After the minimum required documents, a lot of attorneys have turned clients away because they can't pay for medical reports that are expensive and at the same time you are running a risk of prescription (3 years).
in practice the most efficient way to get the attention of the Fund is to take them to court. A limit on the Attorneys fees on the panel should have been regulated honestly, now the state attorney has a lot of work and those people are struggling honestly.
Why is it that RAF doesn't reject incomplete claim documents from the initial stage to stop this delay tactics / invoice running by Attornies? I've experienced this invoice running by Attornies in a different legal process and it's a disgusting conduct by the legal professionals. Yes, ke nnete the legal professionals cover each other's tails. From the plaintiff, defence and Magistrate. There are few of them that are truly and really just. It is sad because they charge such a lot of money for something that is uncomplicated and then drag it for the purpose of milking money from clients
@@sibabalwehlabahlaba9355 it looks like he must have ruffled your furthers. What's wrong with cleaning up a system that does not work. We need to get the country working. The country is broke, lawyers can't be enriching themelves with claimants monies.
As an Actuarial Student, I found this interesting, I used to argue that taxis, buses, etc must pay insurance to cover their passengers then in the case of an accident the RAF must become the Reinsurer just incase the claim amount is very huge and there is a limit on it. I am surprised to know that that's actually the case, however the private sector does not seem to want to play their role and the burden seems to be laying on RAF. The private sector always wants to make themselves appear competent, but they are actually very often incompetent and shielding themselves by the state resources.
It's sad. Private sector everywhere in the world always gets shielded by "socialism" of which business people don't want unless it's saving their backside.
@@tranquilsoothingsounds3334 Personally, I don’t think actuaries have an issue with regard to them being pushed away. I doubt they’ll even fight it, I think they just got opportunistic to overcharge the state like everybody else
As someone whi used to insure ubers and bolts i know there was a fee for paasenger liability. When dealing with taxis they had passenger liability as well, with its own fee. Im shocked now. I know uber and bolt etc would not accept them without a passenger liability disc😂. Now they just pushing people over to Raf??
I also lost my father to a road accident back in 1998. My mother and us 7 sons of him never got a payment. I then decided to study law and I am now doing my LLM majoring in labour law. My research will be on social security.
Mashabela has the best Radio Podcast crossover simply because he understands that at the end of the day the audience is looking for meaningful content....
I blew it has already told us a part of the story which has been mentioned by the CEO. A lot of them have gone back to being dependent on the state. I think the monthly payout will have clauses. If you are unable to do mental tasks then you won't qualify for nsfas. I also think the monthly payout will not affect those in the informal market because they cannot be detected by Sars
Apartheid never left,it just transformed. We now have black people being the gate keepers of apartheid.Good to see that there are still men of integrity.Thank you Collins and David
This is one of the most educative interviews. I am not a South African , neither am i living in South Africa but this interview reflects on how our African government loot our taxes. Thanks David and Letsaolo for this articulated conversation
You don't know what you're talking about, do you? This money does not come from the state. RAF doesn't cost the state any cent. The money comes from fuel levies.
Mr Letsoalo is definately an Activists. Good luck in yo journey to transform RAF. How I wish this information could reach the vulnerable or marginalized!
What Mr. Letsoalo needs is support from us as South Africans and those that have been wronged by the lawyers and all the wrong doers involved. Its a pity that he's already judged harshly by those that used to benefit from robbing the RAF and their friends. He definitely has my support.
Thank you Mashabela for helping to open South Africa' eyes to reality. Please have more of such interviews of South Africans that are trying to fix South Africa, for us to hear their side of the story against the bully mainstream media that is watering down their efforts.
to think that my uncle died after being hit by a car and some people with suits came and told us about his death and gave my grandfather R1500(somewhere in 2011).. I refuse to let go of this and I'll watch this episode and collect as much info as I can, I'm grown now.
@@kennethnkosi430 I don't know where the offices are here in Free State but I'll search the info and be on it(possibilities might be in Gauteng and I'll get there should I know where they are). Thank you for the heads up 🙏🏾
These are some of the laws that the ANC should have amended or Repealed. No wonder the yts are still comfortable as ever as they were in Apartheid years. All the Laws that they put into place are still comfortably serving them 😰😭😭😭
If only the RAF could actually do their job effectively, there would be no need for attorneys. Some people fail to realise that professionals don't become professionals overnight. They study and do training which takes years and costs money. It's because of the years of hard work that they have invested they are then able to complete a task effectively. Attorneys secure higher claims for injured claimants, and they accordingly need to be remunerated. The attorney practically works for free for many years and has to invest their own money to see the claim through to finalisation. The RAF employees earn well and are financially secure for the duration that the claim drags. Hence, they have no interest in speeding up the matters.
Agents of RAF are not in the wrong here; attorneys are in every respect. To be fair, issues of such nature, attended to by whomever (be it an attorney or any competent person) should be done so on a pro-rata basis, given the sensitivity of the issue. Attorneys in South Africa have made it a custom to enrich themselves, by taking advantage of the administrative process of RAF; whilst the taking of such advantage is not wrong in itself, It becomes unjustifiable if it happens at the expense of the claimant. NB: Let all professionals benefit as they ought to benefit, but when the benefit starts to argue injustice, it is the benefit that has to be sacrificed at all cost.
