In this lesson, I learned the difference between the Preliminary Investigation and Inquest Proceeding. The purpose of Preliminary Investigation is to determine if there is probable cause for the purpose of filling an information however in Inquest Proceeding the purpose is to determine if there is valid cause for the continued detention. I was able to see the difference between a preliminary investigation and an inquest proceeding. Preliminary investigation takes place before the guilty party the offense is arrested, while inquest investigation is done after the offender is apprehended. What is a Preliminary Investigation? -It is an inquiry or proceeding to determine whether there is sufficient ground to engender a well-founded belief that a crime has been committed and the respondent is probably guilty thereof, and should be held for trial. When is a Preliminary Investigation required? -It is required to be conducted before the filing of a complaint or information for an offense where the penalty prescribed by law is at least four years, two months and one day without regard to the fine. What are the purposes of a Preliminary Investigation? - To protect the innocent against hasty, oppressive and malicious prosecution. -To secure the innocent from an open and public accusation of trial. -To protect the state from useless and expensive trials.

Preliminary Investigation -It is an inquiry or proceeding to determine whether there is sufficient ground to engender a well-founded belief that a crime has been committed and the respondent is probably guilty thereof, and should be held for trial. Inquest proceeding - It is an informal and summary investigation conducted by a public prosecutor in criminal cases involving persons arrested and detained without the benefit of warrant of arrest issued by the Court for the purpose of determining whether or not these persons should remain under the custody and correspondingly be changed in Court Office. After watching this video, I am able to differentiate the preliminary investigation and inquest proceeding. Preliminary investigation is proper when the person is not yet arrested and detained. Preliminary investigation is to determine if there is a probable cause to file an information. After gathering information from the preliminary investigation, you can now issue a warrant of arrest. In the inquest proceeding, the person is already arrested and detained. Inquest proceeding is also summary in nature. LESSON 18 I learned the differences and similarities between preliminary investigation and inquest proceedings. Both are the responsibilities of a public prosecutor. The difference is that in preliminary investigation, the person is not yet arrested and accused, whereas in inquest, the person is already arrested and held. Thank you for differentiating these two things po, because of this lesson we clearly understood what are the differences of preliminary investigation to inquest proceeding. Even though these two are the same in terms of investigating still there are a lot of differences just like in the preliminary investigation, this is conducted on a person who is not yet arrested and detained therefor there will be a regular filing and the warrant of arrest is not yet issued, its purpose is to look for a probable cause to proceed and file an information letter to the court. On the other hand, inquest proceeding is for those who are already arrested and detained that's why there is no regular filing to this situation. Its purpose is to determine if there is a valid cause for the continued detention. On this part, warrant of arrest is not needed, here, they will go back to the three basic rules of warrantless arrest and find out if it is valid. This is just a simple explanation yet an informative one, thank you for this Attorney.

Good day Atty. I learned today the differences of Preliminary investigation and Inquest proceeding. In PI the person is not yet arrested or detained, Regular Filing, the purpose of PI is to determine if there is probable cause and No warrant of arrest yet. In IP the person is already arrested and detained, they will conduct summary in nature. The purpose of IP is if there is valid cause for the continued detention. IP no need for warrant of arrest. In this video entitled Preliminary Investigation Vs Inquest proceedings, I have found out the differences between Inquest proceedings and preliminary investigation. In particular, Preliminary Investigation is for those individuals that are not yet arrested, while the inquest proceedings are for those who are already detained. Good day Atty. This gave me a lot of information and understanding, not only in the differences of Preliminary Investigation and Inquest Proceeding but also in their own purpose and function. I've learned that they were both mandate and duty of a prosecutor. Their differences defines their purpose. Preliminary Investigation were conducted to determine if there is a probable cause to file an information while Inquest Proceeding were conducted to determine if there is a valid cause for the continued detention. So that Preliminary Investigation is where the offender is not yet arrested, not yet detained and no warrant of arrest yet while in Inquest proceeding offender is already arrested, detained and no need for warrant of arrest. Lesson No. 18 What's the difference between an investigation and an inquest? - An inquest procedure, which is a quick and informal investigation, is conducted by a public prosecutor. When someone are detained and imprisoned in criminal proceedings without a warrant of arrest, the court will analyze this information to determine whether or not they should be retained in custody. - A preliminary investigation is an investigation or action done to see if there is enough evidence to warrant a reasonable belief that a crime has been committed and that the responder is most likely guilty and should be held for trial. When is it appropriate to conduct a preliminary investigation? - The person has not yet been apprehended. - The individual has not yet been apprehended. - Consistent filing - To figure out if there is a good reason to file a report - No arrest warrant has been issued yet. Preliminary investigation is appropriate when the person has not yet been arrested or detained and requires regular filing; the purpose is to determine whether there is probable cause to file an information and no warrant of arrest has been issued. While an inquest proceeding is appropriate when a person has already been arrested, detained, and requires a summary in nature, its purpose is to determine if there is a valid reason for the continued detention and no need for an arrest warrant. Good day Atty! Thankyou for another lesson. I've learned a lot today. Lesson #27 What are the differences of preliminary investigation and inquest proceeding? The Preliminary investigation will take a longer path. This allows both the complainant and the respondent to refute each other. When the complaint, via an affidavit, is filed, respondent is given an opportunity to file his counter-affidavit. While in the Inquest proceeding, the respondent is already in custody. With the affidavit of the person who personally witnessed the crime, chances are the fiscal will find probable cause. This no longer entails any exchange of affidavits. The prosecutor files the complaint with the court. The court proceeds to trial. When is preliminary investigation proper? • Preliminary Investigation is proper when; 1.The person is not yet arrested 2.The person is not yet detained 3.Regular Filing 4.To determine if there is a probable cause to file an information 5.No warrant of arrest YET. In a Preliminary investigation, the person is not yet arrested and detained. It also will go in regular filing and its purpose is to determine if there is probable cause to file an information. On the other hand, in an inquest proceeding the person is already arrested and detained that's why it will go to summary in nature.
