remember that these sentencings are for possession, not creation of the material. frequently lower sentencing will be imposed as part of a plea deal for the possessor to cooperate in helping to prosecute the creator.
Then you need to look at the facts of the particular case and read the justifications made in text. Culpability to a crime matters and that's exactly what she took into account. Giving a maximum sentence for every single wrong is not reasonable and not something our society wants. Our correctional system needs to focus on actual correction of behavior instead of thoughts on revenge.

She is told, by congress how to evaluate based on evidence and information supplied by various court and penal officials. If she makes up her own sentence outside of the guidelines, her case will be appealed and oftentimes overturned.

City councils also pass ordinances that compose part of criminal law. Each state has a statutory criminal code, as does the federal government.
Bring the parents of the toddlers who were being abused by adults and ask them about the sentencing handed out. That child is forever screwed and if that child ends up being a criminal they’ll just say you should’ve sought help. As an adult your influence on a child is massive but yet that doesn’t seem to play a factor in these child porn cases.

I’m all for term limits, but 4 year term limits doesn’t make sense. Congressional seats are elected for 2 year terms and Senators for 6 year I believe. There should be a limit of like 3 or 4 terms.
What about an age limit? Or even better totally restructure the composition of the House and senate so that representation is proportional to the population. This is especially true in the senate as teeny tiny States like Wyoming have the same influence there as humongous states such as texas, california, and new york.

I feel like she took into account the reality of prison. She seems like she knows prison isn’t a place for change, it makes people worse. She seems like she advocates more than change than punishment. Because that’s what prison and jail are supposed to be. Recreational centers. Sending a dude to jail for extraordinary time only drags that jail mentality into the real world after they’re released. In other words, higher sentences make it so that the offender is only worse when he’s released. However, giving someone a taste of prison is far more likely to ensure that they no longer have the intention to even commit those same crimes.
@@henzyperez5487 She also spoke at length about how sentencing guidelines are wrong when it comes to these cases because they focus on the quantity of the content, and not the number of sources or time used to gather them. 1 download could net you terabytes of illegal content and put your sentence guideline into the decades, but that hardly seems fair when people spending years trading in this content and gathering it over time get less of a sentence. At the end of the day the guidelines don't take into account the internet and the ability to get massive amounts of illegal content very quickly.

It's dismissive to do that because they're not all the same and don't all do it for the same reasons. I get that children could be at risk but you also have to think about the people you're incarcerating. If "we can't take the risk" doesn't apply to most cases, then it shouldn't apply here, especially if no physical harm was done to the "victim" by the "perpetrator" (in this case, the image collector). Putting them in jail for the rest of their life for that would be like putting someone in jail for collecting images of murder scenes and saying they're a danger to society. Not all CP collectors would physically do anything themselves so that has to be considered before you label them a serious threat. I get that you don't like it but we're talking about what's fair to everyone, not just the people you care about. Also, if it truly is a sickness, why not hospitalize them? A lot of people call them sick but at the same time argue that they're evil as well and therefore should be either jailed indefinitely or killed, which doesn't make sense to me.

I do not think until 15 minutes ago it was necessary..do you? Two year olds run around explaining to anyone who will listen “he has a penis” and “she has a vagina,” in a very loud voice. There is no trouble. And if you need help women have an XX chromosome and men have an XY chromosome. One from each parent. No trouble. Try to remember say back to 2018. Did you worry incessantly about people who wanted to lop off parts of the body.. There are people who have all kinds of problems and we have it within our country to help those in need. These people need serious help. Their suicide rate is close to 50-50 no matter they transition or not. That is a horrible to life with that much confusion about their own body. They need counseling and support not competition with other women. Does anybody honestly think Lia is proud of what she did here. I don’t believe her throwing her last swims a sign of pride in her choice. I would rather see people live a live of freedom not slavery to their own mind. It is sad.

A rule needs to be implemented for time. I think when the senator is not speaking, their time shpuld be paused. It would eliminate the filibustering answers where they just talk to kill time without answering the question.

I can't speak for everyone, but I find it very difficult to respect the way in which these questions were formed and the inability to allow Judge Brown-Jackson to articulate a response. I think it's important to realize that Senator Cruz came prepared in a very specific way - he wanted to portray a particular narrative by using a group of examples that all point to the same assumed conclusion. The judge's experience is very extensive and she is unable to prepare a straightforward response to his rapid-firing technique of questioning in regards to less than 9% of the cases she's ever convicted. Understandably, she must answer these micro-specific questions with a broad answer in order the lay the foundation so that the America public (who are not educated or well-versed on what is even being discussed) can understand. She was not allowed to do that. What is sad is those who do not realize this are the very ones who needed to hear what she would say. To those who may not take the initiative to understand things on which they speak about, it may be tempting to fall into the anxiety the senator was attempting to create. The truth is that the judge's sentences are on par with the what majority of government/federal judges find appropriate for similar charges. Within-guidelines sentences are often seen as overly harsh and not considerate of humanity and rehabilitation... especially for first time offenders. Unfortunately, the U.S. is nearly the only western country left that forgets the point of prison is rehabilitation and not a holding place for the grave. Additionally, conviction time does not include time on parole, probation and/or other legal obligations and restrictions. It is possible that the defense argued for more time served overall, for a lesser time behind literal bars. For example, instead of a 10 year sentence in prison... a convict can be sentenced to 5 years in prison with an additional 15 years of probation after that - that's surveillance for 2x the amount of time. Out of all crimes, childhood predators are some of the most likely to reoffend. If this covict serves 10 years, they are out of prison with no supervision and are free to do whatever they would like. If this convict is monitored for 20 years, it is much more difficult for them to offend. Those of you who have put in enough effort to watch this video and comment on it, I beg that you also place some time and resources into understanding the judicial system the best you can... especially if you are going to echo statements that you may not have a full understanding of. Whatever perspective you come to, let it be a fair and educated one. These days, with social media, it's amazing the non-sense that people believe out of fear and/or ego. Everything has turned into a conspiracy theory and people with the most to say are the least knowledgeable. I don't believe there is a single logical adult who would accept that type of questioning as respectable, professional, fair or reasonable. Any intellectual person knows that value of a true debate, this was childish cross-fire and really served no purpose other than to rally up America's most impressionable people into following a false narrative that they don't even understand.

I disagree. In few words one could rebut Cruz’s argument with an array of other rulings that may be similar, logical reasoning of each cases specifics that warranted leniency, or a strong stand for principle that child pornography is a possession of material charge, however inhuman, that should not end someone’s life for pixels on computers. She does neither and chooses to argue that because the swimming pool is only 9 percent pee that one could safely swim in it.
Counter argument: crimes involving children should almost never get less than the maximum allowable punishment. If her decisions are "in line" with other federal judges that's all the more reason she perhaps shouldn't be a Supreme Court Justice.

Sounds like you still don't really know the full details of her cases. Maybe look into the disagreements of how sentencing guidelines are outdated for these types of crimes.
