I’m a former traffic unit police officer and a NHTSA certified SFST/A-Ride Virginia DRE……this case shows why it is so hard and Derek does a great job of explaining why it is so hard in these cases… Folks cannot stomach taking the arrest and remaining silent ….essentially losing the battle to WIN the war.

What's frustrating is how bad these cops were. I know you gotta do it, but if you ask me a question twice...are you mentally OK is all I can think. Over 10 times they "asked" him to get out, made threats. But never TOLD him or more importantly, "ordered". This is just insanity. Stop with the "I'm asking" and get to making actual legal demands. It's just so frustrating to see just bad communication and use of english from these officers. We have words for a purpose. use the right ones and say them clearly.

14:32 to be fair at this point she expressly said she was asking if he was willing to get out the car and not ordering it. ( I know later he does definitely get ordered and then refuses but that distinction I think is important)

I'm always surprised to hear Derek acknowledging the most absurd comments and trying to pro-actively refute them. If people are commenting that you're a bootlicker for recommending that people comply with lawful orders then you can just ignore those commenters because you aren't going to reason an unreasonable person out of their position.

I can see the argument that the swerving was due to him eating a taco and not him being drunk. That said, and I say this knowing full well that I do this, you shouldn't be eating while driving. If you are going to do it, use finger foods that don't require you to bend your head around, like French fries and chicken nuggets.

A lurking variable might be impairment due to high blood sugar. High blood sugar causes the body release ketones which smells like, guess what? Alcohol.

@@droiduseruserdroid1731 Eh, there are genetic conditions that can cause the body to either smell like the person's been on a 9-week bender or causes fermentation within the body to literally put the person on a 9-week bender. The problem is those conditions are extremely rare. Granted, they can be tested for and most with a simple genetic screen. But if I were the defense lawyer, I would only look at that if their friends and family stated he never drinks. It's much easier to argue that him trying to eat a taco while driving is what caused him to swerve, and then use that to try and kill the probable cause on the DUI. Of course, the prosecution is going to argue that one sign of being drunk is not being able to control his impulse to eat a food he needs to turn his head for.

What I would like is a lawyer’s view video of a conversation a sober driver could engage in to establish a winnable civil lawsuit. “I hope your dashcam has recorded my driving.” Is your bodycam is activated & when.” “Do you smell alcohol on my breath?” If so, “Let’s get a breathalyzer going.” “Are you going to tell me to stop resisting while handcuffing me.” “I’d like a supervisor.” I understand dialogue aimed towards putting a cop on the defensive may also produce a retributive response, it seems there should be a way to make the cop understand you will be proactively defending your actions. Personal dashcams and phone recordings should help as well. Why can’t police use breathalyzers along with preliminary urine testing(same as a roadside PBT) to determine if further investigation is warranted?

In addition to the accent being something that works against people who are from places outside the US, their culture might also work against them. Police around the world are known for being crooked, and there are places traffic cops will pull you over for a shakedown. On top of that, there are quite a few cultures that do not respect women, and being pulled over by a female officer can also play into things. Not saying either of these things came into play with this stop, but they can.

Doesn't Pennsylvania v Mimms only allow them to order you out ONLY if they have reasonable suspicion that your armed and dangerous?

Read the actual opinion. It’s not that simple. I’m not being a know it all dick to you. I think it’s good practice to read the actual judges rulings in these cases. Mimms didn’t present that type of reasonable danger either. He had expired license plate. The cop ordered him out of the car and notice a bulge in mimms pants. The cop then patted mimms down and found an illegal gun. The reasonable danger was only assessed after mimms excited the car. They have the right to order you out to dispel any suspicion of you being armed and dangerous. It might be wise to ask before you exit if being ordered if the officer suspects you of being armed and dangerous, they’re probably say no. Then you might have a case but probably not. In the case you are suspected of being intoxicated they can’t let you drive away. So what then. It’s just not as clear as you’d think. That’s all.

The little snippet on the screen mentions neither "armed" nor "dangerous", and I can't remember if the full opinion mentioned any specific requirements. Still, the fact that it's so widely abused that the officer openly said it was "just to have a conversation" and "if you say no to a search" is telling. These officers will have a hard time arguing safety concerns

@@DaveBigDawg I agree but they’ll say in the report or when questioned that they believed someone to be dangerous so they ordered them out of the car is all I’m saying. I find the whole Supreme Court ruling a violation of our 4th amendment. As I said before it would be a good idea to ask the cop if they suspected you to be armed and dangerous before exiting. They might say no.

