This video is based on section 60 of Transfer of Property Act, 1882 which is based on right of redemption.
This right in India is statutory right but in England it can be of common right as well as Equity of Redemption.

Mam jo apne devisable redemption ko bataya ,usme mortgagee ke pass kya right hota h jisse wo partial redemption kr skta h????????? ,,, (confusion )

Can you please clarify once again the second para of sec 60 relating to the redemption of a portion of the mortgaged property? I could understand that Mortgor or Mortogaor's together can not redeem a part or portion of the property on payment of a proportion of money but the "exception part for mortgagees " mortgagee does not have a right of redemption right? It's the mortgagor's right for redemption only and mortgagees have a right like either foreclosure or sale etc, hence can't understand this point. kindly explain!!!!!

section 58 c is allowing conditional transfer but ye equity me allow nhi kar raha ha es condition ko to hum kis ko follow kare?

From my understanding, in conditional sale, the mortgagor apparently "sells" the property with a condition. It is sale but with a condition. The mortgage deed is not converted into a sale deed.

Ma'am aapne last me bola ki ye section tab applicable hoga jb property mortgagee k possession me na ho!🤔 But sec.60(b) me likha hai ki agar possession of property rakhta h mortgagee to wo possession deliver kre mortgagor ko!???

She meant ki Section 60 A doesn’t apply in those cases jaha property mortgagee ke possesion mein ho. Section 60 toh applies irrespective of whether property is in possession of mortgagee or not.

Then what is the concept of conditional sale? the property is been sold already in that case and it becomes absolute in case of non payment of the mortgaged money. Isn't this against the concept of clog on redemption?

मोर्टगेर अपनी जमीन कितने वर्षो तक रिडीम करवाने का अधिकार रखता है. 2,) क्या मोर्टगेजी उस जमीन को किसी तीसरे व्यक्ति को आगे बय कर सकता है. 3) मोरटगरजर तीसरे व्यक्ति जमीन बेच देने पर जमीन को कितने वर्षो बाद तक रिडीम का अधिकार रखता है. यदि मोर्टगेजी कोई अन्य तीसरा व्यक्ति बन गया हो.
