Does anyone else agree that the biological Father needs to take some legal responsibility here? He didn't even show up for the trial, seems to be entirely disinterested. However, he didn't actually harm the child, so I don't think any charges could be brought. Being a useless a-hole is not a crime, sadly.

@@AB-hq6vb Even if someone has a predisposition for a mental disorder, there is almost always a trigger of some kind for it to develop fully. There's a 99.999% chance that Shanda had a traumatic childhood as well.
It is still unclear to me what damage has occurred in Paul’s brain from growing up in this terrorist mother’s environment. He got the luck of the draw in the mental health specialist who did his eval. I think his life was ruined the day he was born to Shanda. He did show signs of trying to help his brother toward the end, when he noticed how thin he looked. He even went against his mother’s orders by feeding him, which shows some complexity to the diagnosis. This is such a sad ending to a horrible story.

This is probably the most intelligent and fair Judge I have come across. Most people let their compassion rule over logic. It’s crucial to know which cases deserve compassion and which do not.
I believe compassion was one of the biggest reasons for the judge's sentencing. He had a deep compassion for Timothy. It showed a fair, intelligent, and compassionate judge.

Paul was 18 when he went back to his mother at that point he is an adult and has the right to make his own decisions and those rules no longer apply, he could go live in his own apartment if he wanted! Now Timothy’s father and step mother is another story they should have punishment as well, but Paul’s father can’t be held liable for an adults decisions!

I am so sick of people trying to use autism as an excuse for horrendous behavior. My son has high functioning autism and he absolutely knows right from wrong. It’s such a disservice to the entire community.

They are not saying people with autism don’t know right from wrong. What they are saying is people with autism are more susceptible to manipulation. Your son’s situation has nothing to do with this case as he was not raised in the same environment. Also, autism spectrum is huge. Timothy didn't display any "horrendous behavior". His mother displayed horrendous behavior. Timothy liked taking things apart and putting them back together. Every thing that Monster & Son said he did was classic higher functioning Autism. I may have misunderstood your comment. I meant no disrespect. I'm an activity director at an assisted care home with senior citizens with Autism. All of the reasons VanArdvark gave about his "punishable behavior" were perfectly "normal" for his level of us multiple diagnosis.
This judge is very very smart. I didn't realize till he said it. Paul already had a history of abusing his brother, Paul enjoyed doing it, Shanda used him ye, but Paul didn't object he enjoyed doing it. The judge is 100% right.
I’ve been saying that all along. It drove me crazy that so many people defended, supported and sympathized with him. The fact that he didn’t live with Shanda until age 19 means he already had his “character” developed and was old enough to know right from wrong. He also had access to the camera account and there’s no way Shanda could be watching videos of him abusing Timothy all day while being a COURT REPORTER, in front of lawyers, bailiffs, a judge and other court staff. That means Paul could have turned off the cams and fed him, deleted videos of him eating, erased videos etc. But he didn’t. He also had a job and cell phone, he had access to a the internet and freedom outside of the home. But the worst part is how he regularly snitched on Timothy, made things harder for him, encouraged Shanda to allow him to abuse Timothy more vigorously and introduced new methods of torture/abuse to her. He is worse in my opinion because he was only 5 yrs older than Timothy, was the same gender as Timothy and came from the same place as Timothy. He should have felt empathy but instead he felt contempt and then enjoyed his suffering. Shanda seemed fed up, cold and resentful at ever having to be a mother. She was upset over her husband being gone and took her anger out on a special needs child. Paul enjoyed what he did to his brother. He’s sick. He’s definitely worse.

The fact that his step-sister told police that he was the biggest bully she’d ever met before they even told her what happened says it the loudest. Paul was already being cruel to his siblings, that’s literally why he was kicked out of his dad’s house. He didn’t suddenly start abusing Timothy when he went to his mother’s house because she told him to; he had already been doing it and it just escalated because she encouraged it.

I did notice his head shooting up when the judge passed sentence. He had been on the phone to his dad the day before. He asked who would come to pick him up and take him home from court.
Amazing judge. He considered all the evidence and didn't fall for Paul's performance and excuses. I appreciate how he laid out his thought process and reasoning behind sentencing. 100% agree with him that Paul is "just as bad, if not worse." Finally, justice was served for Timothy.

My husband grew up this way also. His mom had a lock on the fridge. She was afraid of her kids being "fat". I am very thankful she died from cancer when my husband was 16. I never knew her. I've been married 42 years, but I used to cry when he told me about his mother's twisted behavior!

Its interesting to hear jail calls where both he and his mother complain about bad food and cold showers. They knew exactly what they were doing to that boy. They made him suffer by design and should stay incarcerated for their lifetime.
When I hear her asking her friend for money because she "can't eat prison food" and how hard it is feeding herself on so little. Then seeing her order cream cheese and crackers, tuna, beans, sausages etc. Then hearing her complain about being cold and not getting books and breathing treatments I get so upset. Did Tim get to choose his food? Was he cold in the ice bath? Was he comfortable laying on a tarp in a closet. No. I hope her fellow inmates give her the welcome she deserves.

