We all know the cop will smell the strong odor alcohol until the breathalyzer indicates 0.00% then he will claim it's other controlled substances.

This department "doesn't trust" the (state-funded) breathalyzer. They don't think they're inaccurate; they don't trust them to give the desired result.

Hate to assume things these days, but the answers the police chief gave felt like "seems like it" to me. Wasn't the worst interview I've seen. There was a news report a few years back for the Phoenix, AZ PD chief having to defend his "two top DUI officers with specialty training" because a local news station found most of their arrests were being tossed. He literally called them his two top officers for DUI and specifically pointed out how they had higher levels and more advanced training than the rest of the force. And things haven't improved since then. A few months back, Phoenix PD was back in the news where the FBI wrote a very scathing report on them at the same time a local news station found hundreds to thousands of officers on the force with Brady level violations that were not on the Brady list. These are my LOCAL cops. At least I have the protection of not "driving while black and/or Hispanic" (The subject of the FBI investigation), but my neighbors aren't that lucky. All of us in Phoenix deserve better.

Absolutely.... he's sorry they got caught....not that his policies rewarding his "dogs" with treats for making DUI arrests....could possibly CAUSE his guys to unlawfully arrest people for DUI....to "UP" their numbers to get more "treats".

What's more aggravating than a bad cop writing bogus DUIs? The police chief PRETENDING he's outraged about it....this police chief more than likely incentivizes and rewards his guys for the number of DUI arrests they get....incentivizing arrests only LEADS to arrests...whether they're warranted or not.

If the Supreme Court would end qualified immunity you would see a lot of false arrest and police brutality end because then they know that they will be sued and it will come out of their pensions and people could take their homes and cars and any monetary payments would come from the police officer themselves and not the citizens of the city! Where is Citizens need to find a way to take it to our congressman or something to where they take it to the Supreme Court to get rid of qualified immunity! Perhaps we need to start creating petitions and getting signatures!

Also, remove the incentives for DUI arrest. Apparently, officers gain money, and departments gain more grant funding depending on DUI arrest.

Breathalyzers are great for proving you aren't drunk when they are calibrated and maintained correctly. The issue after is, the officer will see you blew 00 and then change it to a drug dui, there is no winning with cops. Just refuse fields, they will never help you, if you've been pulled over, the officer has already decided you're guilty

Good video but does not emphasize strongly enough that drivers should ALWAYS refuse the Field Sobriety Tests. They are garbage and the results are whatever the officer says it is. I don't know of any "Implied Consent" law that requires you to submit to the "dance on the side of the road with a 4000 lumen light shining in your eyes". Implied Consent is for breath tests and blood tests, NOT the Field Sobriety Tests.

Doing blood test casts a wider net. But in Tennessee the long wait times means the arrested pay the same penalty and pays the same fees as guilty. They don't refund those fees. Some departments will not even bother to tell you that you passed. Let's you show up to multiple court dates before they finally tell you. No apologize

I think the officers are not giving breathalyzers because they know the blood tests are backed up 4-8 months. The cops think this increases the possibility that the victim may do some kind of plea deal.

Seen this a lot, the get federal funding based on DUI arrests. Its rewarded in the station for it. The rates they pull people over for DUI and release so they can fish again is astronomical

All government employees eat from the same altar that you and I are sacrificed upon. Don't believe me? Just go to any random General Sessions Court cattle-call and see how many folks enter into voluntary plea deals and pay court costs rather than fight the charges against them. The courts have become a revenue-generating enterprise which local governments increasingly rely upon for in order to balance their budgets.

Its because Departments and Officers get awarded for "DUI-arrests" , not for "good arrests" or "convictions" . Its a numbers game, get as many people as possible and pump up those numbers 🤷🏻‍♀️

Because the incentives (as they are) increase arrests and inconvenience to the innocent and the guilty alike. Since going to court and mounting a defense in extremely costly and inconvenient, "defendants" are all too likely to enter into some type of negotiated plea agreement just to regain the liberty and escape the hassle of going to court. The system counts on this and profits from the practice handsomely. Its all a horse and pony show, but it is a facade for graft and corruption.

QUESTION FOR DDT: Is it better to ask the officers to swing by a local hospital to have them do a blood draw and tox screen instead of going to the processing facility? Hospitals have to do those tests quickly, since they're an essential diagnostic tool, especially for the ED. Or is it better to wait till the processing facility and let them do the blood draw for the state labs to process it?

