Community activists are backing a man seen on camera who opened fire at a Tesla driver during an alleged road rage incident. They insist the Tesla driver should be charged too.
Good way to stop your pursuer getting in front of you and cutting you off, though. Deliberately going slow while keeping the other party stuck behind you is a valid self-defence tactic in a road rage situation and with only a few seconds of out-of-context video we can't really judge if it was the right one to use here.
He didn't stop in the passing lane. Watch the video. He tried going right and then exiting, but the tailgater was already trying to pass him. The tesla was trying to get out of the way, but the tailgater thought he was trying to stay in front of him. Hence the idiot followed the tesla onto the exit ramp, got in front of him, and opened fire. The fact that these so-called community leaders think it's acceptable for a man to open fire because of that is apalling. I don't think the tesla driver was even trying to be a nuisance. He just happened to react in the wrong way at the wrong time, and the tailgater took it as malice.

Nobody here is suggesting escalating bullshit or "fucking with" anyone, but at some point during the escalation of a road rage situation like this - and like I said, we DON'T KNOW from this footage whether that point had been passed by the time that contextless 2-second clip happened - you have to stop seeing a road rage incident through that ordinary driving lens, start seeing it through a *combat* lens, and do what's needed to survive and keep other innocents around you alive - traffic laws and norms be damned. And once you're in a combat situation with a criminal, you also need to recognise that compliance does not guarantee safety; submitting to someone making a sport out of attacking you is just choosing to be an accomplice in your own murder.
As a gun owner, you have to be able to show self control and restrain yourself. You only pull the gun if your life or someone's life is in danger. He did not have to stop and get out of his truck, and pull his gun. He's lucky the guy in the Tesla did not run him over.

And with road rage these days, I just motion for tailgaters to pass me. That's casual, direct, and I can get the license plate number to make a report about it if it was super reckless, if there's not a parked patrol car somewhere up ahead. It's sad people have to drive on eggshells around others, but in this case, it almost got someone shot and killed (albeit, he was asking for it). I don't have time to sit in a hospital or die.

The only person charged was the the correct choice. Just because you get brake-checked doesn't mean you get to get out of your vehicle and shoot into another car. The driver of the pickup truck is both the instigator of the road-rage incident and the person who turned the road-rage incident into felony aggravated assault. He's in big trouble. The guy with the gun is pretty lucky. If I came up the ramp and somebody was standing next to their truck, blocking my way to pass, pointing a gun and shooting at me, it might be the last thing he ever did. I would aim right for him and the door of his truck, crouch down and hit the potentiometer. I don't know who started the whole scenario, but the minute you start using your car as a weapon or pull a weapon out, all bets are off. My safety comes first.
You do realize that drive towards what your looking at. So once you crouch down you are most likely missing the guy and disabling your car and getting finished off. The correct thing to do is get out of the kill zone. They taught us this in the military if we were ambushed in a vehicle even though we were armed as well. The 99% of the advantage lies with the people outside the vehicle doing the ambush. Your best bet of survival is getting out of range as fast as possible.
The Tesla's autobraking probably would have prevented that... that's one of the downsides of too much automation! Should always have the ability to mow someone down in self defense.

Please explain this to me people. That Tesla driver could have been gone with no F150 in site. If I was driving the Tesla, the other driver would have never had a chance to stop on an exit ramp in front of me. I am in no way saying the guy with the gun should not be punished for his actions. He definitely should be. I do agree that the other person should be facing some type of charges and shouldn't walk away scott free. Tesla gone, and the situation avoided.

Both drivers should be charged. I never brake check anyone. If someone is behind me and they appear to want to drive faster than me, I simply move to the slower lane. I move back to the fast lane after they have passed me. It's really simple and I get to return home safely to my family. Brake checking and erratic driving can lead to a car accident or worse. Watching the video, it seems that the Chevy driver was rather close and aggressive towards the Tesla which prompted him to brake check. If he kept a safe distance like he is supposed to then the driver wouldn’t have brake checked him.
Having more than 10 brain cells tells me he was trying to get the Tesla to MOVE OUT OF THE FAST LANE; Where, he should have been in the first place...And, save it you smooth brain; It doesn't justify shooting him...But, it definitely goes to motive. I would estimate that %90 of road rage incidents stem from people camping in the left lane...All you gotta do is move over; Not that big of a deal...

