Seller refuses to move out of sold home and let buyer move in

You've put down the deposit, the deed is signed, and you think the house is yours. But imagine if, even after all that, the previous owners won't move out. That's what a Wake County woman says is happening to her right now.

On April 15, Angie Pearson did what she long considered was impossible. The single mother bought a home for herself and her daughter, Kennedy.
“It’s insanely hard to do these types of things by yourself,” Pearson said. “It was a major accomplishment for me,. It was a feeling I never felt before.”
The sellers, Jeff and Ellen Pope were waiting for a home to be built in Fuquay-Varina so they asked Pearson to enter into a rent back agreement. The agreement allowed the Popes to live in the sold home for 78 days after closing, if they paid Pearson, essentially, they entered a lease. Pearson agreed to the terms and the move out date for the Popes was set for July 15. Further down in the contract was a clause that stated if the Popes stayed past July 15, they would owe Pearson $75 for ever day the stayed.
Pearson said she was deep into preparing for move in when she was alerted by the Popes that they would not leave by July 15. She filed for an eviction and the Wake County Sheriff’s Office spokesperson Eric Curry confirmed that an eviction was posted at that address on July 12. The Popes fought back and appealed the eviction and paid Pearson through the month of July, which halted the eviction. As part of the rent back agreement, the Popes must pay Pearson $75 for every day they stay past the 78 day term. However, WRAL 5 On Your Side spoke with attorney Chris Willet who explained that The Popes are still bound to the initial terms of the contract, and the $75 daily fee does not serve as an extension. Willet is not affiliated with the case.
Pearson and the Popes will meet back in court over the eviction appeal within three to six weeks.
Pearson told WRAL 5 On Your Side that the Popes initially did not pay her the daily fee. Jeff Pope explained to WRAL 5 On Your Side that he was late on the initial few days of payments past July 15 because he was waiting on rulings within the Wake County Court system.
Pearson tells WRAL 5 On Your Side that she is in limbo. Her daughter is set to start a new school late next month and Pearson would like to be moved in before that.
“I’m freaking out. My anxiety is at an all-time high. I have not been sleeping well,” she said. “I don’t know what I’m going to do, money is running out. I have furniture, I don’t know where I am going to put it.”
Keely Arthur spoke with Jeff Pope on the phone. He told her that he wants to move out as badly as Pearson wants to move in. He explained that the new home took longer to build than expected and blamed the supply chain. When asked why the Popes wouldn’t move into a hotel or temporary housing, he explained that wasn’t possible because they own several pets. He told WRAL 5 On Your Side that he and his wife plan to be out of the home by the middle of August.

1. The holdover amount should be so high it motivates the seller to get out fast and cover expenses for the buyer; $200-300/day. $75/day is cheaper than a hotel room and not motivating at all. 2. The judge who stopped the eviction is plain wrong. If you read this document in its entirety, you would understand its purpose is for a short term lease back and the hold-over fee is not rent, it should be viewed as a penalty for breach of contact. The hold-over should not exceed a few days. I am so frustrated for this new home owner! The previous homeowner is in breach of contract and needs to get out of there. It is not and should not be the buyers problem on where they go.

The reporter stated a few times that this was legal due to the contract she signed and ended by stating always carefully read the contracts before signing them. I am just curious how you reached the conclusion that this was fraudulent some how? Definitely a dick move but not fraudulent.

It is highly inadvisable to close on a house while the owner still lives there. There are all sorts of laws and judges who will let an owner live in a house they sold (old, disabled, has old or disabled relative living with them). All it takes is a lawyer to appeal the eviction notice, and you're looking at months or years...

Makes you wonder if they ever had a house being built. It might have been a ploy just to pay rent which is cheaper than what their mortgage payments were. Evil people.

The rent back clause really isn't the problem, it is the rate. I operate furnished STRs and I would never accept $2250 for a 3 and 2. They can't rent anywhere else cheaper. I don't know how these people look at themselves in the mirror honestly. How do you do this to someone?

Wait til she gets legal possession of the unit and finds all the damage that the former occupant leaves for her! Forget pseudo-lease agreements or anything that removes your leverage or is left to a judge to decide. Never, ever, ever, close on a unit that is still occupied.....you walk away from the closing (yehhh...I know it sucks and is inconvenient and will piss-off your lawyer and realtor). Incidentally, no realtor in their right mind would buy a property that is not vacant because they know the terrible financial risk it is. Nevertheless, many unethical realtors will pressure their buyers to enter into this kind of agreement because they just want their commission, and now its YOUR legal problem.

Garbage people!! That fee is not rent and it should not be treated as such I would move in I'd be like "all right y'all aren't moving out well I'm still moving in since I'm the homeowner".

She is too young and too pretty to let that weight creep up on her like that! Get it off now before your body gets used to it and it's harder to get rid of. Probably some stress weight...but don't let it beat you! Single mom, but by the time you can meet someone nice, that weight will ruin your chances. You're God's child and beautiful regardless, but to see that in that short time period was shocking.
