"Some prominent conservative lawmakers and commentators are advocating for ending no-fault divorce, laws that exist in all 50 US states and allow a person to end a marriage without having to prove a spouse did something wrong, like commit adultery or domestic violence.
The socially conservative, and often religious, rightwing opponents of such divorce laws are arguing that the practice deprives people - mostly men - of due process and hurt families, and by extension, society. Republican lawmakers in Louisiana, Oklahoma, Nebraska and Texas have discussed eliminating or increasing restrictions on no-fault marriage laws."*

Way to miss the point. Restricting nfd doesn't aim to make divorce harder. It aims to remove the incentive to cheat or casually leave. Someone who breaks the contract shouldn't be able to benefit from it, hence the "fault" bit.

Ok, keep no fault divorce. Eliminate alimony, child support, and both parents get 50/50 custody off the bat. Those who want the divorce will move out. Women need to stop being rewarded for choosing to be POS'. I've seen plenty of good men get completely destroyed because she got bored and wanted the bad boy.

What about the women of got married at 19 never worked have no skills spent 20 years raising kids and now at 48 husband divorces her to get a young hotter wife? How does she suddenly go from trad wife /homemaker to supporting herself? She needs support this is what alimony is for. The reason they get half the assets is because essentially when married his assets are her assets and her assets are his. With a joint bank account both parties can make a withdrawal legally without permission of the other. So if she contributes 20k he contributes 80k the household balance is 100k when divorced that 100k is split between both parties so she is entitled to 50k (+30k) and he gets 50k (-30k).

my parents argued every day for sometimes hours they should have gotten a divorce when I was a kid but they stayed together "for me" but even my child self voted for divorce and eventually my dad became distant and didn't want to be home and my mom turned her unhappiness on me and I became the target for several years I didn't want to be home and if I was I never wanted to leave my room I couldn't even get a drink from the fridge without her starting on me.

Changing no fault divorce would not have affected this. They both could’ve came amicably to the agreement to get a divorce and that would’ve been that the Republicans wouldn’t change that.

As a child custody consultant I can say beyond a shadow of a doubt that a majority of couples want their pound of flesh. It’s their lawyers that caution them about being vengeful, and judges look on it disdainfully, otherwise courtrooms would look like the Jerry Springer show.

@@budbas I got into with a bunch of friends of mine when the civil conflict comes up, these men they reject for being to short, poor or whatever, there is an entire voting block there that know these liberal ree ree’s will vote for war sending them to die and face no repercussions, have no respect for them when they get home, banging their friends while deployed and taking their kids and money because “you are never home” they give them no sex and no children, no loyalty if they do get together. what reason would any of them have to defend any woman when the barbarians breach the gate? @@Kil23Joy I have a few Soldiers that have custody after a divorce. When we “go somewhere” we have to have someone assume custody until we get back. They like no fault because it’s 50/50 and they don’t lose everything.

I happen to agree that if you leave the marriage without a fault, you should get nothing from the other person. If you cheat on them, you get nothing. If you’ve proven beyond a reasonable doubt to be physically abusing your spouse, you get nothing. You shouldn’t be able to cheat and still get alimony.

There is a reason no fault divorce was set into law years ago. Most of the following arguments seem to showcase men losing assets, salary and having to pay child support. Statistically divorced women have a lower standard of living afterwards, whereas men benefit in the long run. Women generally are employed at lower compensation. Not all divorces benefit women. Many professional women end up losing assets, wealth, retirement if they marry men who are not of the same economic status. So now add the possibility that if they are in a situation where the husband cheats, is abusive then the legal hurdles are now more costly and time consuming.

Remove the potential for cash prizes where women are incentivized to divorce, then see what happens. Men would care less if money wasn't an issue. Divorce all you want. But as it stands, men are the primary victims of family courts in a divorce.

If you want to be able to leave your relationship for no reason, just keep dating. Don't enter into a lifelong legal and religious contract. It's the easiest thing in the world. You sound like you think the only options are for people to get divorced, or be awful/bitter/hateful/in conflict around their kids, but that isn't true. They could be adults. They could be civil, and work on the issues between them, and not let their children see any of their problems.

Current gynocentric marriage law: Feem ale "isn't haaapy" so she has an affair. Of course, but we should still push to end no fault divorce. It’s saved many men from losing everything. They only lost a small amount in their divorces in fault divorce states. And easily recovered within 2 months.