I do NOT agree that he should have leniency. If you compare his demeanor/way of speaking when he testified and from his recorded phone calls, there's is a distinct difference. When he testified, he was definitely "acting" like he had some sort of cognitive delay. In the phone calls you can tell he's very sharp and aware. he deserved a lengthy sentence.

My 4 siblings and I grew up with a mother like this. I actually was locked in a tiny room with nothing in it for an entire summer not allowed to have any food. I could use the bathroom once per day timed. My siblings would sneak me peanut butter sandwiches in the middle of the night. Our mother would sometimes try and force us to hurt or abuse each other- we would do so as lightly as we could bawling our eyes out, or once we got old/big enough, refuse all together. We all protected each other and looked out for each other, (except for one, the also sociopathic golden boy) and as a result, we were all kicked out of the house permanently by 13-16 (apart from sociogoldenboy.) The love between siblings is strong in situations like this no matter the age or mental capacity. It's like the bond of those who are in combat together. Unless of course you have zero empathy. Any one of us would have and did many times take a beating ourselves for refusing to hurt another one. Lock him up and throw away the key.

I love a judge who actually prioritizes the victim's rights over the perpetrator's. His thoughtful and thorough examination of all the evidence of Paul's history, mental assessment, and actions helped deliver a fair and just sentence. What broke my heart, was there was no victim impact statement by Timothy's family. I won't be satisfied until I know Timothy's birth father is also charged in Oklahoma for handing over custody to Shonda when it was against the law. What are you doing Oklahoma??
Paul SA'd Timothy when he was 5 and had to be put in a separate school so there was no contact. He bullied his younger siblings for most of his life. He didn't live with his mother for many years. His childhood evaluation gave a diagnosis that is pretty much code for budding psychopath. He told his current shrink that it didn't even occur to him that what he was doing was wrong (probably in a misguided attempt to look "innocent"). If you listen to the jail phone calls, he finds no irony in his own complaints about bad food, cold showers, lack of preferred entertainment, and a request that he not receive spicy food in his care packages. Not one word of sorrow for his little brother. Not one word of responsibility. The verdict is fair.

When the judge started to say he was trying to place all of the blame on his mother and that Paul enjoyed inflicting torture he hangs his head and he is fuming you can feel his anger towards the judge , so much so that when he realizes he is in fact fuming he pulls his hands up hangs his head more and tries to make himself look small and innocent. He knows exactly what he is doing. Judge got it right.

Everyone thought he had autism cause of his little act in court, I stand on every word from day 1, Paul is switched on, you heard his sentence speech. A letter written beautifully articulated, More like a poem than a get me out of prison speech Anyways……., He was bullying Timothy his whole life they grew up with each other in the same house, It gave him power, he use to tell on Tim just so his mother could dish out some punishment for him to give him! He didn’t care once about what they were both doing to him! They are 2 peas in a pod! Like mother like son! They both had their heads down, The twitchy behaviour, They didn’t want the judge to fry their asses! That’s it! They both lack empathy! Legit psychos! Paul isn’t 1 step away from being one! I listened to Paul's jailhouse calls and in his sick and twisted mind he really believed he would get a slap on the wrist. It's incredible to believe he would get out he tortured and starved him and his brother to death. He deserves to rot in prison just like his sick mother!!!
Incredible sentencing report by the judge. Ferguson was a willing participant from start to finish and his head snapping back when being handed 30-100 years was justice in itself. His world completely collapsed.

Rip Timothy. I can't even imagine the horror and torment he had to go through everyday by people who were supposed to care and love him. Well Paul, you got a long time to think about every time you willingly abused Timothy. You are no different than Chanda, she was his mother and you were his brother, you were both partners in crime. I was originally torn on Paul, but after looking into everything available to citizens I really think the judge gave the appropriate sentence. This judge said it perfectly
Pauls jupers delight at 1:30 still believing he's gokng to get off lightly then hus utter shock and anger when he hears his sentence shows how manipulative he is. The Judge got it right and i doubt he will ever get out as he will always be a danger to people weaker than him.
My father was horribly abusive and made his kids fight in front of him -that’s pretty sick. We’re all pretty traumatized but I protected my siblings garnering more abuse. I cannot comprehend this boy and his actions

Thirty years in prison is no justice at all. A 50 year old can easily procreate many times over. Imagine, being born to a monster who served 30 years. Much wiser to cover his crimes. No Sir! Throw him under the jail as far as I’m concerned,
Love this judge. Paul needed to hear his words. He can’t escape responsibility and accountability for the role he played in his brother’s death. It’s disgusting, shameful, sadistic and inhumane.
This kid grew up in a abusive, neglective and manipulative environment. This kid was 18 which probably compares to most of us at 10 maybe 12. It’s just a sad story all the way around. Why isn’t the biological dad on trial for allowing his timothy to be somewhere he was not allowed to be legally.
