A recent CBC Fifth Estate episode about polygamy has sparked debate amongst Muslims. The investigative report featured an imam who officiates marriages for men who want to have a second wife. Some of these marriages are kept secret from the first wife. Because the marriages are not recognized or registered under Canadian law, the women in these relationships forgo their legal rights and are often treated unjustly by their husbands. So now we have to ask: Why was the practice of polygamy permitted according to the Quran and the teachings of the Prophet Muhammad? And should polygamy be practiced in Canada?

Thank you Doctor... To summarise, if I understood well: the principle is monogamy; Polygamy is allowed exceptionally when that brings justice where strict and rigid monogamy rule would bring cruel injustice. The objective is therefore JUSTICE, not satisfaction of men's lust; Quran says it clearly. Monogamy is indeed the principle according to the Quran; because: 1. Quran says God created a couple of one man and one woman to start with (Bible and Hadith name them Adam and Hawa). God could have created one Adam and many Hawa's, or one Hawa and many Adams, but he did not. 2. Nature (God's creation) also points to parity of sexes (therefore to monogamy) according to demographic statistics; except where disequilibrium has been brought about by catastrophes (natural or caused by human). 3. Let us also take into account the instinctive dislike of polygyny among all women; and the instinctive dislike of polyandry among all men, except when they objectively see it as a remedy to an unjust situation they dislike even more and want to correct... Men and Women, also God's creation Therefore, Nature and our Inner instinctive feeling agree here to prove what Quran meant on this subject, as per Verse 41:53 (fussilat) [we shall show them in Nature and in themselves our signs (the same that are mentioned in Quran) until it becomes clear to them that it is the truth, etc.] ------- God never contradicts himself! (a) Nature, (b) our natural unbiased instinctive feelings and (c) Quran, all coming from the same God (the One, Unique and Universal God), they cannot contradict each other.

It seems you have a good grasp of this. Would you be able to shed any light on my questions above- I'll copy/paste my comment here: "So what is the conclusion on the practice of polygamy itself? If the Quran lays down explicit conditions for it's practice, then doesn't it follow that its practice outside those conditions is forbidden? If so, how do we reconcile this with the Prophet's polygamous marriages which did not always meet those requirements? Why should a believing woman feel such a sense of hurt as to prevent her husband from a practice that God has allowed him? Moreover, why should this be sufficient reason for him to actually refrain from the practice? I just can't get behind the idea of forbidding something purely because it hurts someone's feelings - while emotion has it's place, laws are supposed to be based primarily on reason and logic. I was under the impression that monogamy is the prevailing norm because it's the stronger institution and therefore produces a more stable and prosperous society. Polygamy creates a social imbalance wherein men with more resources 'hog' young (mostly virgin) women which creates a deficit of eligible brides for the men with fewer to no resources. This in turn creates a discontent male underclass which in turn breeds many social ills including more violence and generally less safe environment. Not to mention the plethora of other issues including mental health problems amongst the women; developmental problems in the children resulting to some extent from the part-time fatherhood that comes with polygamy. It would be great to see a more in-depth and comprehensive analysis of this (and other) hot button subject that addresses the points above."

@@Muslimah1987According to ISLAM, marriage is a contract between a man and a woman. So woman have right to prevent her husband to get married again. You're not buying a woman as your permanent partner. Marriage is just a contract that depends upon mutual faithfulness,love and respect. So if any partner go against this contract and don't take spouse opinion that Means you're not following ISLAM. The same reason Prophet Muhammad didn't allow his son in law to get married. Prophet said that my Fatima will get hurted. Don't give excuse man to fulfill your lust. Don't defame ISLAM.

Siddiqui 456 the contract of marriage was only interpolated recently as a state use to control population. So what about women who may initially be hurt but quickly come to terms and be receptive of their circumstances that would allow the women to take care of each other under one or two roofs? Then that contract is obsolete. When people can actually apply reason and logic without emotion then we could be more progressive about the concept to where we could improve and reestablish community life.

@@xadam1964 I suppose because it brought more justice than rigid monogamy in the circumstances that prevailed then. Polygamy is allowed as an exception when circumstances are such that imposing monogamy would be crual injustice. Also, from the little I know he married his women before receiving the revelation about marriage rules.

The second (third, and fourth) wives are only married Islamically by way of nikkah but are not granted legal marriage status Canada or the US. Lots of potential issues with this…

@@elisalopezdelacruz3563 Polygamy only applies to widows with lots of orphans as the qur’an says. And no,the amount of men and women are roughly the same..even in some country there are more men and women..and Not everyone has to get married..what about people who died before they got married? And what about poor men who cant afford his daily needs let alone other women’s needs? And what about rich people who are majority more evil and arrogant who cant even do enough good islamic deeds yet?!

IMHO a line needs to be drawn between polygamy and polyamory Parading as polygamy. Polygamy is an institution.....a form of marriage....in which Al. Parties are apprised, have input and come to an acceptable resolution.If some one is playing "I gotta secret" ,that's not marriage. I dont mean to offend, but I do want to say that I am increasingly dismayed at the co stant reports of malfeasance conducted in the name of Marriage. What gives these people the right to play fast and loose with the rules?

