As per my little understanding of this section is the object of legislation to give presumption of access between his Mother and any man during existence of marriage , it is private act /relationship between them and no one has such evidence of such relation or rearly has evidence to prove it access.therefore presumtion of access is given .existence of marriage relationship is itself presumed to be proof of availibity of access or had access.Therefore if man wanted to prove no access the legislation gives legal right to him to prove non access , which he can prove it by any of evidence, which he can prove it.

Law created by vote purchased with valid consideration.same was executed with help of the judiciary for the welfare of the vote sellers India is a democratic country

Evidence act does not provide for evidence of marriage . It’s the seven steps that are required and eligible age . Polygamy not permitted in Hindu marriage so if a divorce has not taken place the social contract is maintainable but any behaviour contrary to it is an offence or if done by a stranger without the consent a crime .
