Unbelievably, the National Federation of Republican Assemblies (NFRA) put out a statement asserting that Kamala Harris (as well as Vivek Ramaswamy and Nikki Haley) are ineligible to hold the office of the Presidency. Largely, they cite an old idea that your parents have to be citizens at the time of your birth, but more importantly they cited Dred Scott vs. Sandford which states that no Black people can BE citizens of the United States! Which is insane! Join us as we break down this lunacy and try to laugh so we don't cry.

Imho, your Scottishness doesn’t tie you to Trump any more than my Russian ancestry associates me with Putin. Which is to say, not at all. I’m part Scottish, part German, part Lithuanian, etc. Half my great grandparents (two sets) were first-generation Americans. One great granddad was a Hungarian-speaking farmer who (according to my dad) had an accent like Bela Lugosi. Another fought Bolsheviks in the czar’s army. We’re all made of many small pieces that form into the unique shape of “you”.

SCOTUS at that time ruled Dred Scott had no rights as a person,he was property,could be return back to his master.The Argument was once Dred Scott passed into a free state he was considered a free man

The enslaved weren't considered people under the law, they were classified as livestock. Livestock that runs away doesn't get to choose to not be returned to it owner. That's the "logic" they were using.

They knew what they were doing. They knew their hypocrisy. But, this benefitted them, so they didn't care. They said what they had to say to justify it.

My understanding of this (not a lawyer) is that Dred Scott was overturned by the 14th amendment and that Kamala Harris has already been legally deemed eligible to become President under the 12th amendment when she ran for and was elected Vice President four years ago. So they're a little late to the party here.

It was. But the 15th Amendment gave black men and eventually black women after the 19th Amendment the right to vote, and you see how well that turned out for us, don't you! White constitutionalists didn't realize how egregious Dred Scott was until the CRM. Let that sink in!

Though they are also working to bring in an end to divorce as well. She may call herself that though as she *was* born in the US, which is fine and a pretty good descriptor. She is mixed race and a person of color. I'm sure she has had *plenty* of people dis her. If I get treated like shit because I'm a mostly white queer atheist and AFAB, I'm sure she has been treated way worse than me in a lot of ways, but she's Cis/Het and a christian so she's got that going for her.

You didn't mention my favorite part! Before Dobbs, anti-choicers would constantly compare roe v wade to dredd Scott as a means of showing just how wrong the supreme court can be. Conservatives being hypocrites isn't exactly a ground breaking observation, but it's worth noting in times like this.

If German kids can learn from age 10 (and sometimes younger) what happened there 100 years ago, American TEENAGERS can and fucking SHOULD learn in detail what happened here. Maybe then people would be more committed to making the world a better place. What my grandparents generation did doesn’t define me, any more than it does them, it just compels me to do better.

VP Harris’s mother was Indian (from Madras), her father is Afro-Caribbean, specifically Jamaican. And yes, the US has birthright citizenship. 14th amendment. I’m pretty sure there are plenty of “originalists” who don’t want to get rid of all constitutional amendments, since that would also mean the 2nd amendment goes bye-bye.

Maybe some do… the 2nd amendment covers the right to carry firearms. Many of these folks are attached to their munitions. I’m not against self-defense... just saying the “well-armed militia” crowd might wanna think twice before looking to gut constitutional amendments.

If both parents have to be citizens at the time a person is born AND they have to be born on US soil, then John McCain would not have been eligible, because he was born in Panama and didn't get citizenship until he was 11 months old. Ted Cruz was born in Calgary and his father was not a US citizen at the time, so he's doubly disqualified. Obama's father was never a citizen, so Obama was never qualified either.

Referring to migrants as "undocumented immigrants" instead of "illegal aliens" is also relevant because the Republican immigration policies have been about curtailing LEGAL immigration. The "Remain in Mexico" policy, opposition to DACA, opposing pathways to citizenship, banning Muslims, lowering caps on refugees are all policies to make LEGAL forms of immigration ILLEGAL. There was a controversy in El Paso where a church was being targeted for operating a shelter for migrants who crossed the border. While the church wasn't requiring proof that they were here legally, they were located near El Paso's official port of entry and provided a place for people seeking asylum to stay while the process goes on. Referring to people as "illegals" is also dehumanizing and should be a very clear sign to someone that they're the bad guys. But it's also less accurate in the contexts it is being used. Both political parties want to end "illegal" immigration and both political parties want to put additional restrictions on legal forms of immigration. But only one party hate-mongers off of this position.

Dredd Scott v Sanford was completely repudiated and corrected in the 14th amendment. Within the first few sentences of Section 1. AMENDMENT XIV Section 1. All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.

When they clam that they are quoting the U.S Constitution word per word they are lying because the part in which they say that "shall be eligible" is in Article II, Section I, Clause VI in the manner that they clam is not right whatsoever. Instead it is written as: "No person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President." Notice how the part "shall be eligible" is nowhere except at the end of the sentence and not at the beginning after "No person except a natural born Citizen" like they clam.

Whoever writes a legal opinion that cites, as its foundational case law, _Dred Scott v Sanford,_ sould be referred to the answer given in _Arkell v Pressdram_ and laughed out of the court. Not necessarily in this order.