Hi , in the U.K they have a roadside drug test for coke and mj which takes about 8 minutes to get a result.

It probably wouldn't shock me of how many false DUI arrests their are. I know that even though I never drink when I am away from home, I would fail those field sobriety tests. Getting falsly arrested for DUI would be tragic for me. I am a truck driver and would not be able to drive trucks until my record is clear. 8 months without my normal income. Wow! That is something that I feel police departments don't think about. A mistake like this can destroy a person.

He’s sorry? A false DUI can literally ruin someone’s life. I know someone that lost a full ride scholarship over a false arrest. You should never ever take a FST test. Take a breathalyzer or hold out for a blood test.

I know why we are seeing this and it’s because the federal government is giving bonuses for meeting dui or dwi arrest not tickets, detainments, or convictions which is most concerning IMO

There are very easy ways to stop this 1) STOP M.A.D.D. from giving awards for the most DUI. 2) STOP giving officers bonuses for the most tickets and DUI. This one will stop all bad tickets and arrest extremely quickly. 3) Make officers 100% responsible for all their victims cost. This includes making the officer a) Pay the fine for any bad tickets. b) MUST pay for fighting the bad ticket and/or arrest, includes all attorneys fees, court cost, time off from work and time wasted for fight the bad arrest or tickets. (A person is arrested and in jail for 12 hours. The officer must pay that person what at least twice what they normally get paid for working. If not working, paid at least twice minimum wage for stealing that person's time). This does not stop lawsuits. Just once it hits the officer's pocket, they will not just think twice, but maybe three or four time about what they are doing, Will the arrest or ticket(s) stand up in court. So many officers write fraudulent tickets to punish people, or just get their ticket count up. The officer knows it is going to cost the person, no matter what (fighting the ticket or just paying it). The officer on the other hand is getting paid no matter what.

Simple solution, change the goal line from arresting, to successfully prosecution for the shinny award. Also, add automatic internal audits require mandatory retraining when a certain number DUI arrests results shoe the person was sober.

Never submit to field sobriety test. Its completely up to the officers discretion and hes allowed to lie and probably gets bonuses for the number of arrests he makes.Request a breathalyser or a blood test. He is probably a lieutenant by now

As a defense attorney. Show the videos in open court. You humiliate the prosecuting attorney, the arresting officer, chief of police or the sheriff or state post commander and the judge. After everyone has been humiliated, then the arresting officer gets fired.

To answer two of the questions the police chief "didn't have answers to": 1. What to do about this officer? The question is, "Is this the only issue the officer has, and is the officer worth saving?" 1.a. If the officer is an otherwise good officer, take that officer out of duty rotation, sit them down, explain the situation, and give them the training they obviously lack. 1.b. If the officer is not worth saving, then shitcan them out of the force with a black mark on their service record so big, even the smallest small town police forces myopic HR department can see from a mile away. Let them do something other than police work, like being a night guard at the local Walmart. 2. What to do to make sure this isn't happening with the rest of the department: 2.a. Sit everyone down and REMIND THEM what the expectations are. 2.b. Review the training and see where training and/or procedures can be improved. 2.c. Put controls in place to review and catch these false positive arrests. 2.d. Look at other ways to determine drug levels. Like, I don't know, driving to the local hospital and having them run a tox screen on blood work? You know, where it only takes an hour or two to get results back (because it's needed as a diagnostic tool for patient care) over the MONTHS TO A YEAR the state lab is requiring.

I object to the term "officer" as it's been applied to municipal street cops. The term should refer to career military leaders that have often graduated from elite academies like West Point or AFA with 4-year degrees, often also with graduate or professional degrees. Municipal street cops with tatts and a HS diploma or a GED, should simply be called "cops".

Question… If cops have to take a course in DUI to be able to perform testing and making determinations for alcohol. Shouldn’t they have to be trained in drug recognition to deprive someone of their rights (unless it’s obvious)? Everyone knows these tests aren’t that easy for older people, especially with injuries/disabilities.

The laws in the US seem so odd to me around this. Here in the UK, a roadside breath test (or drug test), will be requested. If you blow over, it isn't used for evidence, you're arrested and taken to a nearby station to produce an evidential sample on a collaborated machine. No field tests, just facts. If you refuse the roadside test you'll be arrested and probably have bloods taken, but that depends on a lot

These test are great for someone who's fit but for if you're elderly or have medical impairment you'll never pass.

