I live in NZ and can confirm the justice system is a joke. I got hit on my motorcycle by a drunk driver, the other guy was entirely at fault. He was given 60 hours of community service, no reparations, after destroying my motorcycle, breaking my arm, ribs and skull (I was wearing full leather protective gear and a decent full cover helmet) To this day I still suffer from the brain injuries I sustained in that accident and am getting help for ongoing concussion symptoms at my own cost
while i don't think prison would really do anything to help in a situation like this, there absolutely should be some sort of financial compensation, as well as required assessment for alcoholism and permanent revocation of a drivers license. i'm truly sorry you had to experience that though, along with all of the lasting complications♥️
@@warlordofbritanniaif this happened in America the other man would have been sued into oblivion for the medical bills and the guy would have health insurance.
I grew up with a father who road-raged almost every time we drove together. Rarely it would escalate, but he didn't carry weapons on him. He's been stabbed and had guns pulled on him though. He still does it to this day. He's like a mindless barbarian from an RPG.
As a born and breed New Zealander, the sentence sounds absolutely accurate lmao. My older brother got into a barfight with his mate at 18 and nearly killed a man (they were heavily intoxicated) and all they got was a night in the slammer and a warning 💀
the apologies also. That same brother was involved in a burglary and ruined the cashiers life, the court made my brother paint apology letters to the victims family in which he said he found quite stupid as they dont help the situation at all
@@fightinggamerman1 Do y'all have the ability to sue in civil court? In the US, after the criminal case there would probably be a civil lawsuit where the victim would try to recover damages. IMO it should all be handled in a single case but in my limited understanding of the legal system it's often separate.
I feel horrible for the man who was attacked and his son. I can't imagine finding my dad bleeding out somewhere in a ditch randomly, later being told he could have died of blood loss.
@@Max_Ohmif he got 8 months for almost killing(basically killing if not for lucky intervention). You'd be out within a year. But I ain't stopping at the dad. You make that "a family issue"
As someone who lived in NZ for 16 years, this sounds about right. In my experience, New Zealand seems so safe most of the time that when something like this does happen, they justice system doesn't really know what to do unless there are actually fatalities.
I hate to say it, but at least America's justice system would've handled it more appropriately. Also, I'm glad I live in a place where you can open-carry or concealed-carry handguns without permission and have extra stand-your-ground protections. There's a good chance that swinging a sword at a middleclass guy (with a family) here will get you shot.😂
Nz actually has quite a lot a crime it’s just covered up a ton by media not being allowed to report on things as it “isn’t in the good of the public” murder, child abuse, suicides are hardly if ever covered in Nz media
@@Omnip073n77yeah there are very few times I celebrate or compliment the American justice system but this is one of the cases where I’d much rather this asshole have literally been beaten half to death by an angry mob than I would him getting such a sociopathic sentencing for a dangerous, mentally unstable nutjob that’s very likely to repeat offend. I literally got a worse sentence than this for having less than an 8th of weed. No distribution. No bags. Just simple possession. 11-29 for that.
This is the kind of guy that genuinely deserves a life sentence. He is unhinged and has no regard for people's lives, and is an active danger to everyone around him. Whoever suggested this absurdly light sentence should be held accountable.
One thing of malicious note is he had commit to follow through to do that amount of slicing in an arc. His "50% of my power" line was white trash cowpie already, but cannot say you pulled your punch when you clearly did not pull back from a point of contact as instead the tip cleared well past the destination. It's like shooting someone with a harpoon gun and claiming that's kendo. The guy really was trying to do as much damage as he could. Hope his kids sue him.
I live in New Zealand (American originally) and we've had a few cases like that here, where the criminal/s get insanely small punishments for awful crimes. I remember one where a guy was found guilty of raping 5 girls but only got 9 month's home detention. Everybody was super pissed so they tried to change the sentence but the appeal was denied
Then there’s cases that surround money that only inconvenience rich assholes and ooh you harlot! 2 years. People potentially dying? Go home sure. I wonder if the judges being attacked would change their tune.
Did you also hear about the gang member who picked a fight with a rival gang, got beat up, went and got a shotgun came back and shot them? Dude got 4 years. He shot 3 dudes, 2 in the head and the other dude in the leg or something. Somehow no one died but the 2 dudes who got shot in the head were mangled pretty bad. Hot tf do you get 4 years for attempted murder?! Boggles the mind man NZ justice system is a joke.
