I work at Warrington hospital and am a key worker. I have to pay to park at work (taken from my pay) and it’s nigh on impossible to get a parking space. Unbelievably, Highview parking own the car park. I received a fine for parking not in a designated space, but was not causing an obstruction or blocking anyone. I emailed them and said I wouldn’t pay. Now they’re threatening debt collectors and court unless I pay £120. They must make a fortune out of staff who can’t get parked before their shift starts. It is utterly disgraceful.

you did not receive a fine.....you have to have attended a court before anyone is fined...its nothing more than an invoice...just ignore

If you get a PCN from the police where you are under the contract of your drivers licence required to legally supply the name of the driver and the address of the driver. There's a legal loophole do not sign or date the PCN form just send it back recorded delivery signed for Track and Trace mail. They will pursue you to invite you to sign it and date it but you don't have to there's no law that could force you to sign a witness statement against yourself which could be used in court and that's what they do these n i p forms are a witness statement against yourself. Looking the back of these forms it's called a statement. So you'll be signing a statement against yourself😂

I was fined at Morrison parking for overstaying while my car broke down due to low battery. I stayed in the car while waiting for a family friend to come over and jump start the car. I am in the process of contesting the £170 PCN

Dont pay it, council ones you have to. You get 20 threatening letters and after 9 years they stop. If you move update them of your new address. If they send court papers wgich is rare follow latest advice online. Landowners just turn round and say they cant help when they actually employee the cowboy companies

I have not contacted the Euro Car Parks Ltd. but instead I have sent an email to Morrisons customer service explaining what had happened. after shopping at Morrisons I only found out that car wont stop when I was about to leave and waited for it to be fixed. there was no way for me to prevent the overstay. if the Morrison doesn't cancel the ticket then I intend to contest the PCN and will get online solicitor help to challenge this invoice.

Let's just hope you never get taken to court and made to pay a much greater sum with court costs thrown in. I don't think you would be too happy with him them. Just trying to save a few from the misinformation.... not everyone gets taken to court that's true why risk a much bigger payment when you can normally pay half original demand if paid within 14 days, then learn your lesson and look for then read any signage. If there definitely isn't any signage you stand a good chance of contesting the charge.

​@@c.m.s5071contest first BEFORE paying and before the 14 days are up. That gives you time to gather evidence if you believe the fine is incorrect or even time to find the monies to pay the half sum.

​@c.m.s5071 but if everyone paid within 14 days, I mean ni fuss or appeals, then you're encouraging a lot of people to pay when they're not at fault! Mine was £50, I appealed and it went to £100, then they added admin fees. At this point, they want £155 and if I go court I could have to pay a bit more, not much, or I could win (I have good records and evidence) and then seek my own time and costs, which is actually in the court budget that people don't know about. Why are you so concerned people just pay?

The PCN was on the inside of the tiny car park not as you enter. There is a council planning information board on the outside and the parking company notice on the inside. After leaving after 3 minutes I get a PCN and after appearing I get a fine from debt collectors an increased fine. Someone said pay they could send bailiffs you should have paid £60 within 7 days

I parked in a lay by next to a shopping centre. No signage on lamp post so I went for coffee. A week later demand came through from parking company saying I had overstayed. I appealed on the grounds of no signage. Heard nothing then a demand for £170. Tried to phone, nothing , tried to email nothing. They just want your money. If there was signage there and it was on their land I probably would have paid the initial £60.

Dont pay, unless its council and then you need to. Im 7 years in on mine and the letters have dried up, i have received around 20 threatening letters threatening all sorts and usually red. Just make sure if you move you send a recorded letter to the debt collection agency with you new address. This avoids if they do try a court appearance you are fully aware. If they send papers to your old address and dont attend court you could end up with a ccj against you. Very few cases go to court. Collect any information you have about the location, photos or local stories about other people being unfairly trapped.

It’s good advice, but once the parking company employs a debt collecting company to come after you for payment and you don’t pay the debt collectors, they will file a civil claim and take you to court. The problem, then is, if you don’t follow the courts directions and acknowledge the civil claim against you within 14 days or file a defence within the time frame allowed. The debt collectors can win the case by default. Then the debt becomes real, you are legally bound to pay by law once there is a CCJ against you. Of course you can appeal, but it would be a lot cheaper to pay the judgement fee and be done with it.