You know I looking at the comments that people are posting and one person is right there is so many unanswered questions ???. There is one thing people got understand to when the books were written whether you want to call it the Bible or the Koran no matter what holy book remember times were different we didn't even have the technology that we have today when these people wrote these books they wrote according to what was happening in their tim. This is why many words that you see written in the books if they were to be written today people will use the events that we have today to describe. you know you have to remember they don't carry the world in the time was going to continue the same way as long as man exists but the reality is the world has changed culture has change technology has changed the world you know you see things written where people described by writing and they use the horses because in that time there was no such a thing as automobile there were no planes so people use different terms of words that they knew that they can use in their time to write the Books. if these books will be to be written today they'll probably use airplanes, automobile or whatever technology we have today I know this is very hard for so many to swallow. this is why I tell people don't get caught up with the books don't misunderstand me what I'm saying it is important to books but you must get caught up with the god the Creator Allah or whatever name you use in your language. some will say elohim. it is more important to have a relationship with God because that's the source. You remove yourself from that source and you will lose your connection to to the one that give life. Ahadumiliah

Therefore legally allowing unconditional polygamy and relying purely on men's benevolence/social pressure to regulate it, seems an atrociously unfair thing. @@Muslimah1987 if Muhammad's daughter Fatima can't tolerate her husband to get married again, then why you're expecting from normal women. First go and ask why Muhammad didn't allow Ali to get married again and again. Why Ali have only one wife Fatima. Prophet wants that Ali shouldn't practice best sunnah (polygyny). A lot of injustice and nonsense rules and regulations in Islam. Now I understood why people with good understanding leaves ISLAM. It's just because ISLAM makes no sense. Dr Shabir Ally is just defending Islam unsuccessfully.

@@siddiqui4564 You may have a point. Which is exactly why Dr Ally and others need to cut the apologia out and focus only on being entirely faithful to God's word alone. Watering things down for PR purposes helps no one and is only driving people away who feel confused and eventually disillusioned by all these contradictory ideas.

My understanding(to simplify it) is Financial and Emotional/Mental ability. With that being said if a person is making around 300k per year with minimal work(business owner) invested and is a practicing Muslim. What would prevent said individual from doing justice between wives and children? IF the man and both women were truly righteous they would assist each other to raise the children in the most respectable way islamically. Another point I would like to mention is Aisha(R) was the most jealous mother we had, and married the youngest at 9 years old. She should have been the most exposed to mental instability, especially because of her age. But no, rather, she was the most learned scholar among the sahaba kareem, because of her, we have over 2000 authentic hadith which was only with her. Subhan'Allah. Not only that she was the commander and leader on the battle of the Camel. I also understand the examples you and I mentioned are exceptions, and we don't base rules and laws on exceptions. Allah'hu alim. Allah will judge every individual accordingly. and polygamous relations are extremely difficult. I myself would prefer not to enter into a polygamous relationship, as my wife and 2 children take up all my time. I have very little time to read and gain knowledge. BUT if a situation occurs where it would be the best course of action to take. My wife and I both say: If it is Qadr of Allah the we accept the extra members to our family. Especially if there are orphans to take care of. Jazak'Allah for reading Salam'alaikum.

This knowledge is free to all who seek it out, especially in our day of unprecedented access to information via the technology we possess. The qur'an can be read in any language alongside the Arabic version, and available in more versions than just the 1924 canonized qur'an edition most commonly used today, as are all the haddiths~though I personally only study the sahih class haddiths. There is no great mystery in studying islam, it merely takes time and patience to work out the abrogations and striking inconsistencies.

This was a fascinating conversation. As a Christian revert to Islam, the correlation between what the prophet does and what is prescribed in the Holy book sometimes differs. Biblical accounts say that Jesus the Christ (pbuh) never married but that clearly is neither the practical nor moral standard for those who followed his teachings. I humbly submit that the same may also apply to the prophet Mohammed, pbuh.

This man doesn't teach classical teachings of Islam. To be honest he is giving his own opinion not the classical teachings. He told many contradictory things in the past but this discussion doesn't seem to do that. It's your life and your feelings are more important than your spouse's and you should respect what your spouses think.

Dr. Shabir is refusing to directly answer the question. He's trying to respond from his cultural context, that is, presupposing Western norms in his reading of the Quran. Find one Muslim scholar not from or living in the West that answers this question as Shabir does?

We wont find any scholars that answer like Dr. Shabir because they will speak with evidence. The evidence presented by Dr. Shabir is amazingly biased. Like you mentioned it, its the western ideologies mixed up with his readings of Islam. Im very disheartened Dr. Shabir would scoop to this level. P.S I have 1 wife and I'm good. I don't believe I can do justice with another one.

Muslims are already practicing polygamy in Canada and on a larger scale than they would be able to in their countries of origin given that Canadian welfare pays for their lifestyle choice. DNA testing to verify who the father of the child is not a pressing matter. The stock answer is ... ''It was just one night- I don't know his name'' and they get a nice home for cheap rent while 'The Man' goes back and forth, switching women and sometimes convinently in the same ethnic-cylo-public-housing-complex to breed to his heart content while John and Jane que public got to work, struggle to support one child and pay down a mortgage and paying out a heavy tax load.

The reason prophet Muhammad didn't get married on his first wife Kahdjah, first of all she proposed to him because she was wealthy women and the prophet was her employee, now you tell me how come you think she will allowed him to bring another women? not possible. That is what kept the prophet from marrying 2nd wife, but as soon as Kahdijah died he started marrying women not only 4 but many of them,plus the women who gave themselves( sleep with him) with out getting married to the prophet. So Dr. Shabir not telling the truth and he know it.

Everywhere in the world the book and the law of the land are at logger heads. Muslims needs to be self critical and understand that in modern age these sorts of archaic laws have no place.As the other imam said if you find it hard to follow Canadian polygamy laws then leave for other countries that allow it. Best I have heard from the conservative Muslim clergy.
