many a time the greatest challenge is what is in book and what is in practice.

Faizan Saheb, Very eloquent lecture. Legalities apart, the dichotomy between Sharia and constitution are too many. If the Muslim population has to progress, it should be the duty of eminent and learned men like you to impress upon the population to allow discussions and bring in the reforms. The triple talaq is banned in many progressive Muslim countries. And any divorce has to be agreed between the partners only in the court of law. You have talked about the better examples of Muslims laws prevalent in Medical period, such as Slave Girls which is in very poor taste. Proposing examples of Medieval versions of Sharia will never allow the Muslim population to come out of ignorance and allow them to be stuck in the ideas propagated by the clerics. You give examples of western jurisprudence and legal greats but still talk about the sharia or muslim personal law. These two things are totally contradictory and only way to progress is to follow a clear cut common civil law without any ifs and buts. Otherwise let there be imposition of a harshest sharia law on all Muslims without any exception. Simple fact is that every citizen of the country has to follow one law and that too passed by the parliament. There should be no other escape. A common civil law which allows for compensation to wives and children and protects then against all kind of domestic violence, allows honourable settlement and divorce is always welcome. But this should be done not by a Kazi, but only front of a Judge or a registrar. It is time that people like find courage and come in forefront to create an atmosphere of change and progress in the Muslim society which is still shackled in medieval ages.

Faizan Sahib is smart , knowledgeable , articulate , entertaining and somewhat pompous. All Good. Now... 1. 96 minutes and FM did not say He had opposed TTT on many many occasions past 30 years. Did he ever file a PIL ? Why not ? 2. FM never suggests his recommendation on a path forward on TTT. ( Gutless ) 3. Faizan Sahib skirts Uniform Civil Law and his opinion on UCL. 4. Agreed , Society mindset will take several generations to change. Dahej is Down. Child marriage is down Sati is down in 20 years, it is likely TTT will also be down... If in Year 2040 , It is clear TTT criminalization has produced Great suffering , no real benefits , Law on Criminal Punishment for TTT can be changed. 5. Faizal sahib... make a recommendation. Just dont toss everything to Uleema. What things progressive has Uleema done in past 100 years ...zilch. 6. Nikah Halala is in the courts ? Your opinion ? तर्क छोड़िये ....कुछ तो बोलिये If AMU throws you out .... so be it.

Criminalization is a necessity even though it is not the full solution. All types of laws dealing with violence need to be criminalized. Dowry related violence was criminalized. You are conveniently talking that it is not a solution but I am saying - it is a necessity. The social solution of course is the social awareness & enlightenment but the legal solution is a criminalized law. Having both is good for the society. People like you can spread social awareness and the criminalized triple talaq law will ensure the end of this evil practice. The Indian justice has a book in one hand (teachings) and a whip in another hand (punishment). You need both salt (teachings) and pepper (punishment) to make a good cuisine.

Dr. Faizan Mustafa SB, Triple Talaq bill is the only achievement of India after independence. It is a great bill, punishment should be increased like 10-15 years because you don't know that ass holes get married with full festival mood and try divorce on WhatsApp.

Faizan Mustafa Forget that Article 13(3) definition of law is not exclusive but inclusive hence many other things may fall in this definition which is law of the land this is also clear by 13 (3). Moreover like any other fanatic Muslim, he is putting arguments against making Tripple talaq crime. and for this, he puts an argument that raises questions on the existence of law itself according to him law doesn't bring change in society.

Muslim Personel Law is law though it is uncodified because it has Divine Authority. The whole universe is governed by divine law. All the schools of Islamic Thought not independent they are bound to follow the Quranic Law / principles. Islam has both under its fold the criminal law & civil law.

Janab Faizan sahab you have talked excellently but recently the courts delivering judgements are totally incontrast with your views and facts of the laws. Be it the case of Triple Talaq or of awarding of death punishments to Yakub Memon in the case of owning a vehicle in his name in the blast case while Pragya Thakur and others in same type of offences registered against them are being allowed to got Scott free, Which law is governing here and what is status of its implementation.