One problem I see with your logic, the teacher/Uber driver said he didn't drink (sounded like ever), so the officer wouldn't smell alcohol and then probably say it must be drugs. So aren't we still at the blood draw and all the crazy lab time, just like before? Now we don't know about the other two people, but for the officer to narrow it down to alcohol vs "something else" might help some, but doubt the guy featured. My nickel's worth (ya know, inflation).

Tennesse does have a few VERY good officers, but the overwhelming majority are mere order-takers who either don't think deeply enough or are they think everybody is a criminal that hasn't been caught yet. Not many in the middle.

Thats the problem though, these cops are just flying thru these "tests" and if someone loses there balance then they automatically say they are "impaired" and arrest. I have an issue with my left leg and hip and it hurts to walk, no way can I stand on my left leg without flailing around. I would fail all these "tests" that have to do with balance and walking. And I dont drink or do any drugs.

It is disheartening that the chief just doesn't know what to do and that he "really feels" for the drivers' lives his agency has potentially ruined. I have some suggestions. The first is research and disclosure. Does the department incentivize DUI arrests (or number of traffic citations in general) through salary increases or bonuses - review each officer's annual performance report. Has the department received additional funding (either local, state, or federal) for its DUI arrests? 100% stop on incentives. Annual review of DUI citations/arrests vs DUI convictions. The second is to stop any awards - such as those from MADD. We have reached out to MADD for the past three years asking them to stop giving awards law enforcement use to request additional funding. MADD bases these awards on number of DUI arrests, not DUI convictions. They refuse to respond to all inquiries. Besides, there is nothing courageous or "above and beyond" about writing a citation or making a traffic arrest it is simply doing your freaking job. As someone who visits the grave each month of a friend I had since kindergarten in the 1950s who we lost to a drunk driver three years ago, his wife, children, grandchildren and friends know that pain all too well. But we have motorists who continue to be collateral damage to law enforcement ignorance, lawlessness, and ego and this needs to stop.

Forgot to add, thank you for your commentary well presented for the lay person. Maybe it's time to enhance DUI to DUIA (A-alcohol), DUID (D-drugs), DWME (W-while, M-medical, E-emergency). DWI, driving while intoxicated, became the generic DUI so there is precedent. One last thing about training. I just pulled up a RU-vid from a few years ago (after doing some Google searches) where a middle-aged man suffered a heart attack while stopped at an intersection. When the police showed up their BWC record them saying "he's drunk and passed out" they ended up tasing the man because he was not compliant to their directions to exit the vehicle. The level of aggressive stupidity by their recorded conversation was both disturbing and astounding.

Four States Legislators have wised up and reversed Qualified Immunity for Career Criminal Police Officers, Colorado, Nevada, New Mexico, and Montana. Smart decisions because they are tired of the Taxpayers paying for LEO's cowardice ways. Qualified Immunity needs to be reversed in all states. Cops have gone rouge, they don't care if you sue because the taxpayers pay for the suit, you and I. Not only do they not deserve Qualified Immunity but they should be required by law to submit to at least two psych evaluations a year paid from their own pockets to keep their job, done by Qualified Professionals not affiliated with any police association or union. This will weed out the bad cops. A northern California sheriff’s department stripped 47 deputies, 10% of the force, of their guns and arrest powers because they failed psychological exams, it was reported on September of 2022. They have become nothing but Career Criminals with badges! In John 10:10 we're told that Satan has come to steal and to kill and to destroy. I think he has recruited most of the LEO's, Judges and Prosecuting Attorney's in this Country! In some states an officer is only required to take 600 hours of training but to become a barber it take 4000 hours, 6.6 times longer. How right is that? The only sane conclusion you can come up with is that LEO's are stupid, corrupt and evil! Colorado has also made it mandatory for officers to report bad cops and not be involved in their cover ups but that still doesn't work. Police investigating police, how well has that worked? It hasn't and that's why Legislators need to reverse Qualified Immunity.

Don’t you like how when they catch a cop driving drunk, they try like hell to sweep it under the rug and try to tell the cop (off duty or on) to just go home. They area joke. No one likes cops, except other cops
