In a lecture, Rabbi Avi Weiss describes how the Modern Orthodox approach to Halacha differs from that of the Conservative movement. He explains that the practice of the Conservative movement is to adopt an opinion of the Talmud even if it has not been accepted into halachic practice, “In other words if there was a deah in the gemara that never really took hold, but if there is such a deah, that would be enough to lean on. Conservatism therefore remains free to select whichever position within the prior legal history that appeals to it.”
His description of the Conservative approach to Halacha is nearly identical to what Rabbi Linzer (YCT's Rosh Hayeshiva) advocates in “finding within the Talmud voices that articulate those same values that are driving us.” In both cases, a non-authoritative opinion is adopted in order to advance an agenda.
