Ive seen people pass the field tests, then only to have the cop say " well you must be under the influence of drugs then" so agreeing to any field test is USELESS>

@@Shadowmantspassed FST’s AND breathalyzer. Or the guy who passed 6 breathalyzers and STILL arrested for DUI. That one the cop was finally investigated and fired. Possibly charged.

Never agree to these field sobriety test, if you're not drunk it 8s mandatory to provide a breath test otherwise you can lose your DL and still if your drunk flat put refuse to everything. You will lose your DL but then you might get it back in court since you never provided any evidence to the officers.

I think this one of the best takes you guys have had. Honestly the defendant's anger at the lying cop is why we shouldn't accept as a society to allow cops to lie, it literally is the definition of "one bad apple ruins the bunch", we allow them to lie, so we know all of them are liars.

People always get that axiom wrong, too. It's not meant to exonerate the so-called "good apples," it's to remind us that the potential is there for all of them to be corrupt, even through inaction.

Sure, she "accidentally" opened a closed container of alcohol, emptied it, and placed in in the car and claimed he had an open container. Accidents happen. Just like a cop might accidentally go in the back of his cruiser, accidentally pick up a baggie of drugs, accidentally shove it in the suspect's pocket, and accidentally arrest him for possession.

Something I've seen in other videos that I didn't see here was when she threw the empty bottle back on the passenger seat then told her Sargent that she found the open bottle within reach of the driver. The Judge ruled in pretrial that the empty bottle can be admitted into evidence and let the jury decide if its relevant. During deposition the defense lawyer made the point that there is NO regulation about impounding liquids.

She lied to her superior about the bottle, so EVERYTHING she claimed about his stop is highly suspect. There's no proof he was speeding or that his headlights were not on. She's a corrupt cop and the police force should be working to get rid of her and to improve their police force instead of blindly supporting a dirty cop that would manufacture evidence.

i can't count how many times i've driven a car accidently without lights on because the streetlights were so bright that it was like driving in daylight.

I got pulled over for it once - my car had automatic lights so I wasn’t really paying attention to them, but I had taken it into the shop a day earlier and they turned them off. Now I always check. But the cop said that drunk people drive without their lights on and let me go after not smelling any alcohol.

I've done that several times. However one time I got pulled over for driving with my bright lights on. When I drive home at night, I needed the bright lights to navigate the dark roads to my home. I did not need my headlights to drive to work in the morning. When I left the next evening, I I just pulled out of the driveway where I worked and onto the street and immediately noticed that my brights were still on, so I turned them off. I was on the street for less than 2 seconds at this point. A police officer saw me turn off my bright lights, and then turned around and pulled into the gas station that I had pulled into to get gas, initiating a traffic stop . I asked what was going on, and he told me that he was pulling me over for driving with my brights on. I explained what I was doing, and he said it's still against the law and got all of my information ran my license and everything and spent about 20 minutes trying to determine if I was legal to be driving. I stayed completely respectful, while he was an absolute jerk to me. It was hard not to get snarky back. Fortunately, I was able to go on my way without a ticket.

Here in the UK we don't have sobrioty tests, the police ask you to take a roadside breath test, if you fail that test you are taken to a police station and placed on a calibrated test. If you refuse the breath test at the roadside you are arrested for failing to produce a breat test, at the police station you can choose from breath test, blood test or urine test. If you refuse any of the tests at the pollice station you are charged with failing to provide a breath test. At court you will 99% of the time be found guilty, plus the fines etc are stricter than the initial drunk driving offense so it's fruitless to refuse the roadside breath test.

How do we know the lights weren't a lie?? Unless it's on tape. She has no credibility!! He also had a right to be angry. The only thing that's real evidence that I saw is him admitting that he was drinking a couple of drinks.

There is only one thing you should say to an officer when they ask you questions, and its "I'm invoking my 5th amendment right to remain silent, and i want my attorney before any questioning." Anything other than that is too unclear for police

@TheRusschannel you are just wrong, or you would've given an example. When cops, judges, and attorneys all say verbalizing your right to remain silent, then remaining silent is the best option. I'll take literally all of american jurisprudence over your word

Every time he says, “You stopped me for…” and the officer says, “I’m not the one who stopped you.” It’s like she’s twisting his words in the moment to make it seem like he’s confused and he can’t tell people apart. Which he’s clearly just using “you” as a general pronoun. Another good reason to not talk

My newest car is a 2011 Mazda CX-7 and the dash lights are on all the time. I've caught myself a couple of times driving at night without headlights on. Most streets where I live are well lit.