Rubbish! No problem at all, just make sure if you move you send a recorded letter with your new address to them. Chances of taking you to court are slim and if they do fill out the papers and attend, they rarely bother showing up in court. You just get many threatening letters. Seems to go quiet after 7 years and 20 letters. They are the criminals not you.

I recieved 1 of these invoices whilst recovering a vehicle at 1220am where signs are not lit up I'm going back there to take pictures / videos after 12am just to gather extra proofs and going to appeal it 1st reason I was recovering a vehicle which they can see on the cameras, 2nd reason no lit up clear signs at that time, 3rd no loss to the landowner due to businesses being closed, 4th there's a council sign in front of this saying 1 hour no return so confusing and misleading hopefully they can see this and accept my appeal absolutely spoiled my mood

I think their success is largely based on intimidation, sadly it probably works on vulnerable people. I can understand them chasing piss takers commuting to work every day leaving their car for 12 -15 hours meaning other customers can't leave their car there and use their business but threatening nanny pat on a one off offence for 20 minute overstay with debt collection and county court is bit of a piss take. I won't be paying mine that's for sure until a judge in court tells me I've got no choice

They have sent me a letter that they will send the case to solicitors and that they strongly urge me to pay them. I only parked there for 3 minutes and there is no signage visible until you enter the car park .

Seems to be lots of confusion surrounding this. A Parking Charge Notice is an invoice from a parking company whilst a PENALTY Charge Notice is usually from a local authority (Council). Both are Civil cases but Penalty Charge Notices are issued from approved devices that record the make, model, VRM of the vehicle, plus photographic evidence and more importantly, Penalty Charge Notices are issued by properly trained and qualified Civil Enforcement Officers and their operating mandate is covered by a Traffic Regulations Order (TRO) which is publicly available.

Have the rules changed now? I have recieved a parking charge notice letter to pay £100 reduced to £50 if pay in 14 days, should I appeal? Would I lose the option to pay reduced amount if appeal fails? Could they he challenged on grounds of unreasonable charge specially when no loss to land owner? Or to avoid hassle of ccj, bailiffs chasing debt, employment and mortgage affected is it better to just pay?

I have been given 2 Both at the same site and both accounts due to people who work there telling me to actually park there to avoid parking tickets. One ticket actually shows me going through the security gate and are claiming that I was parked there! Either it is negligence or entrapment.

I stayed at Premier Inn, on their website it said there is free customer parking at that hotel. They took my vehicle registration at reception. 10 days later I have been issued with a £200 PCN from a company called ParkMaven. I am presuming I can get Premier Inn to cancel this? And if I have to appeal to ParkMaven I can include my booking and payment receipt and they will leave me alone?

I did EXACTLY the same as you. I reg'd my vehicle with reception at The Cedar Court, Harrogate (were I have stayed on numerous occasion in the past with no probs) I had 'free parking' on my hotel deal and with late checkout that I did not use. I month later Parkmaven send me a threatening letter demanding £60. I contacted the the hotel, they said they would sort it. However I have had 'two' more demands from this ghastly firm, the latter threatening me with Bailiffs blah blah! I have NO in tension of paying a fine I did not deserve! I shall take this up with my local radio station, citizen's advice and my MP if this harassment continues. These firms should be shut down forthwith by the government and nationalised and run fairly and honestly. They have picked on the wrong bloke with me, I will not let this drop!

I parked where I sometime used to park. My daughter seen the signage my English is not too good. I inquired at a shop next door they said there is a fine if you oark here. I removed my car and in a weeks time got a PCN to pay £60. I appealed on the parking company's website I was only in the small space for 3 minutes according to their CCTV footage. Now a debt company demand £170 the parking company did not reply to my challenge appeal on their website. What shall I do only 3 minutes this is a no parking area. I have no proof I appealed on their website although idid

They will do that, as long as its a private company and NOT the council they always pass the fine to a debt collection agency. My one was passed on to three different ones over 7 years. The letter are always threatening, but in actual fact its just an invoice. If you dont pay and move update them with your new address as they may decide to take you to court. If thwy send the legal paperwork to your old address you will never know and probably end up with a CCJ.

@@insan4508 They mostly target multiple offenders, but always a chance. Most people get worried over threatening letters and pay. Do what's comfortable. Always risk of ccj without your knowledge and you wouldnt know until you apply for a mortgage, credit card or loan.

