Ms. O'Shea provides a first rate example of a defense opening that points the finger at a particular alternative suspect, often referred to as the "SODDIT" defense. (Some other dude/dudette did it). Pay attention to the her physicality in the courtroom - her tone, movement and eye contact are what superior advocates should strive to emulate.

The problem with these teaching points, is that they're trying to teach how to appear authentic. If you try to fake authenticity, you've already either failed or given yourself a difficult hole to climb out of. Identify with your client, care about them, and BE authentic. Let the other attorney try to put on a good act, and see who the jury favors.

+jabba0975 - I think you misunderstand how authenticity and skills mix together. They're two separate issues. Let's use writing as an example since it's so closely related. When I started writing novels, I was writing authentically, but my writing was unskilled, so some readers would be put-off by the lack of delivery and flow. As I learned skills to make my prose more engaging, my writing didn't become less authentic. Instead, my authenticity came through with more skilled delivery, allowing the reader to become more connected to the main character and engaged in my story. Same goes for this video presentation. He's teaching skills which will be utilized by your authenticity to help you engage and connect with the jury better. That's the key to any good story or opening statement. Does that make sense?

Whether you're the plaintiff's attorney, or the defendant's attorney, a great opening statement is very important-and it's your introduction to your client's story!

This type of opening is totally improper in a real trial. Opening is to give a roadmap of the anticipated evidence, not to argue or to make assumptions of what a victim thought or felt. All of this would never get admitted into evidence, so why are law students being taught to do opening in a way that is not realistic?