I still think he was convicted of yelling at two young, innocent, blond white girls. One of the officers testified in a frilly pink sweater rather than her uniform.

When ever I ever see someone who is pulled over and suspect of dwi and alcohol is in the car, the container is usually sitting on top of the car. Not dumped out or sitting back on the seat of the car

On the discussion as the weather the officer deliberately lied about the liquid and supposedly pouring it out because they couldn't impound liquids. There was also a drinking cup / bottle there with liquids in it, which they didn't test, and they did not pour out. If they're saying they had to pour out the liquids then they would have had to pour out that drink container, but they didn't, so it's a blatant lie. If I were the chief over this officer, she would have been terminated.

This outcome shocked me since the cop made up evidence by employing the bottle and placing it back in car. She lied to other cops and her supervisor and put it on the arrest warrant. The think blue line say at trial the bottle was not used in the prosecution. But allowing the man to be convicted doesn't sit well with most people. I kind of understand some of the other evidence but I probably would have caused a mistrial

I think the mood swing thing is racially coded. The problem with the alcohol being opened and the officer's testimony on it, is that at best it was inconsistent, at worst she lied. If she lied it throws all of her statements into question. The state has the burden but somehow we let them make whatever kind of mistakes but the accused better be perfect. I get it. He could've done himself some favors by not answering any questions. Name, rank and serial number so to speak. I just don't like it. Also I don't like that once he said he wasn't speaking without a lawyer, they continued to ask him questions and even had the new cop come in to ask more questions. Why did they need to transfer him from one car to another? What is going on? I didn't like that we are convicting people of anything without any physical evidence. But I digress.

Once arrested, how many questions can be asked before Miranda is read? When is it considered a formal interrogation? (Obviously questions like "do you have anything in your pockets that will poke me are a bit different than "did you smoke weed today? Did you shoplift that Gatorade from Walmart?"

He should not have been prosecuted at all. No matter how small the evidence tampering, in any crime, the state's burden of integrity of evidence should not be lessened. Lying and creating evidence on a sliding scale? Are you for real?

Is there a policing technique of accusing someone of something else, not suspected, to trigger the detainee to talk and admit what the police really suspect him of? A questioning trick to prod the person to confess?

Headlights isn’t good enough for me. Newer cars have the daytime running lights that are very close to the brightness level of the headlights. However to everyone else passing you, you clearly have no headlights on or taillights

My cop buddy says DON'T get all your stuff out and ready. They get nervous if people are fumbling around in the car. He says put on the dome light, crack the window, hands at 10 and 2, wait patiently.

I know I saw a video recently where they covered the part where the cop opened the unopened bottle. And they showed the testimony that you guys did, only it was longer. I can't remember exactly, but it seems like she got some sort of reprimand for doing that (she didn't get fired, but she should've been fired for lying about the bottle being previously opened.)

1st thing when being pulled over, tell them you're invoking your 5th amendment Rights, but be nice in the interaction. 2nd this cop knew what she was doing and did this to help her case against this man. Additionally, she knew she was about to get a check from MADD for another DWI/DUI arrest and it doesn't matter if he was sober or not. It SUCKS that he was found guilty in court. If I was on the jury, he would have been let go as she had been proven to lie within her arrest report so I wouldn't be able to trust ANYTHING else she says or 'claims' she saw! Law Enforcement is NOT your friend!

Unfortunately, that's the case. He had PD's, and they were woefully unprepared. You stand very little chance of winning anything with a PD as your council, they cut deals with the prosecutors, that's how they move things along. They do not have the time for due-diligence in most cases, this was no exception.

Don't answer the question is the best alternative, they may not think it's respectful but you don't have to answer any questions other than your name if it's a lawful stop

I think she was locked in on the dui and assumed the bottle was opened. Then she didn’t catch that she opened it herself. Just railroad thinking. I can believe she is not too bright and could easily fall into that mental trap.