I saw a video awhile ago where the lady said she wasn't answering any questions. She was very polite, gave all docs, exited the car, refused tests & breathalyzer. The cops badgered her to answer. I'm usually pro cop but that bothered me.

I feel like the problem is that because officers can lie it’s impossible to know when they request something if it’s lawful or not unless you watch shows like this. If they weren’t allowed to lie then people would feel more comfortable following instructions.

If you do comply and get arrested. It goes to court and you win the DUI. Will all costs be reimbursed? The towing of the car. The lawyer fees. Taking time off work to turn up to a court. Isn't it still gonna end up with you losing out on alot of money? Money that some people just don't have to give out? Isn't this the reason why people try and battle with police officers and stay out of custody?

No they will not reimburse you. But if a cop orders you out of a car because of a suspected DUI, then you're going to jail with or without your compliance and with or without taking the field sobriety tests. Might as well be polite and not give them a reason to further suspect you - so that you have a better chance of getting the charges dropped. It's not fair, but that's the reality of the situation.

Considering what he's eating, he might be suffering from delirium due to high blood sugar levels, which would appear like he was drunk and impair his driving. Additionally, that causes the body to release ketones which would smell like alcohol to the officer.

You glossed over the purported "safety" element in Mimms. She's fishing for clues and coincidentally extracts the driver for safety without any independent indication of danger. That's a convenient elephant in the room jurors can comprehend. The officer hadn’t developed PC, so she escalated in furtherance of that aim, not to mitigate any danger. In any case, if I'm stopped, I'm gonna do what I'm ordered to do, lawful or otherwise. A civil cause of action doesn't require my refusal and my cooperation shows good faith in a criminal prosecution.

4:01 To me it sounds like he’s mumbling to himself saying “I wasn’t all over the road.” I wouldn’t say it’s clear that he is slurring. He says it all 3 times (third being loud enough for her to hear) in the same exact cadence. When she returns to the drivers side, you can hear that she has trouble understanding him due to his accent but not due to *slurring.* it’s also clear whomever wrote the captions can’t understand him either because he says “I just drive [broken English for drove] here and I stopped to see my friend and Crystal Lake” and they’re staying “I just drank beer…”

Derek, after reading some comments, I would like some clarification about the Mimms business. Do the cops really need to feel in actual danger for them to ask people out of their cars? That seems an unreasonable criterion to apply. In addition, sooo many people will tell the cops "I know my rights!" What is the most common misconception about people's rights?

If a person did as you suggest, get out of the car and keep their mouth shut, and is then arrested without significant evidence of DUI - and after the arrest the police search their vehicle and find open containers, does the fact that they didn't have sufficient grounds for the arrest, which allowed them to search the car, supersede the discovery of evidence of a further charge? I guess I'm imagining you go to a friends, have one or two drinks over a couple hours, bring your open bottle of liquor home - maybe its in a backpack in the passenger foot area. You get pulled over for texting or something and the cops escalate to a DUI investigation. Are you basically just boned even if you're completely sober?

I agree with your view of complying even if we disagree with what the police do. I disagree with a lot of laws and the power police have, but fighting with the police on the side of the is not a winnable thing to do. I am glad that give us the criminal side so that we know how to act around police without getting into more trouble.

This guy did not look drunk,, but he did not help himself any by both pissing them off and handing over evidence by talking too much and refusing to exit. He hurt his DUI case and quite probably earned he resisting charge, adding credibility to the DUI case against him. He has either watched too many or too few RU-vid videos.

So throughout the video, the cops keep telling him to step out to have a conversation. At one point the driver says that he doesn't want to talk, he just wants his ticket and to go. Could that be used as his defense in court, that they were unnecessarily prolonging it to force a consensual encounter instead of giving him his ticket? I guess try to argue that step out to have a conversation wouldn't be a lawful order because police can't force a conversation?

You say “winning the DUI”. What you mean “beating the DUI” because winning in court is at the cost of how many thousands, how much money in possible lost wages/earnings, the psychological/emotional cost, as well as damage to reputation. I guess “winning” is all how you view the situation.