@@socketyellow3 You know what that sounds like? A whole lot of not her fucking problem. Whether or not the jails are full shouldn't affect her ruling at all. It's not her job to lock people up, it's her job to cast judgement, and other people take over from there. What she did is a bastardization of justice, and the lesson I learned from it is that I can cripple anyone I want, and as long as I say I'm sorry, I will face no consequences. It's a complete joke.
I grew up in New Zealand. One time when I was 16 or so, me and three of my other friends were hit by a car going insane speeds at a turn. The driver drove up the sidewalk and hit 4 children, giving me and one of my other friend significant injuries. Even now, a large portion of his arms is covered in scars and I have a headache that sometimes just pops up out of nowhere. The driver didn’t even get her license suspended, as far as I know she barely got any punishments.
We call it the "injustice system" in NZ because the punishment for crime is far less significant than the impact of the crime to the victims and their families
Not only he ruined victim's and his family's lives, he also ruined his own family's lives. I can't imagine living with a psycho like this, knowing that someday can be you.
@@heartycoffee4754 right?? I was thinking the same thing. His kids better be on their best behavior or samurai Samuel is gonna whip out the katana on them
Earlier this year, a 17 year old was convicted of sexually assaulting 4 girls, one of which was unconscious. They were given 9 months home detention. New Zealand’s court system is fucken ridiculous.
New Zealand's "justice system" is a cruel and pathetic joke. Dude commits attempted murder with a sword in front of his wife and child and gets a 10 month timeout, absolutely shameful
bieng in front of your wife and children shouldnt have anything to do with the charge. Its not attempted murder if it was a sheathed blade. The sheath breaking was an accident though so the fact that the blade actually cut the victim wasnt intentional meaning it wasnt attempted murder.. This was clearly dealt with well by the judge, 10 months and then the pending civil suit where he will have to pay the guy a shit ton of money to live off of for the rest his life. Good job NZ, to bad this 4chan armchair losers who just parrot their fav youtubers opinions cant see it.
@@Benji-jj2bgIdk, you get out of your car to assault someone with a sheathed weapon and it ends up breaking because it's not made for that so you cause way more damage than you intended, is uh still kinda your fault. "I only intended to pour out a little bit of juice, but the whole thing came out" kinda mindset only works for so long, usually until you're 10.
"Didn't know that the scabbard broke" That's like pointing a loaded gun at someone, pulling the trigger, and then saying, "Omg I thought it was unloaded".
If 10 months is all that’s worth then one of the victims family members should just go pull that guy out his house and spill him in the front yard sheesh
I’d be absolutely outraged if I was a New Zealand citizen… hopefully there’s some public outrage over this and hopefully it’s enough that there’s actually some real justice handed out
His poor wife and kid. There's no way a guy like this provides a stable home life and now he's caused them the trauma of watching him massacre someone and having no break from him for the next 10 months.
Sounds like "man's house, man's rules" type of asshat. I don't know what's acceptable over there but hopefully she divorces him and doesn't get shit on for protecting herself and her kid from him.
as a new zealander myself i can almost gurantee you the womans terrified of him and he does all kinds of shit at home, we have a massive domestic violence and alcohol problem especially the males of ethnic descent, very very short fuses
@@StevenKing-c6x "we have a massive domestic violence and alcohol problem especially the males of ethnic descent" - The psycho attacker is the whitest guy in the world named Darryn Clarke. How much of a fanatical bigot do you have to be to try and make this a "ethnic" issue lol
Hey Charles I live in NZ and this pissed me off so much, the media also barely covered it besides I think one outlet. The reason the sentence is so light is partially the apology but it’s also because our current government is on a mission to get prison numbers/population down and they have basically strived to achieve that by not passing justice onto any criminals for over a year. I was jumped a year ago and the lost half a tooth and broken 3 ribs and the cops came after somebody driving past saw what happened but when they got there they put him in the car and told me to find a way home. The cop called me days later and I found out the drove him home while I had to find my own way without a phone or any communication point, then he told me I couldn’t press charges because “nothing was gonna happen” I don’t know why they want prison population down so badly but that’s the main reason
We will keep tying to pretend we are fixing criminals while putting them back into our communities and causing more harm..... Another stabbing from a guy on bail ffs...