This is a long video, so hopefully I don’t have a lot to say, but at 1:15 you made the comment, “Pro Tip, have that stuff ready.” And I’ve always wondered about this. Because it would be nice to have it ready so they can’t claim you were shaking or doing anything weird while searching. But at the same time, I don’t want them using a “furtive movement” as an excuse to search my car if I move around gathering my things before they show up. So what are the pros and cons to each of those situations and what would be the best way to avoid that?

Best way is to make certain for one your vehicle.is fairly clean of excess trash and unnecessary garbage. Second, is to have your documents fixed in a place for when asked for them, you can quickly and easily access them with no trouble. Which ks how I always travel. Regardless of the outcome of the case, shouldn't any Officer who fabricates evidence and then lies about it both to other officers and on her official report be on a Brady List and out of flipping burgers for a living? Is there any reason every defense attorney who ever has this Police Officer/Sheriff(POS) on the stand shouldn't bring this up and ask her why she lied on her official report about this?

1:15 Pro tip: DONT HAVE IT READY, as in grabbing before they come to your window, Know where its at beforehand, but some police will take those movements as furitive. Leading to an excuse to search the car or eliciting an armed response by the police.

Driving without lights on is one of the 24 clues to impaired driving, speeding isn't but a rookie going to get excited about busting a dui, plus it's taking a bit of time to get the paperwork together.

I would ask the cop what the policy is for liquid drugs (Tincture, LSD, etc) if they keep those or are those dumped out/destroyed on site. What about for testing purposes if the liquid is unknown or suspected of being something other than what it is labeled.

PRO TIP: (As a "black" man)... When you get that stuff ready as you're pulled over you get guns drawn for furtive movements, that creates suspicion in their minds & you'll be lucky to not get shot.

I watched another video where an officer shot a guy when he leaned over to pull stuff out of his glovebox for the stop before the office told him too. The officer said that he was making furtive movements as he approached the car.

The problem Calvin has is that even without the marijuana and the alcohol, he's still driving on a suspended license. That alone gives them all the excuse they need to F with you.

He damned if he do, and damned if he don't, and the jury found him guilty even after hearing what the Cops did? The Judge knew he was railroaded, and that's why he gave him only 10 days in jail, just for sh*ts and giggles. I've never been in trouble with the law, but after watching several of these videos, I've learned to just stay calm, remain silent and let my lawyer handle it.

The video here doesn't show it very well, but she had clearly lied in her desk position about the alleged opened a bottle of alcohol. It was clearly done as planted evidence to indicate he had been drinking. They tried to cover by using the BS about impounding liquids, but then they also tried to indicate that the drink bottle in the console was a mixed drink, but they hadn't tested it, and oh by the way they didn't dump it out either. So some liquids they need to dump out, and some liquids they don't. Apparently it's only sealed containers that are perfectly legal that they need to dump out to try to pretend that they're illegal. The clear thing is she had lied in her deposition and she had planted evidence, and based on that how can you believe that this was a valid traffic stop, when only the word of a proven liar says that the lights were off or that he was speeding. Yes, I think the guy was clearly drunk, but it was still a bogus traffic stop as soon as she started lying.

I wish I would have thought my DY case. I was due to catered. I was completely innocent and that was before body cameras and I was tricked into pulling. No contest. The public pretender worked out a deal with the district attorney

What should a non-drinker/non-drug user do if questioned about drinking/drugs if questioned by police? Should I refuse the acrobatics test but consent to the portable breathalizer? Ask for blood/urine draw if arrested?

You refuse any field sobriety tests, do not submit to any portable breath test. You are likely required by state law to submit to the breath test back at the station, if you refuse it you get an automatic license suspension. If you've been drinking, refuse, and take the suspension. It'll be a lot cheaper than a DUI. If you haven't had anything to drink, go ahead and blow.

Got asked if I drink or do drugs once. Cop said he smelled it. I told him he had better have a body camera with a scratch and sniff app on it then because after my blood test he was going to regret those questions. I was let go.

You say pro tip have that stuff ready but we have seen many examples of police officers being terrified by absolutely nothing I don’t want to rummage around my car at all before an officer gets to my window they will use every excuse they can get to search your vehicle.

Listening to these guys explain the law is like listening to a DnD player explain to the other players the rules of the game, even though everyone at the table knows the DM ignores all the rules and does what he whatever he wants to do with the game. Pro tip have your documents accessible without having to reach into the glove box. They will call it "furtive movements" and pull you out and search the car.

