Appeals always go to the next court up. Asking the court for special treatment because you need your politically-motivated trial to happen immediately before an election, contrary to what has hitherto been long-standing DOJ policy, seems a lot more corrupt than simply following the standard procedure for appeals.
It's truly a BAD decision to skip over the lower Courts of Appeal and have SCOTUS decide the APPEAL----and it's very, very RARE. I read the Governments Petition to SCOTUS (approx. 230 pages!), and I understand why Chief Justice Roberts was unhappy with it! It basically said "a former President can be prosecuted because he is being prosecuted by this Court." This really ticked Roberts off because it was extremely "shoddy" for a Judge to write that to the High Court Justices.

I think there is a law which states something to the effect that a judge (for example) cannot be sued for any wrong decision they make on a case. Which is a far cry from total immunity.

A terrorist is in a foreign city, and there are even American citizens in that foreign city, and the US President bombs that city to take out the terrorist, BUT many American citizens and Foreign citizens are no longer with the living. That would be okay? And sure, the foreign nation would most probably want to retaliate. But okay from the US President's perspective? b. Now another hypothetical: A terrorist is in a domestic US city filled with many American citizens, no other foreign citizens are in that city. The US President bombs that city to take out the terrorist but many American citizens are no longer with the living. That would be okay? Is there a magic number as to how many American citizens can be taken out so as to take out even a single terrorist? And even if there is, would it matter to a US President who was just 'acting within their job description' of taking out terrorists?

Why would Nixon have resigned? Ford, the only president not to be elected, pardoned him, so a lot of questions about the prosecution of a former president were delayed until now. Nixon would have been the first president to be charged if it weren't for Ford's pardon.
