Her Honour Wendy Joseph QC joins us to break down courtroom scenes from movies and TV shows, including 'Anatomy of a Scandal', 'Sherlock', 'Judge John Deed', 'Broadchurch' and 'Liar Liar'. Order your copy of Unlawful Killings here: amzn.to/3Nw3bve
High-profile murder cases all too often grab our attention in dramatic media headlines - for every unlawful death tells a story. But, unlike most of us, a judge doesn't get to turn the page and move on. Nor does the defendant, or the family of the victim, nor the many other people who populate the court room.
And yet, each of us has a vested interest in what happens there. And while most people have only the sketchiest idea of what happens inside a Crown Court, any one of us could end up in the witness-box or even in the dock.
With breath-taking skill and deep compassion, the author describes how cases unfold and illustrates exactly what it's like to be a murder trial judge and a witness to human good and bad. Sometimes very bad.
The fracture lines that run through our society are becoming harder and harder to ignore. From a unique vantage point, the author warns that we do so at our peril.

I find High Court judges' accuracy of language and knowledge incredible. They're like encyclopedias. I know it's part of the job but I doubt I'd ever be able to learn such a rigid framework so absolutely perfectly. The point she made at the end was beautiful.

So, little bit of background. Jim Carrey's character is treating his witness as hostile, something that US courts establish as, though it requires permission to do so, a method by which a witness can be questioned in a way that they would not normally be questioned by their own council, they can ask leading questions, they can ask more probing questions, and they can press the witness on things that they believe to be false statements, etc. As much as his actions are entirely improper(Don't enter the well, don't put on theatrics in the courtroom, wear a proper suit(Yes, I know why his suit was damaged, under the conditions therein the case would have been adjourned for the day)), Jim's character is showing us a perfect example of pressing a hostile witness in furtherance of their own benefit. Sometimes you don't get to pick your clients or your witnesses, so if they're really stupid, sometimes you have to push them to say and do the right thing so that they end up coming out even remotely on top of anything. Sometimes, the worst enemy of your case is your client, and while pre-trial coaching could have significantly reduced the theatrics involved here, he... kinda did the right thing. He did the right thing wrong, but he did the right thing.

In United States law, defense attorneys cannot "call", subpoena, or otherwise compel their own client to testify, and defendants cannot otherwise be compelled to testify by any other means either, _but_ a defendant can volunteer to testify. However, once a defendant has decided to testify, their right against self-incrimination is effectively waived for the duration of the trial. They are treated the same as any other witness, including cross examination from opposing council, redirect and recross, and so on. Their testimony must come in the form of answers to questions asked of them by either council. They must answer any question that is allowable by the rules of evidence, even if answering a question would incriminate them lest they face contempt or perjury charges. Unlike some other rights which can be reinstated at their discretion (for example, in warrantless searches, a suspect who has previously consented to a search can revoke consent and stop the search at any time), a defendant who testifies cannot stop questioning. So if they had this cheeky idea to answer their own council's questions in order to soapbox to the jury, then refuse to answer the prosecution's questions, that won't work.