I feel like the only crime they've 'cracked down on' was when the gangs were making kids ram raid shops :/ now a kid can actually get tried for it! Lovely. Being completely honest NZ laws are actually dogshit I know so many people who blatantly break the law and almost get rewarded for it makes no goddamn sense.
Regardless... this story has prompted me to cancel an upcoming trip to NZ. I will never go there now because if something happens to me I won't get justice.
While this quote from Dr. Monica Applewhite is for abuse cases i think it can apply here, "Once somebody abuses, once their internal mechanisms of control have allowed them to cross that line once, I don't have confidence in those internal mechanisms of control for the future." this quote shows that once people do the act they are likely to do it again without professional help or severe punishment.
The fact that the judge only sentenced a man who attempted murder to 100 hours of community service and home detention just shows you what our world has become. Edit: Wow 2k likes thanks y'all
Im from NZ and our law system is absolutely borked atm, there's currently a petition getting signed to get this guy more charges, type "darryn clarke petition" and look for "fair deal". Get this scum what he deserves!
What's self defense laws like in New Zealand. Google wasn't very clear, though judging by pepper spray and stun guns being illegal I'm guessing not ideal.
When I heard that the victim of the attack was f/cked up for life I almost cried. It makes me so sad to hear an innocent man being hurt permanently by a foolish psychopath will never be the same again his life ruined his family having to see him like this. it sickens me that the judge knowing of this didn’t even imprison the attacker
When i heard that the dude with his dog is going around banging on the top of peoples cars as they pass by, i'm not surprised someone pulled their car over and attacked him. A sword is fucking nuts, but definitely not surprised he was attacked.
@@Lord_of_the_Pies I didn’t know that what do you mean banging on top of them? Like holding out his fist and pounding on the roof? I really didn’t know he was annoying people I just thought that the guy tried to make sashimi out of him because he came too close to his car or something it doesn’t justify the samurai sword but he was bringing trouble upon himself.
@@dylangaming698I honestly can’t get a good understanding of what happened to cause this. Definitely the dog man was in the middle of what they are calling a “lane” and banged on hood of the Tesla as it went around him. The man then got out and did the sushi cut
I seriously am mind blown at stuff like this. Dude tries to kill someone with a sword and gets to go home yet there’s people that have been in jail for years for petty weed crimes. This actually pisses me off. Hope that guy gets what he deserves.
@@tigresavoladoragiganterealista if the punishment for deadly serious violent crime is such a joke, why would that stop one of the family members/friends of the victim who was attacked from performing some vigilante justice? 10 months sitting at home playing video games sounds like an easy punishment for beating the samurai attacker to within an inch of his life.
Honestly I think any road rage case should be given harsh punishment, I’ve never heard of anyone who isn’t a complete psychopath getting out of their car over nothing and hurting/threatening someone
I love the way the legalese calls the person who got carved up with a samurai sword a "complainant" like he's some Karen writing an email to management
@@adamwest8711 Not when it comes to the most dangerous and harmful crime there is: speech bad actions that almost lead to death -> complainant bad words -> victim
I honestly hope the worst for the judge and especially the perpetrator, these people are a danger to our society yet they roam the world free like nothing has happened.. I hope someone looks into the case, re-opens it and serves justice. Thanks Charlie, for actually putting this to light, big youtubers like you gather needed attention.
honestly this should be seen as attempted murder. this is NOT something to get house arrest for wtf hopefully the wife leaves him. if this is what he does on a whim like that imagine what he would do in a domestic incident. terrifying.
They need to sue and fire that judge or something because that’s unacceptable. That man is disabled for life, cant even work, almost murdered, has PTSD probably.
I'd fully expect this case to be used as an example in future cases of harm. "We wrote a note and said sorry like the sword guy, we should get a lighter sentence too!"
This right here is why I picked up Historical European Saber Fighting and bought a 1796 light cavalry saber. The likelihood of a sword fight is much more likely than people expect and I will NOT be caught lacking.
@kevinc.cucumber3697 Yeah. I did get the saber from a British sword collector. Most sword doctrine is European in general, so that's the best way to learn. I could learn American saber techniques but it's simpler, more brutal and aggressive but can leave you open on the defense.
