Both section 135 and 136 can only be issued when a medical professional, who has training in mental health or psychology for at least 3 years has given a personal assessment of the individual, if no assessment has been completed the warrant is invalid and cannot be enforced, doing so violates the individuals human rights, even if it has been signed, the individual can be asked to have a assessment but cannot be forced to do so, if the individual shows signs of violence, such as threatening behaviour towards themselves or others this does validate a assessment, it does not allow the police to use force against the individual however, section 136 also cannot be enforced in proximity to the individuals home or place of residence as the warrant does not allow for the place of personal safety to be included in the issue.
