It is! But first they've gotta be declared crazy. The form you fill out ask that question and the background check looks for it. The problem is that if no doctor or judge ever declared the person mentally ill, the person isn't legally mentally ill. Apparently, no one ever did that. That's where the failure was. The problem wasn't the background check or the gun laws. It was all the people who let her off easy and never declared her mentally ill or never convicted her of a felony because they sympathized with her.
All red flag laws are unconstitutional. You don’t fix a society by restricting the rights of others and ignoring the problem. You fix a society by educating the people, feeding the poor, and helping the elderly. Good values and love are what leads to good outcomes. Not pointing fingers and trying to blame others. The prison system now houses a lot of mental health people. That is due to the asylums being closed. It is time to reestablish them IMO! With better safeguards in place. Nothing is perfect but we can do better

Glad they finally released details that give useful and accurate background info to who the shooter was. Lots of red flags there. So many opportunities to deal with this behavior ahead of time. Sadly, her actions are her own and the consequences fall on her... and unfortunately the child too. God help those injured in this situation.

I understand that there was a divorce but when was it granted? Before or after she started displaying psychotic behaviors. If before why was she granted custody with a history of violent behavior towards the father of her child as well as towards him. The criminal adjudications should have been entered into NCIC and would have prevented her purchase on the background check. Looks like what ever agency and court was involved in the prior domestic violence situations did not report as required. As usual in something like this a chain of mistakes or lack of follow through ended up allowing her to get the weapons legally.

I believe the backgrnd check was supposed to find the mntl diagnosis, so....she should not have been able to purchase the item by our current law. No new law needed, they are always trying to add new laws when they are already in existence so they can add other hidden caveats.
A criminal background check will not pull mental health records. Those are protected by HIPAA unless previously reported in some sort of criminal proceedings with the court.

There's video I saw on X where she's was wearing a burka (not over her face) and says, "My name is Jeffery..." She wasn't transitioning but was identifying as a male.

And this is why she was able to get the gun. It's not the gun laws. If someone never gets convicted of a felony or is never declared mentally ill, because the judges and the doctors sympathize with them, the background checks won't stop them. It was passed and became law in the 1980s after a mentally ill man bought a gun and shot President Reagan. If you buy a gun anywhere in the US, it applies to you and you have to undergo the background check. I know, because I've done it numerous times. The problem is as I said. The law can only work if a person has been legally declared "mentally ill". When sympathy or political correctness causes Doctors, lawyers, judges, etc., to NOT follow through and declare a person "mentally ill", there's no way the system can work. It's not a failure of the system, nor the law. It's a failure of those people to do their due diligence! The problem is no one with the authority to do so, would stand up and say "this person is mentally ill". And that's why this happened.

It is a law that "individuals with diagnosed and documented mental illness" are not allowed to buy guns. It's called the "Brady Bill'. It was passed after President Reagan was shot by a mentally ill individual who bought a gun. That was many years ago. The problem is the person has to be, as you said, "diagnosed and documented". If not, the mandatory background check will find nothing. The problem here wasn't the law. It was that all the people who dealt with her in the past, doctors, lawyers, judges, etc, apparently never "diagnosed and documented" her as having a mental illness. Was that because of political correctness? was it just because they felt sympathy for her? I don't know! But that's where the system failed. None of those people were willing to say "this person is mentally ill". And that's how she was able to pass the background check and buy the gun. The system didn't fail. The people involved did.

The father had reported to the court that he was scared for his son’s safety because she was violent….she also was schizophrenic….but obviously the court still allowed her to be with the child.
There could also an issue here because she's an immigrant. If you're "undocumented" how do we know your mental history? Do some of these countries these people come from even keep records and if they do what's their mental health system like and how effective is it at tracking and identifying people with serious issues? When you just let undocumented people come into your country unchecked, how are you gonna know which one's are kosher and which aren't? Really, there's no way!

No matter whis bullet hit little Samuel, it is because the actions of his mother out him in this position to be fighting for his life today. Ill be praying for little Samuel. My twin sons are 7yrs old, the same age as him, & i could never imagine putting them in any danger let alone being the reason they get hurt..i feel so sad for this baby.
