I actually answered my own question on a recent play through... if you don't take the gun, you don't get given your handcuffs either

You can fire it in Police Quest 2, though. You have to shoot back when Jesse Bains attacks you, and you waste him at the end of the game

Yeah I know I find that game a bit odd to play through