That's a certainty in life, so why make the life-long commitment if things changing is enough of a reason to get divorced? Don't get married and maintain your own autonomy. Toxicity, personally, is overused at this point. But certainly, if a party within a marriage is subject to physical abuse, substance abuse, or infidelity, for example, divorce should certainly be on the table. So, I support at fault divorce. If your reason for getting divorced is " I don't wanna anymore" then you had no business getting married in the first place.

Divorce might not, but marriage literally adds years to a mans life while taking away years to a womans. There has been so many scientific studies that validate this. The issue was that men for centuries forced women to marry them by designing a society that treated them like property. It's only been in modern years that women could own a bank account, real estate, get a loan, or a credit card. You'd be remissed by not acknowledging that. It doesn't have to be an all or nothing situation. If both parties agree to divorce they should be allowed to do so however they choose. However, if the divorce is contested with one party being able to prove the other party did not act in good faith during the marriage then the person who broke the contract should suffer heavy consequences in the divorce settlement.

As for contracts, those would then be applicable to ANY two (or more???) people willing to enter under such an agreement. Since it would no longer be romance-based, then any willing adults, friends, siblings, business partners, lovers, etc. could all partake and craft the contracts as they see fit and dissolve it as they see fit.

It all comes down to money. Divorce laws rob men of their money plain and simple. I knew a guy who's wife cheated on him and left him. He had to pay her tens of thousands a year in alimony plus continue her health insurance. She cleaned him out so drastically he had to file for bankruptcy. To make matters worse, she would not marry the new guy because she wanted her payments to go on for the rest of her life. When comedian Phil Hartman got divorced, he not only had to pay out the settlement but he also had to pay for his ex wife's attorney fees in addition to his own. Marriage has become one of the biggest financial grifts in America. We have a legal autocracy in this country that is drastically unfair.

Steven Spielberg's ex wife convinced a judge that they had a prenup based on what was written on a napkin. If you have no reason to divorce your husband that makes more money, you aren’t entitled to alimony. However, if you make more money and have no reason to divorce, you should pay your husband money. Same thing would apply to assets. You don’t get to break the contract and then have things go your way concerning finances and assets.

Marriage is not a contract. It's a institution that binds two consenting adults together until death. This is important because for one it creates stable families that in turn produce well adjusted children. But maybe just as importantly it takes men and women out of the market reducing the pressure on especially young men for finding a partner. Without marriage you have older more financially successful men taking all the women while young and less successful men are left alone and frustrated. This increases social instability and social decay in general.

No they are not 1:1 when population declines. Men marry younger women and when the cohort of women is smaller than the cohort of men two years older society tends to become significantly more aggressive. This is not my wacky view of the world this has been extensively researched. Also the behavior of men has been shown to vary in aggressiveness significantly depending on how many women are present. Women have had unfettered access to the labour market for 3 generations now. They even have equality in wealth, at least in some demographics. There should be no alimony, and assets should be diving based on the documented/evident rate of contribution to each asset. I've been married going on 28yrs yhis September 8th. I believe no fault divorce is what has turned our country into a modern day Babylon. For example , I have seen a woman that has cheated on her husband or left him because she had lost the feeling then turn around and literally take everything from that man behind the court system. Nofault divorce disproportionately favors females because of this. Should a women stay with a physically and verbally abusive man? Hell No! But what I am saying is that the courts need to be more fair to men, which they are not, during this process.

The idea of no fault divorce is that people randomly fall out of love and should immediately divorce if they no longer love each other. In most cases it ruins kids lives. Other cases it ruins the life of the party that asked for the divorce. Many other cases it works. Key thing is stage of life and whether the people have responsibilities (non independent kids.) or not. Going back to the scenario of sorts given in your comment if the only issue is your partner becomes a total ass and is actively pushing you down divorce. If it’s you find out your partner liked dark humor and you never fully noticed but the signs were on the wall that’s on you.

My friends mother divorced her husband because she no longer loved him so the courts rewarded her the house, the children and got alimony just because of no fault divorce. Take alimony away just give 50/50 custody will fix all this nonsense.

Don’t need to do that. Just make it so you can’t become rich by divorcing the other person who makes more than you. Separate finances, each keeps their own assets they bought with own money during marriage, etc. if children are involved, then each parent provides a certain percentage of their income in an account for the children to be used for expenses related specifically to the child. Not to buy yourself a new handbag or car, or pay for dates.

Why is it "stealing" half of the husband's money? Marriage is a contract combining finances. The property bought or created during the marriage should be split when the contract breaks. Don't like the current laws for this property splitting? Write your own contract. That is called a pre-nup or a post-nup. Both parties sign it creating the marital contract.
