I don't know, but they did know they were going with the captain on a speed boat. They surely didn't help themselves. I know the captain should share some responsibility, but I personally don't think he's liable. Irresponsible, surely
Absolutely, captain knew that it was rough and his responsibility would of been to inform the passengers to remain seated and not standing up in the boat, anyone who has a fast boat should not have people standing up at that speed on rough water!

I used to live in SW Fla and I remember the story of a family in a boat like this, hauling ass, hit a wave that stopped them in their tracks and decapitated the whole family on the windshield… my dads a boat mechanic and works on the cop boats, they told him the story, he told me when I was about 24.. I’m 40 now and it still gives me chills….

Went out 6feet tall came back at 5 foot 10 inches in pain. That’s why they have seats and seatbelts and in some the seats have shock absorbers built into them to avoid back injuries.
On Miami Vice, they used experienced stunt doubles and experienced racing boat captains to run the boat at least early on.. They did teach Don Johnson how to properly drive one. I remember a scene taken from a chopper of Johnson and Phillip Michael Thomas (who played his partner Rico Tubbs) while they bounced along through big waves in the Scarab, Johnson was loving it but Thomas clearly was not enjoying the whiplashing ride at all!
Spent 4 years in the Coast Guard and those tye of idiots should never own a boat. Multiple timed air lift injured to trauma centers. And absolutely they can be held liable for any careless related injuries.
Just like a car is passenger didnt wear seatbelt driver slammed on brakes to avoid somthing you flew out . Not drivers fault you didnt have seatbelt. Anyone else in car or atleast drive happy he if he did.. have a seatbelt wich saved his life . Everyone knows what dangers come with being in a high speed / powered vehicle water or land

I live on a boat, work on boats, spend a lot of time out on different boats. I learned a long time ago that you don't go out on the water with someone you don't know and trust. Too many ways and too easy to get hurt or killed. It's supposed to be fun, not life altering.

They really should have special aircraft type seats with shock absorbers and racing harness and hans. Then they could explore the strengths of the boat with safety.
