You have to pay the higher amount and submit the order of higher amount in court from where lower amount order is passed.

Agar husband 1 yr tak maintiance na de aur aur wife v application 1 yr ke baad lgaye (exp:- jan20 se jan21) tak ka maintiance pending ho aur wife feb21 ko application lgaye to kya vo jan20 se jan21 ka maintiance le sakti hai ja nahi. Kyki after one yr wo last year ka nahi current ka le sakti hai aur last yr ka claim nai kr skti it’s right.

Hello! Sir. I've a serious question. Please help me with the perfect reply. I'm a commission base LIC Agent. So my monthly income isn't fixed. I've not other source of income. Now, I want to know what amount I've to pay to my wife as a maintenance in case of 489A IPC or 125 CRPC ?

Amount of maintenance is decided by wisdom of judge and as per facts presented before the court. One can not predict the amount. It is totally depend on judge as no formula is decided in law. Maintenace has to be paid in CRPC 125 and not in IPC 498a.

Wrong information.Limiftation is there. Execution has to be filed within one year after the amount of maintenance becomes due. Suppose if wife file execution after 10 years iof the maintenance was allowed to her. What will happen in that case.

Sir mera husband month me 400000 lack kamat hai to mujhe court ne 40k manjur kiye hai kya ye sahi amount hai. Aur ye amount kam hai to kya maine hight court me apply kar sakti hu kya jada amount keliye. Mujhe koi child nahi hai.

I think that amount is ok.If you are not satisfied you can go to highcourt but maintenance kam bhi ho sakta hai wahan....if you have strong evidence about his income and your case is genuine,you can challenge the order in highcourt.

Most of the cases filed on the basis of falsehood.Use CRPC 340 to punish them u/s IPC 191,193,195 etc. for giving false evidence.
