When do you need a license for a song and how can you get it? Songwriting coach Trina Belamide continues her talks on music copyright and answers this question which so many singers ask regarding singing at private functions or public functions, live singing at gigs or doing covers and cover versions. Hi Miss Trina, for example, im producing an instrumental/beat, and i incorporate a sample from a song of another artist, do i also need to get permission? Technically it is not a cover, for example i am just getting an excerpt or a part of the old song and try to loop or sneak it to my new song.

Hi Marco! I think what you are doing is called sampling and yes, you would certainly need permission from that artist or their producer to do that. Even beats are considered intellectual property, and some artists actually sell them or make an income from them. So yes, you would really need their permission.

For covers, it's both mechanical and sync because they have visuals. I've heard that the workaround that some artists rely on is Content ID which enables rights holders to claim ad revenue from these cover videos. FILSCAP does claim for the MR (Mechanical Rights) of songs for which it has the authority to claim (given by Publishers and some Composers). But the safest thing to do is really contact the rights holders and ask permission. It doesn't necessarily mean you'll be charged. You could be but still safest to let them know.