In the exact same boat. The £170 includes unlawful add on by the debt recovery company. There is at least one other example of this that I have read online which makes me think they are deliberately not sending the appeal verdict and just passing it to debt collectors. People need to make a stand on this and we will not pay the £170 and will definitely go to court. Just ignore all the debt collectors threating letters but not anything that says Letter Before Claim, that means they are taking you to court. They are hoping you don't respond so they get a default judgement and can then get a CCJ issued. If it does go to court even if you lose they will throw out the extra £70 so nothing to lose in defending it. They scare people hoping they will pay up.

@@paulstimpson8373 The CCTV recorded the vehicle to have been in the tiny car park that was commonly used for short stay parking prior to this. A second demand for a final penalty payment was not send the case was passed on to debt collectors. How do the debt collectors threaten you through letters? What will the court letter look like? If the case goes to court can you be asked to pay court charges. Does 3 minutes CCTV recording define this as parking or just entering and leaving

This I formation is now out of date they do not Persue the driver they now persue the registerd keeper of the vehicle. They do not have to prove who was driving the vehicle they go after the registerd owner who is liable.

By MARTYN McLAUGHLIN Published 12th Oct 2017, 01:00 BST Awoman who was ordered to pay £24,500 in unpaid fines after ignoring hundreds of parking tickets has been declared bankrupt with debts totalling more than £37,000. In a landmark ruling at Dundee Sheriff Court earlier this year, Carly Mackie was told she had to pay the unpaid charges to a private parking company. The 29-year-old had taken to parking her car in the city’s Waterfront without a permit. She claimed she had a right to park in the area as she was living there at the time. Ms Mackie, from the city, also believed the charge notices could not be enforced under Scottish law. However, Sheriff George Way said the charges served against her by the firm, Vehicle Control Services (VCS), were from a “valid contract” and she was liable for them. The parking tickets were left almost daily on the windscreen of Ms Mackie’s Mini, which was parked in front of her parent’s garage, near their West Victoria Dock Road home. There were eight signs in the vicinity, advising motorists that they could only park in designated areas, and would require a permit to do so lawfully. Those found parking without a permit were liable to be fined £100 a day. VCS took Ms Mackie to court last year when she racked up an £18,500 bill for ignoring more than 200 penalties. Sheriff Way ruled that Ms Mackie had to pay the outstanding charges, including interest, charged at eight per cent a year, until the debt was paid. It is thought to be the biggest ever parking fine in the UK, and the first time a Scottish court has ruled on a dispute between a member of the public and a private parking company. He said in his judgement: “She knew perfectly well what the signs 
displayed and that she was parking in breach of the conditions. “She stated (effectively a protest position) that parking charges were illegal and unenforceable in Scotland and that she could park where she liked as her father’s guest. “The defender is not the tenant. The defender’s car was an additional burden on the parking facilities and she was the same as any other interloper. “She was offered a permit by the factors (at a reasonable charge I think) but she refused on principle.” Sheriff Way added: “Parking is not only an amenity but a valuable commodity in modern life.” But just six months after April’s ruling, Ms Mackie has been declared bankrupt with debts totalling £37,546. Documents lodged with the Accountant in Bankruptcy (AIB), the Scottish Government agency responsible for administering the process of personal bankruptcy and corporate insolvency, show that she has now left Dundee and has moved to Paisley in Renfrewshire. She is working as a member of the cabin crew with an airline. The case summary filed with the AIB show that Ms Mackie was awarded sequestration - the legal term for bankruptcy proceedings - on 22 June. Ms Mackie was not available for comment. So, yes there is a difference between a parking charge penalty and a parking charge notice. The notice is an invoice for breaking the contract and the company has to make the effort to take you to court to get the payment. Its up to you, take the chance or pay the first initial charge or end up like this woman who obviously believed the BS spread on the Internet. Look for signs, read signs and heed the warnings, stop being gullible. It doesn't matter where you live in the uk you can still be takes to court and made to pay with added costs.

