There is another kind of problem with home buyers that there are more than one phases in a builder project, but he fails to deliver all phases or keeps delaying one or more phases. Important to note here is that even if a buyer gets his flat in say phase 1, but he also owns the common land share with all other buyers and also he is a consumer of the amenities which builder could have planned with next phases of construction. One case I know is that the builder had 2 phases out of which one was delivered with set of amenities covered within the phase 1. But he doesn't start phase 2 at all and the amenities like extra landscape or amphitheatre are never delivered.

All you say is right. But I'm more concerned of those corrupt government officials that are helping these false developers growing the fraud. When a fraud happens, these officials try to cover the developers by giving them blind eyes because they feed on developers' money. If possible, please make a video on this topic.

My querry is that the property owners (developer/builder) generally mortgage their land and avail loans to construct the multistories (flats). In way banks have suo moto charge on flats as well, Now a purchaser buys the flat making cash payment and takes the possession as well. After 2-3 years the owner (developer/builder) becomes defaulter of Bank, the Buyers of flats now (after2-3 years) start receiving notices for vacation as developer/builder has not repaid the Bank dues. How can one take presumptive care in such situation.

I guess u never bought a flat in ur life. Once u book a flat, the builder gives u a huge booklet of papers, which u have to check in with ur lawyer. Only then u go ahead after clearance

Hello Sir, I have one problem. I can get loan upto 50L but I don't have much amount for down payment. Most builders in my home town are asking 20L in cash and I can take only 30L loan. Why are they doing like this? Is this allowed? So many people with cash are buying like this. Is this not considered as fraud by both parties by avoiding taxes?

1.Where can we get professional help? I mean who are those people or agencies 2. Incase if bank is approved for loan 1 person, is there any chance of selling same property to another person 3. Sir, Thanks. But, like this its very difficult to find a free of fraud property. How can we even verify that all papers are correct. Maybe the builder has forged few docs etc. Its really sad to hear. Lifetime saving goes in buying property and still there are few people who does scam.

I had booked flat in 2012 in Panvel, Maharashtra and property was approved by DHFL. After loan agreement they had disbursed loan about 80% without any information. Due to some NAINA issued property was demolished by CIDCO. DHFL recovery agents are frequently threatening me for loan repayment. Also builder is saying he will give replacement property but no any written communication. Please what legal action should be taken.

My Father has purchased a plot of land in Dhanbad 8 years ago. But after some time it was came in to light that the title deed was forged by making special type of Xerox papers. The seller was already having two loans from different banks on the same property. One with original deed and other with forged deed. Unfortunately, seller died 3 years back and land and title was in his name. He has left behind his wife and 3 sons who are not of good nature. My question is that, how to get back my land and/or my money back?

Second bank ke saath saath aapka Paisa bhi doon gaya but aapko dhokadhadi ka ek civil case karna chahiye unke parivaar se paise recovery ka ....kyonki plot to ab first bank ka hai kyonki orginal paper mortgage girvi honge first bank ke paas....

Abhi practice shuru hi kiye hain, kuch din rera ka kaam kiye hain toh samajh aaya ki isme land laws jaise khata khatiyan etc transfer of property and contract ka jaroorat hai toh soche karte hain.. par sir aapse raye leni hai, kya real estate advocates ke liye future me achha prospect hai?

Company ke pass jo current account hota hai usme aur escrow account mein fark kya hota hai.kya dono ek hi jaise hote hai. Kya escrow account kewal builder ke pass hota hai ya developer dono ke pass hona chahiye.

Sir. Mai Noida se hu ya ek colony me bhut se building bane h jisme bhut se flats h. Us builder need apne naam se hi vha ka nam rkha hai, ex.. R enclave Hm vha property kharidne ja rhe hai. Sir maine rent ke liye ek flat book Kiya tha. Lekin broker ne time par kam nahi kiya uski vajah se muze ko flat cancel karna pada. Ab broker us flat ka deposit vapis nahi kar raha to muze kya karna chahiye. Police ke pas bhi gaya tha mai lekin police bhi bol rahi hai ki fir bhi nahi ho sakti! Ab us se paise kaise wapas lu, kaha shikayat karu. Please sir bataiye.

Recently I bought a plot I have done the registration and my name is also on 7/12....after some months the owner asks me to return his plot and tells me I will give money back ...I refused him ..so he said that I will file a case against you that returning the plot ...is there any type of law of returning the plot once sold ...

Sale deed is one way traffic...now after registration property is on ur name...make sure you complete property mutation....

Mutation karwalo jaldi otherwise wo mutation rukwa sakta hai but agar koi valid reson or proof wo nahi de paya to mutation processes ko rok nahi sakta.....uske baad laat marke bhagao usko....