My grandpa is 60 and also an electrician for all his life when i heard he is 55 and also an electrician my picture in mind just changed into my grandpa and it literally broke me inside and made me feel even more bad for the family i hope they recover from this as much as they can
You know actually now I’m trying to figure out something: why the hell did he even have a sword with him? Who just drives around with a sword in their car? What was he driving to go do, face Jetstream Sam in an honorable duel in the middle of the desert?
Yea he is definitely a weeb because if I ever did have something for protection in my car and it had to be a blade idk why you wouldn't just use a knife
why not have a sword tho? You can't have a gun in NZ so isn't that the best option if you actually want to protect yourself and are actually an upstanding citizen, unlike this guy?
I live here in NZ. Never have i heard of this story but i can tell you there is some serious issues with the levels of punishment dished out to dangerous gang affiliated criminals. We have some pretty bad gang issues here.
The fact he left the scene is all the evidence I need to know that the guy is scum despite the sheath thing. It would be immediately obvious if you wounded someone, let alone sliced them grievously... Leaving the scene after you did something so "unintentional" and bad is ridiculous. That judge is insane.
I am speechless, this dude is just...insane I guess and that punishment, they need to do better because those injuries are horrible, just listening to the severity of injuries, shocked me and shook me to the core. Hopefully he makes a good recovery.
Interesting fact my mom told me, in some places here in the US you can't just have a baseball bat in your car, but if you also keep a baseball in there too then you can claim to an officer that it is 'sports equipment' because for some reason you'd otherwise be in trouble for it. It was the weirdest thing I'd heard considering, you know, a baseball bat isn't a sword or a gun. Of course there can still be terrible injuries from a heavy maple wood bat, just thought that was weird she needs a ball sitting in her backseat to not get in trouble for a baseball bat.
It basically comes down to “intent”. If you don’t have the ball, it could be construed that you intend to hurt someone with it, making it a weapon instead of sporting goods.
I have jewelry made of bullet casings that's fine and legal to wear while driving my car through Massachusetts. If those empty casings were unaltered and in my glovebox, I could go to jail.
And yet when the police display harmful intent and turn off their body cams nothing happens. Innocent civilians are held to a higher standard and are subject to more punishment for existing than 'law enforcement' is for trying to ruin lives
I feel so bad for the victim and his family, imagine, after being seriously injured physically and mentally by his attacker, the judge only gives the perpetrator 10mths house arrest, and community service!!.😠
I mean they are starting to appear, that dude who cut someones finger off when he broke into the house for example as well as a lot of dairy owners. I do expect it to increase unless something changes significantly after the election.
Yeah, I essentially count the judge and the legal system itself as an accomplice to the victim's mangling, as they essentially helped the assailant get off scott free while the victim has to struggle with health problems for the rest of his life due to the road rager's actions. Disgusting. A system that enables violent criminals and leaves their victims to have to suffer far greater consequences for the rest of their lives while their assailants are mildly inconvenienced for under a year.
As a New Zealander, the response to crime is one of the things that freaks me out about my home. I feel that our justice system is a complete failure... which can make me feel pretty uneasy sometimes.
I know people that drive around with hammers and massive sticks and shit like that it's not that rare. Lot of farmers here too outside of places like Wellington and Auckland so very likely got a knife too at the very least. Hell, my cousin had a metal samurai sword that he kept in his car (it broke though) We don't have really have guns and the possibility of getting jumped is always there so
As a kiwi living in nz, it is VERY SUS to me that our news outlets in nz aren’t blasting this on all platforms. VERY FUCKING SUS! So thank you for making this international 😂❤

But I still love how Charlie Covers this up because this was the most Scariest news ever in Zuckland, keep up the awesome work, Charlie!
Man, I could not be the victim's son... After that sentence the judge passed, I wouldn't have any fear of repercussions for my actions so long as I turned myself in. The judge should be ashamed of himself.
I got the same punishment for, as Charles said, getting caught with weed in high school. Hot take here, crimes shouldn't be prosecuted by a legal system, the victim and their family should have free reign to assign whatever justice they seem fit.
Thanks RU-vid for making me spend more time just trying to leave a comment on mobile than there is time on the video. But the fact that he plead guilty is why I think the justice system is shitty, if you don't fight it then you don't get a real punishment.
As a New Zealander, I was totally gob smacked when I heard about this attack. That is, until I heard it took place in Auckland. Honestly, my limit for being surprised by Auckland's bullshit was surpassed a long time ago. Also I don't what kinda weed that judge is smoking, but I want some.