@@Gaofenngwe_Diremy assessment is the person above is a lawyer.😅the fair thing is let the people who need the money get more ...these systems hv always been rigged...poverty is big money...being poor makes it easy for others to enrich themselves..i understand what Jesus said" there will always be the poor among you"..yah neh
From the outside it looks like practicing law IS about exploiting loopholes for your own or your client’s benefit . They want you to believe it is about the so called “justice”but I am not buying it.
It's limited to the lesser of 25% or actual legal fees incurred whichever is lower. Sometimes we complicate the explanations that is how lawyers operate or how the law was setup. If processes are explained in all local languages and everywhere, i.e. social media and preferably local radio stations. This will reduce the cost tremendously
This practice of settling at the doors of the courtroom not only sounds like a waste of court time but also exacerbates the delays already prevalent in our legal systems, necessitating the implementation of recourse measures to hold attorneys accountable for such tactics
I always wanted to follow up on this issue, thank you Mashabela for bringing this gentleman, kindly interview Ntate Mitchell "Monk" Nkomo, former editor of Sowetan in 80s. He has a lot to say about families who their loved ones were tortured.
Damn I saw this on TikTok then i came straight to king David podcast but unfortunately is not premier at this moment but I did put notification to notify me.. I want to miss this.
I respect this gentleman. I also feel that he must be protected he is a great leader. I disagree with him when he says everyone knows that there is RAF. I grew up in a rural area in Mpumalanga, called Diepdale I know a few guys who were seriously injured and fatally injured in car accidents some and their families never claimed because they didn't know that there is a thing called RAF.
Mr Letsaolo is one of the few public servants that still cares about the public. The rest of this country is filth of corrupt law, politics, medicine, big business, and so on.
It was that calculation that said by virtue of my parents not having matric therefore I would claim less. And there I was at Wits and listening to a lecture saying complete opposite....
Personal Capacity as the CEO? This guy needs to go back to school. The legal field is bit complex, but sounds easy to the audience. He is attacking the judges, his time is up.
Perhaps David, you should also invite a lawyer assisting with RAF to hear their perspective if there is any. Can't wait to see part 2 of these. Very enlightening.
But do u really believe thy will admit to certain things...lol they'll never even agree to come..thy say only the good part of themselves like thy always do whn thy convince u to let thm help u with ur claim
The passenger liability I once claimed for someone who died in a car accident involving my taxi. They told me they only pay the money if RAF does not pay. So they passenger liability was never paid.
here comes a politician lapdog who was fired from prasa for giving himself a bonus more like Hlaudi, now comes to raf and turn raf to a litigant instead of settling claims. you can fool them all but we know you. you have used about 100M on litigating useless things than payng beneficiaries
I bet ur an attorney....u want to milk claimants their money telling them it's not yet paid whereas it was paid 4 or 5 yrs back ur enjoying the interests of it...
Thanks Monareng for simplifying this matter. I hope and pray for your safety, as yours is for a service of the nation. E sware bjalo Phutiane ya boya bonhla magola ka go ikilela
Mr Letsoalo must also be recommended for Department of Labour ( UIF to be specific). The Labour department is become useless for South African Workforce and this economy. He must start at UIF, transforming it because the fund has become irelavant for people it must benefit. Then must move and shakeup the CCMA including all bargaining councils.
This conversation is one sided. Unless legal professionals are accessible to all litigants in rsa this wont work. Somewhat like how the NHI is. RAF needs to be accountable. Attorneys hold RAF accountable. If his ideology is considered then it would spread like a disease were ultimately nobody will respect the law and our judicial system. Litigants will slowly disrespect the law and the rule of law. There will be no need for legal professionals. Rather stem out the corruption in the RAF.
This Constitutional delinquent is being disingenuous abt most things he says on this platform. #Instead of fixing the RAF administrative issues, he attacks Lawyers who don't work for the RAF.. A whole CEO doesnt know that Lawyers didn't make the Road Accident Fund Act.. Its Parliament that makes Laws..
As a lawyer myself, looking at the comments, it’s scary how he’s managed to change the narrative. Only we’d know that this guy is talking out of his backside.
@CalvinPietersenBaase-hp5te yes it makes sense for SABC to be free cause we pay such taxes, even the content will be world class the way the state tax us as amongs the highiest taxed payers globally,if corruption is stoped this can be a reality
Mr. Letsoalo has been on this battle for years, ( a natural activist - the one who clears the path) the noise gets up a bit then mute, before you know it we are discussing corporate governance. This is the reason that we need to relook some of the laws. Mr. Letsoalo does not have letsoalo and has character.
The state attorney system is definitely the way to go and will lower costs! Also changing the payments from lumpsums to annuities is actually a smart idea but there may be a need to pay some lumpsum to cover the initial costs e.g. a person who can't walk no more now needs a wheelchair friendly home. This will also create more business for financial advisors and insurers. Great opportunity for gov to create more black insurance companies and hopefully reduce unemployment.
A very insightful interview about the nitty gritties of the RAF. I'm in awe of how complex it is.. put in layman's terms 👌🏽 Mr Letsaolo is an eloquent communicator
In a country like South Africa where there's total disregard for the rule of law all the way from the president, judges, lawyers, doctors, police etc it's a miracle the country hasn't collapsed yet but we are soon heading there.
May collin Letsoalo succeed in fighting the system that steal from people, no matter the number and power of his opponents may they scatter in many directions and fall on their own sword.. in the name of highest being that seat above all systems.
Why don't we have more of such South africans in leadership positions who have quard to confront wrong doings instead most of leaders are scared to confront the system