Pretty much their Argument is Article II under the interpretation as laid out in a 1857 Supreme Court decision and thinking that is "originalist interpretation"... the problem of course is that the 14th Amendment altered Section II's Citizenship clauses, and thus negated the 1857 interpretation, as the "original intent" of Section II was modifed in effect by the language of the 14th Amendment.

Birthers and such will say any nonsense. That being said, I think that natural-born citizenship is a daft criteria for being president. Every country produces diamonds and sewage as far as people go. Something else needs to replace it, preferably pertaining to formal or informal educational and psychological requirements, and also about not having a criminal record with felonies. Trump got in and that proves why it needs to change.

Just wanted to say I was a child slave from 6 - 13 in "domestic abuse" and it didn't feel like I was a person then and I still have a hard time coming to terms with that now. Every time you say "enslaved people" instead of just 'slave', it feels both wrong and really nice. I don't know why it feels wrong. I don't know if this is an issue with me because my shackles were society, psychological torture, and the threat, and carrying out of, physical abuse in response to my trying to run, my cage was the basement, closets, sheds, and . . . one time even buried alive head first for a few hours. I know that's not a cage but . . . I still feel like I'm in that hole so often. Wasn't actually "buried" but I couldn't breathe, I was deep enough, so deep only the person who put me there would ever find me . . . it was behind the retaining wall . . . I could have just . . . sorry. Went from . . . sorry for trauma dumping a little bit. It felt and still feels like the worst cage even though I was locked in the basement and closets FAAAAAAAAAAAR longer. Those just blend together. I've spent so much time locked up. But I don't feel like I have a right to call myself a . . . enslaved person. Or freed person. Or anything. I've been told I was a victim of slavery but it just . . . I know we aren't supposed to compare, but it feels like because I got out, because I didn't have physical shackles or metal bars keeping me held, I don't have that right. I know. I would never suggest that of anyone who had been in the same situation but only for a year, a month, even just a single day. I would never say they hadn't experienced slavery, a thing no person should. Because they had and it's so wrong and horrifying that it happens and can happen to anyone. Sorry. Just thank you. And seriously, it can, does, and IS happening. I'm sure that most people, if not all, know someone who is currently, or was, in that situation. And it can be so difficult to tell. And while it's no ones job to be on the lookout for any sort of abuse, except for those who's job it IS, it is so important to be willing to help if you DO spot it, are told about it, or anything. The amount of times I had people just look away when inhuman acts were being committed in public . . . far worse happened behind closed doors. Please don't look away. I know it can be difficult because so many are scared to say . . . He beat me, ripped my skin into shreds with a broken piece of tire he found on the highway in Wyoming going back to Kansas. So many cars were going by. I just remember wishing I could struggle out of his grasp and run into the traffic. I still think it would have been best. He's abused so many more children. ALWAYS little girls . . . not that many knew I fit that back then. I'm guessing he was one of the ones who could tell. I was bad at hiding it. But if that had happened while he was beating me for hundreds of people to see, he would have been in prison and wouldn't have been able to hurt anyone else. I turned my own eyes and let him keep doing it to others. I'm weak. I don't deserve to be called a survivor or an freed enslaved person, or anything else. I was just weak and let it happen to others. I guess I know what I'm talking about with my therapist next week :\ Just got off the call with them about half an hour ago . . . But yeah please anyone reading this please do not turn away when you see anyone being attacked. Be it by a parent, a stranger, police, it doesn't matter, it takes from you every time. And at best you stepping in against a bad person. At worst, you stepped in and saved someone from years of horrific abuse.

Umm, why are you framing it based on being black? It is a wild mischaracterization of a ridiculous natalist argument. Their argument is that because her Indian mother wasn't a citizen when she was born she isn't a "natural born" US citizen. It has nothing at all to do with her black half.

Do you know anything about the Dred Scott decision? Because that's one of the ones they cited, and it explicitly says that no Black person can BE a citizen of the United States. And also, this is the same thing they did to Barack Obama, because he is Black. Like let's not pretend that isn't their core complaint here, they are deeply racist against Black folks

@@LuxanderReal yes, I know about the Dred Scott decision, but they didn't cite it for its stance on black people being citizens but for its stance on what constitutes a "natural born" US citizen - someone who has two parents born in the US. They cited others as well which don't involve black people. Their argument is not that she is not a natural born US citizen because she is black, but rather that she is not a natural born citizen because her mother was here on a student visa when she was born. It is still an idiotic argument based on a form of bigotry, natalism or xenophobia, and it involves ignoring many sources of law prominent both before and after these decisions. However, you are attacking a strawman - an argument they didn't make - despite their actual argument being so laughable. They may have chosen to make that argument because Kamala is black - but that doesn't mean their argument involves her blackness. What is the effect of the strawman argument you're making? Fascists point to it, show that it is a scarecrow argument, then convince their audience that nonfascists are liars. It is especially effective because they also claim other white, Republican presidential candidates are also ineligible for the office. Don't help the fascists with such invalid arguments. Don't further cement people into their disinformation bubble by spreading your own disinformation.

They didn't say she wasn't "natural born" because her mother wasn't born in the US; but rather because she was not a citizen when Kamala was born. Maybe pay attention closer next time. It's very important to focus on the actual argument being made rather than one you can defeat.
