Sir wat the difference between s. 15&16 ..? In 15 prior interest fails but still it ultimate beneficiary goes to class of person and s. 16 says if prior interest fails then whole it fails... So I'm confused so please reply sir will it take place if prior interest fails
Bhai sec 15 me basically ek class of Persons ke favour me koi intrest fail hoga to uska asar dusri class of Persons pe nahi padega. Jaise sec 15 k example me condition thi ki agar B ko beta hoga to gift absolute hogi lekin beti hui to gift life intrest ki hogi to yaha pe kyuki beto ko jo gift ha wo absolute ha to wo 13 k hisab se valid ha . Betiyo ko jo gift mil rahi ha wo life intrest k liye ha matlab 13 k hisab se invalid ha. Ab betiyo ko jo gift mili ha uski invalidity ka koi bhi fark nahi padega us absolute gift par jo beto mili ha
Sec 16 me basically ye ha ki agar koi transaction ha jo sec 13/14 ki wajah se fail hota ha to uspe Dependent hoga koi transaction to wo bhi fail ho jayega. Jaise example me hai na ki B ke beto ko 25 saal k hone ke baad milegi jo sec 14 ko violate kar gaya ab jo dusri condition thi ko B ka agar koi bhi beta nahi hua to C ko milegi. Ab yaha pe kyuki wo beto wali condition hi void/fail ho gayi to uska fark jo ha Wo C par padega isiliye use kuch bhi nahi milega.