Yes because he was probably going slow. Then on top of brake checking the truck, the truck was going to go around and pass on the right but the Tesla purposely cut them off to exit. Should have just let the truck pass on the right.

Also, the shooter was tailgating the guy in the Tesla, which is what started this entire thing. Even after being brake-checked, he just got closer on the Tesla driver's tail rather than backing down. He was the aggressor all the way around.

If the Tesla did not speed up, the driver would likely have been injured or killed. If anyone is driving aggressively, do NOT engage.....DO NOT ENGAGE! That means no horn, flashing lights or anything else! I have learned the hard way to stop all that nonsense when my honking at a car that cut me off had him follow me (which I didn't realize). When I was behind another car at a stop sign, he ran up to my door and opened it to grab me. I reacted quick enough to turn into a parking lot drive way on the right and get away. Had my door been locked and he was trying to get in, I would have been within my rights to pull my gun on him. He should count his blessings that did not happen.
@@droid4d279 It does matter. Tailgating is illegal because it prevents people from being able to see if anyone is behind their car, preventing them from being able to safely move out of your way and also preventing you from having space to stop if they hit the brakes.
Law where I live requires yielding to faster vehicles if you are in left lane. You don't get to set a speed limit for someone else. Tesla driver should have been charged for reckless driving along with charges for the shooter

@@vandarkholme7759 I followed him to his home, found out he has been in trouble with the law for his hot temper in the past, and he has gone to jail for several theft charges, i wanted to file charges on him but I was running late that day. he did the same thing to me on my truck because I was trying to pass him, he pulled in front of me and braked almost to a stop, then he did it two more times and took off, I was able to follow him to his house and found out his name is Christopher Harclerode Reid, I wanted to call the police or confront him but being as I stated I was running late for a business meeting, so I wrote down his information and looked him up later that day. the truck driver on this incident was lucky he didn't end up dead due to this man's actions.
He never should have stopped his truck and had absolutely no right to shoot. That was road rage pure and simple. That said, Had that man in the Tesla not been driving antagonistically that never would have happened. Both are wrong imo.

Mr. Young is extremely lucky the District Attorney didn’t charge him with attempted murder. His actions meet all the requirements. He would have a very difficult time proving he didn’t intend to kill the Tesla driver.
He would 100% walk free if they charged him with attempted murder. What he committed was attempted voluntary manslaughter. Even a bad lawyer would successfully argue that this was committed in the throws of passion and did not have premeditation which murder requires. He would have been lucky if he was charged with murder because he would have been found not guilty and the state is not allowed to charge a person for the same crime twice and so he would be a free man.

In this case, Mr. Young pulled in front of the Tesla, stopped, exited the vehicle and opened fire in a calm deliberate manner. That fits the definition of murder. If, in fact, the Tesla driver had been killed in this incident, Mr. Young would 100% be charged with 3rd degree murder. Also, being brake checked would never meet the standard for a crime committed in a fit of passion. The mens rea element would be laughed out of court.

Voluntary manslaughter and 3rd degree murder are exactly the same thing. 3rd degree murder is a informal laymans term and voluntary manslaughter is the correct legal term. 3rd degree murder is NOT legally recognized as murder but manslaughter. Manslaughter does not require unintentional killing. Voluntary manslaughter is defined as INTENTIONAL killing committed in a “heat of passion”

The only way to put a dent in road rage is to punish everyone who participated in it. I do feel both are responsible...However, not the same charge. The break check guy continued the break check, even after switching lanes. The guy with the gun was wrong as well, so yes, a charge was needed. But the break check guy needs to be given a ticket, if not charge because he's definitely not completely innocent as how he tried to portray it to the news. That break-checking guy didn't know it was a video of him break-checking, smh. Both wrong. One needs a charge. One needs a ticket.

Brake-checking falls under the category of stunt driving, but so does tailgating. Thus, the driver of the pickup truck was both the instigator of the incident and the person who escalated the incident into a felony crime. He's in big trouble to put it mildly. The Tesla driver responded to aggressive driving with aggressive driving, which is not good, but the law is mostly on his side. He'll get a ticket and a few demerit points at most.