Under rated comment!!! I keep all of documents in the sunglass holder on the interior roof of my.car, and always drive with my wallet on the shelf in front of my.screen in my car. Being able to quickly produce all legally required documentation while driving will always bear in favor of the driver. Regardless of the circumstances, in most situations. I commonly travel thru a very low population dense area of rhode island, and any time been stopped for ridiculous reasons, having the pertinent documents, and proper knowledge, had kept me.from.multiple citations and or tickets. Heed this great advice.citizens of the great USA.

When the 2nd officer shows up, the officer Oliver tells her I can't really smell anything right now but minutes later she smells marijuana which has a very distinct and noticeable smell okay, whatever officer Oliver....I believe you are a liar

I used to watch you guys a lot but really don't much cuz it seems your takes give the cops a lot more benefit of the doubt than I think is often due. But I was interested to see this video cuz I've seen it covered on 2 other civil rights channels. Again, you kinda skated over the cops obvious misconduct, deception and falsification of evidence, painting it as a "mistake". After opening the bottle she clearly started to the other officer "Yes. It was open." As a paralegal for criminal defense attorneys, I've never seen one of my lawyers give that much credit to the opposition. I'd love to see your videos a bit less bias towards the cops n hear more how you would defend the case cuz mostly, you sound like you work for the prosecution... but maybe that's the niche you're trying to present. Idk... just my thoughts n why I stopped watching.

I appreciate your comment. I enjoy spotting the major issues I see in the videos. I like talking about the issues. If I were arguing this in court, of course I’d argue it’s misconduct, it’s planted and I’d be banging my fists on the table demanding a Not Guilty verdict. But I have no desire to do that on the internet - I get to do it in real court everyday. So while I get your point, showing you how I’d defend the case is not really the point of the video. Maybe I’ll try to better explain my purpose/approach in future videos.

In Florida, 3 major violations in five years triggers HTO, habitual traffic offender, probably 2 dwlsr and now dui, so he's looking at 5 years revoked and everytime he drives it's a felony, so the state can take his wheels for forfeiture every time.

Dude pulled over in the MIDDLE OF A TURN LANE...with headlights off...slurs his words...fumbles about...gives them some BS letter...admits to drinking...admits to leaving a bar...other officer independently said he reeked of alcohol...swerving...enough to convict. His record was NOT good, btw. Apparently, there is some sort of policy re: when to dispose of alcohol, and it was to be disposed of if it's open (if I recall correctly). ALL of that was presented at trial, including mistakes by officer(s). The defense attorney sucked during the trial, but her close was a little better. The prosecutor was much better at raising objections, rebutting objections, etc., but had a lukewarm closing. And remember, you're watching Law and Cuck, and they're always "less-than-honest" with their reporting.

There is no policy to open bottles of alcoholic drinks, pour out the contents then lie to another officer that you found an open container in the car. The 2nd officer then proceeds to lie under oath during the trial and claim that she wasn't told that by the first officer on the scene although it's clear from footage that she was. Minus the chemical test you have to trust the testimony of the arresting officers and I wouldn't trust a word out of either of their mouths at this point. Had the defendant at any time shut up and acted sober throughout this encounter he might have stood a chance in court. I believe he convicted himself by his own actions that night in spite of the atrocious policing by TPD.

Getting someone in cuffs "is a tactic" cops use became they know it causes stress. I've seen cops get arrested drunk that flip out once the cuffs go on. In this case, it was an unavoidable situation, but any questions they start with, at the car even, you announce "Im exercising my 5th amendment right to remain silent" and do exactly that. Cuffs or not. Police are sworn professional witnesses of the state, noting they see, do, or say can help you in court. They are not even obligated to protect you by law. They're not even expected to know the law. Most are people that have a relatively clean record, have a ged or high-school diploma, and spent a few weeks in the police academy. Barbers and hair dressers at least have to complete 2 years of schooling before becoming one. Cops are given a gun and a badge, put in a car, and everyone expects ethical, moral, and honesty out of them. Be smart about your rights, everything they do is a way to effect an arrest. To subvert your rights. Sorry this was long but it needs to be explained properly.