Scottish law differs, council fines pay but private ones no. She had £26k worth of fines(invoices) so a private company is bound to chase and be succesful. For single fines its just not financially viable for companies to take you to court. Nice copy and paste👍

@fiveminuteman I know scottish law differs, but as I've said, you can be taken to court and made to pay wherever you live in the uk. I am also proud of the copy and paste, took a while to remove the adverts. I also stated that it was from the Scotsman newspaper from the get go. So you still think its good advice telling people they don't have to pay a parking charge notice? I have had to pay charges on four occasions (not mine, we have a fleet of cars for our business, so in our case 9 out of 10 drivers are not the owners of the vehicle) because employees have ignored the parking charge notice which has then doubled and in some instances more than doubled. Asking them why they ignored them, the answer has always been, because they thought they didn't need to pay them as they were not a fine. Guess where they got the wrong information from, yes, social media. Why have I got a bee in my bonnet about this subject? Because, yet again, this week, I'm having to deal with another employee who has not paid a parking notice that has doubled and we have been sent the bill. She claims the same reason for not paying, she thought she didn't need to pay, just ignore it and it will go away. She read this on Facebook. The advice you give here is wrong and could lead to more people parting with more cash than necessary, which in my view is irresponsible. Keep up the good work 👍

@@c.m.s5071 You can be taken to court but highly unlikely for 1 invoice, if you have £24k worth of invoices you are highly likely to be targeted. Advice is always pay council ones, but never these cowboy private companies. Hope this helps.

In fact, you have someone here in the comments, stating they followed the advice like you're giving and ended up in court having to pay from one invoice. You're not helping me or anyone. Proper advice would be, be careful where you park look for any signage, not just signage that may or may not be outside a parking area, read these signs and follow the instructions as they are a contract that you have agreed to by parking in that area. If you get a parking charge notice pay it promptly at the reduced rate offered and save yourself a lot of grief. Don't do what the five minute man is telling you to do, spend 5 minutes checking where you're parking, you could save a day sitting in court.

​@@insan4508 my story is that. Few years ago received cpn from civil enforcement ltd parking company. And never plan to pay, after a month received another one, because i overstayed again 😂 They started to bombarding me with scary letters for over a year. I just piled them up. One day received a letter from county court, so replied them online. Did not cost me a single penny. Then these cowboys decided to take me to county court by going there. And guess what, these cowboys didn't show up. And it was all finished. I could possibly counterclaim for threatening me and wasting my time, but i was lazy. And i am lazy to write here, and i could explain you why they never go to the end. With few words, it's too expensive for these companies to hire solicitors for these cases, and they will never recover that amount of money they will spend at court. Plus they know that to win there is 0%

I don’t plan to pay myself for three minutes spent in the car park when there was no signage on entering the car park. Did they reply to you when you replied online. I am very lazy too they have sent me two letters at the moment.

I ignored them and ended up with a CCJ I was worried about it for over a year I didn't want bailiffs coming round as my mother is 84 and would have been scared I ended up paying nearly 300 quid Thanks a lot pal.......!

Thrill Seeker they wont as it has to go to court first. Unless they dont send the papers or you move without giving them your new address so the papers go to your old address. Its a cash cow for these parking companies and last i heard the rules are going to be looked at.

5 Minute Man no it’s private car park spoke with the company who’s land it is they said they can’t do nothing to help me just advised me not to pay but I can’t afford to have any bad credit or ccjs as I am getting a mortgage ,if they send me a letter after ignoring the ticket on window and I ignor letter to they defo can’t send dept recovery ?thanks for your help too.

Thrill Seeker I received 10 letters chasing the "invoice" then about 20 text messages saying it was going to go legal. The last Txt was Christmas day then nothing. They have about 7 years to chase the debt and possibly issue court papers. My situation is different so I don't need any loans or mortgages. The only risk is if you do move and they send the papers to your old address and you never see them. For peace of mind it could be worth paying and if I was younger I probably would have. The other side of the coin is that 9 times out of 10 if it goes to court you normally win. I believe the larger parking cash cows use a well known solicitor for taking people to court. Google it as they have a poor reputation. I don't mind paying my way on taxes, fines etc but I don't believe being charged £100 for a 10 minute overstay is justified.i pretty much forgotten about mine but initially it played on my mind daily like a pain I the rear.☺

Ive tried contacting group nexus. I have to out PCN in and registration number in. When i di (repeatedly) its saying not recognised. Ive tried to make cintact but with no luck at all. Its a scam. The fkrs are pissing me off
