Adv Mshololo was on point to ask the question on handling. Just because it was viewed in court it doesn't mean it should be handled differently i.e from a quality assurance point of view. The justification by Judge Ratha and Adv Baloyi is an error from quality management point of you because how sure will we be that it was the same one?
You are trying by all means to make the cross examination of Adv Mshololo on point neh … but but she should have objected the day when the col mangena open the bullet from from the evidence bag So in plein language she failed

Unfortunately Advocate Mshololo's question was not fully answered..🤷🏽♂️..Mangena did his examination and found that he can use (TB 5 and TB 9)as his match..Sereo's findings were (TB 4 and TB 8) meaning they both came with different results but Sereo decided to take his verification and make them a final results..🤷🏽♂️..
Everything about this case is not make sure. The fact that the bullet was found so late after the scene has been tempered with, plus the gun alleged to have been used is different to the one that the eye witnesses discribed makes this entire case compromised
South African police are corrupt I had a case against 32 police officers but even 2day the docket its lost It's a case of 2020 I don't know where I can get help
I reported the Judge, Prosecutor and Clerk of the court for Mismanagement and I had proof, the Court Manager simply transferred my case to another court & did not take action against the parties involved so I took it upon myself to report to the DoJ and Magistrate's Commission. If you don't escalate them you will never get the justice you deserve.
This case is a shame, I wonder if the bullet was booked out from the ballistic to be brought to court. If senior police officers in SA are handling exhibits as such, in this case, there is a possibility of a planted bullet....hearing this today part of me believes that police can plant and alter evidence at the scene... These are senior police and they are handling a very critical exhibit in their pockets/handkerchiefs without properly sealing it, What a shame in South Africa... Police are really destroying this case...if I was a judge I would have thrown this case out.
It is a common purpose from corrupt Police who shoot people and plant unlicensed fire arm to claim they were shot but In reality that was not the case.

Everything must be recorded in the register so that it can be traceable what if mangena died during the process or worst case some come and claim that gun was used in crime while u hide it in ur office not recorded in the register.
The bullet hit the deceased,went out through the door and came back via the same hole and sit behind the jar inside the house.🤣🤣🤣🤣🤣.That bullet is so clever. Those who were in the house including Gininda told the court that the murder weapon is a revolver(a gun with a wheel) No catridges found. The problem here is the judge.

Mshololo's logic regarding the barrel swap is unclear. It is the barrel that imprints grooves and striations on the bullet, and both Roelofse and Mangena essentially tested the same barrel. Accused's gun also had the same barrel. Changing other parts of the gun only affects the cartridges, and since no cartridge was found, the barrel swap is irrelevant. Mshololo seems to always grab the wrong end of the stick. How can one person get a wrong understanding most of the time?
Looooool I don't think you understand the reason behind her question,go and listen again to her question and the follow up question in regards to the barrel question then you would understand,infact the defence case is always bullets were planted,barrels were changed so you don't understand the reasoning behind the question and this witness played right into her hands,teh defence has to plant doubts into the state case and not to prove beyond reasonable doubt therefore Mshololo was merely trying to put doubt by saying the barrel of the gun couldhave been changed by a ballistic expert and because of the training they received they are able to change barrels faster so they can get the positive results they wants after testing and getting none at first

While the theory that the bullet was "planted" is one of the defence's strongest argument, they haven't developed it adequately. The defence has only offered weak inferences, easily dismissed by any rational person or witness (Ginida and the ballistic analysts). Though the state still has significant work to do to prove guilt and may even fail to do so, it doesn't change the fact that the defence's case and presentation were underwhelming.

The court and the state failed dismally in handling the exhibit bullet even if it was brought to the court. The one who brought it was suppose to carry another seal which after showing the court the bullet is returned in the bad and sealed with a new seal and be recorded again in court that the seal number has changed. Ratha to support such failure is a travesty of justice. He is messing this case.

We're tired about the fabrications and the cooking of this case, according to me this case is to be close,and it will be opened when Kelly and her mother and the neighbor and their colleagues will appear at the court to confess with new advocates,new judge,new state representative and new witnesses Kelly and helle, we're not interested in the caree of ballistics and who ever,but want the truth and go on to listen to other cases, enough is enough
I have a problem with people not following procedure and claim exceptional circumstances...what may be exceptional to one may not be to the other hence rules or procedures are there for everyone to toe the same line

@@siphonengu5436 To be honest, this question is unfair and worse irrelevant if you guys expect a response from Mangena because he is not a DNA but ballistic analyst. This question should have been raised with the police DNA expert who testified last year.
It is hoped that, during his roughly 27 years of forensic experience, Dave has not brought exhibits directly into the lab as Mangena has done. If there is any record of Dave having done so in the past, the value of the defence's argument regarding the legality of that action would be neutralised. It also becomes risky to call Dave as a witness.