Policing for revenue. The decision to arrest was made before the stop. Bolstering their arrest record to get that cop of the month award , the next raise and promotion. Abolish qualified immunity.

That's not what the law states, the law states officers can control the scene including removing drivers and passengers from the car. Those are lawful orders as long as you are legally detained.

@@antoinewood2478 Reasonable control, not absolute control. The guy is not running into traffic or acting crazy so YES Mims is the controlling doctrine and Mims has limits. Specifically a citizen needs to be considered "armed and dangerous" and the officer is removing him from the vehicle for a "Terry Frisk".

If the cops are in fear of their safety can order you out. To perform a sobriety test is not a reason to order out.

I despise the "I smell alcohol" excuse that cops use. Unfortunately, I just don't trust or belive cops anymore. My child like innocent trust in the police ended with the advent of RU-vid videos.

Women should NOT be police officers unless they can pass the EXACT same mental and physical training that the men go through. Why? To help save each other's life someday. Derek, remember the courts have now said a person must affirmatively invoke the 5th amendment by saying, "Based on the 5th amendment, I invoking my right to remain silent." It's no longer good enough just to state you are not answering questions.

Do you have to cooperate with their investigation? Just because you don't want to have a conversation with them?... Is eating now a crime when your pulled over?.. I hate her tone of voice... She's reaching for sure... The DUI laws have been abused... MADD is responsible for alot of this...

If he proves he wasn’t drunk Olin court then all the other charges should be dismissed .. but that’s not the way it goes. When the falsely accuse you and you resist arrest knowing you are not committing a crime no charges after the fact should stick..

This should be a good test case regarding the 5th amendment as well as the 4th amendment. Although he clearly didn't invoke his 5th amendment right, he clearly stated that he was not going to talk to them or answering anymore questions. Additionally, he said his lawyer was on his way. By asking him to get out of the car to continue the conversation would violate his 4th and 5th amendment rights because he clearly said he didn't want to talk without his lawyer and the reasoning for getting out was not due to officer safety. If a lawyer argues this well, and a judge accepts that, all charges--except for the DUI charge, should be dropped as fruit of the poisonous tree.

If you don't do your job, you get fired. If you violate tenant rules, you get evicted. If you break the law, you get punished. There are limits to all of these, which we get to enjoy for the low low price of reasonable limits on us. TL;DR: Yes, we follow orders. Endlessly hitting beehives begets endlessly getting stung, whereas working with the bees yields honey

A lawyer saying no big deal got getting arrested. Easy for you say say dude. You make 6 figures and rely on these ppl for customers. Meanwhile they have to pay a lot of money out of pocket to cover their ass. What’s your answer to that? No big deal right? Everyone’s got 10k for lawyer and court fees. NOT Average American doesn’t even have 1k for emergencies in the bank.

My understanding; if they ask you to do something, and they can ask you to do anything, then, you ask them if they are asking you or giving you a lawful order, if it is indeed a lawful order then they can site or arrest you. If you think that it's not a lawful order, on the side of the road is not the place to contest that, I would comply and let them prove that it was a lawful order in court. They have a lot of latitude to order you out of a vehicle for officer safety.

@@SpaceFrawg Unfortunately, several women have been raped by police officers with the "lawful order" statement. managing in court later didn't prevent their assault. But you are correct.

@@SpaceFrawg when does a man have the authority to order another man to do anything ? Are we not free men ? The answer to that question is never ! We are not free Men.. We re bound by laws imposed upon us by another. Freedom in the United States is a sham. It doesn’t exist as long as anyone can ORDER you to do something against your will, when you are not part of that service.. I know, laws and they are ment to protect citizens.. Not to enslave them and generate revenue. There lies the problem in our policing and judicial system.. So here is the question, is it better to be a slave and follow orders just or unjust and be some what safe ? Or is it better to be free and protect yourself and family and live your lives without the imposition of the will of another upon you ? Wether it be walking on the road side taking pictures without being molested by authority .. where is the freedom. ? Where is the accountability, where is the justice ? It has been shackled by fear and malice by men who strive to take from you what you own wether it be your property, your livelihood, your family, your wealth or even your life.
