The Judge knows what he is doing, He want the mastermind to be arrested and secrets will be out. If he rulled inadmissible then kelly will not face the music. For me I like the rulling so that kelly can tell the truth, remember this rulling is not final judgement

Indeed and people get carried away by these so called podcasts where a sister to one of the accused keeps on peddling unfounded allegations, even Senzo's brother. Why can't they be what is called friends of the court if they have so much evidence? They are raising a tonne of money in the process through donations and hence they can easily pay for legal representation. Instead that money goes elsewhere....this money comes from the gullible social media lovers.
But the evidence by the state is not clear cut so I don’t get it. The evidence of the police couldn’t be proven and had a lot of holes. Not all cars had AVL so tracking one car when there was a convoy escorting the accused doesn’t make sense… If Gininda met them at the police station his car’s AVL was supposed to corroborate that but there wasn’t enough evidence so according to what the state presented there is a likelihood that the accused were right simply because the evidence isn’t tight…
Why would Kelly and company clean the house before the police arrived or were even called? Why would they want to protect Senzo's wife if she sent hitmen to Kelly's house to kill Senzo? All the eye witnesses said Senzo was still alive when they were driving him to the hospital. Zungu said Muzi announced Senzo's death even before it was announced anywhere else. I doubt Muzi was in Senzo's when he was being transported to the hospital, so how would he have known Senzo died if he wasn't sure the bullet that hit Senzo was a killshot? So y'all reckon Senzo's wife was told, then she called Muzi to say "it's done"? I personally believe Senzo was killed accidentally, then there was a cover up by the police. What we are currently witnessing is not about protecting the people in the house, it's more of a cover up of a cover up, if that makes sense.
@@SamukeloMaduna covering up the fact that they tried to cover up at the original crime scene when Senzo was killed. Not sure if you'd noticed, but almost every state witness kept closing holes that were left by the preceeding witness. When being lead on their evidence, they would conveniently mention something that the previous witness encountered during cross examination.
Now you are digressing into something. The same mistake done by the defence. They spent a lot of time presenting or cross-examining state witnesses on things adding no value to material matters regarding a trial within a trial. The last straw was when Mgo called in a witness who was irrelevant as he was not part of the team that arrested the defedants and involved in the so called confessions arrangements and hence his evidence was largely based on hearsay and obviously this is not adminisible. A lot of those things should have been left for the main trial. Even the state was not immune from this disease. For example, I don't know how the witness who gave testmony on prison regulations added value to proving beyond reasonable doubt that these guys were not tortured. Lastly the defence knew that there as a voice recording about Ntanzi's confession and were at some point given time to go and listen to and later succesfully argued that it was recorded without his consent and hence not admissable. They didn't for instance advance an argument on the authencity of such a recording without a scientific verification of the voices. So for them to let Ntanzi claim that he never conversed with Magistrate Cronje was one of the mistakes, at least in my opinion. He could have rather claimed he gave a confession under duress fearing for his life due to the beatings. He also claimed that the confession he was purported to have signed was forged. For him to admit that the signature was his when the state had not proven or verified that was another mistake. Now he can't later argue that it was not his. Remember he claimed that he bled on the papers that he initialled and hence he could have easily claimed that those which were shown in court without blood stains were forged. We could go on and on but my opinion is that fatal flaws were committed by the defence.

He said the dentist, magistrate & 2 different interpreters in different field lied about the same thing He supposedly never told them. He lied he was at work when he was not. He lied abt drawing money. He lied about being taken to a ATM dump yard. He lied about the magistrate never asking him a single question. He lied about not bathing for weeks but yet he had changed clothes on multiple occasions. Throwing hus defense under the bus multiple times. You cannot be rational & look over these facts. A major clue in the confessions being admissible was that majority of the defense head of arguments were never even brought up in cross examination of state witnesses for the trial within a trial.

We've already knew that this was going to be Ratha's rulling,its not surprising.i feel sorry for this two guys because its clear that even the final judgement they are going to be found guilty, its clear as well.
The judge is saving his life here the way he put it he is actually saying the accussd are not guilty but in oder for him to be trusted by the state so that in the final he will change and say these guys are not guilty he is now saving his life to continue with the case but I know at the end the 5 guys are innocent the judge knows that just he want to continue I can say what a smart way of doing things he even say it's a ruling not judgement what does that mean to you?

It's so sad . The defence cocertrated on the arrest procedure and deed very little to prove about the confession and pointing out. On Ntanzi Mjiyakho should have been brought to court.
Calling Mjiyako in the trial within a trial was supposed to be called by the state since they say Ntanzi was represented. The state was supposed to prove they have evidence that Mjiyako was hired and retained by Ntanzi and that proof doesn’t exist but we must trust the state’s evidence
@@rita_TMThere is client attorney privileges which means that a attorney cannot be called to testify against their client. So the State would not be able to call him maybe the defense. And the defense could not do that because Ntanzi 1st claimed to never ever known Mjiyako. But there is court records that he represented & won 2 previous cases for him & this was their 3rd encounter. A criminal defense lawyer would also never want to testify in these cases cause who in their right mind will hire him & then the next day he is testifying against them. There is loopholes in our law in this instance.

Also, they failed to tell us the day when Ntanzi said he wanted a lawyer because allegedly when he was giving the 1st confession he said he didn’t need legal representation when they were "telling him his right to a lawyer" yet they can't tell us when he said "NOW I NEED A LEGAL REP" this alone would be some evidence that Mjiyako was hired by the accused. I remember a video of the 5 men in court for the 1st time being asked if they needed lawyers and they said yes... but that was after the so called confessions, so make it make sense.

Already the state has said there were at least telephonic conversations between one of the accussed and Kelly at least on two occasions and to the best of my recollection this was not challenged in the cross-examination. E.g., one could have easily said I once met this beautiful lady who told me she was called Cathy and all that I did was to propose love to her but to my suprise she claimed not to have known me when I did a follow up. It therefore means that Cathy gave me a wrong number that I now understand in court that it belongs to Kelly

@@SamukeloMaduna I will definitely do that because there is learned people here who know how to construct grammatically correct sentences, respect the rule of law. Additionally, there is a justice system that is not bogus, corrupt, dishonest, and deceitful. People here pride themselves in what they do and the quality of work and service they deliver.
It couldn't have been a co-incidence that all confessions were made under duress, it would seem that the accused were making just bare denials. They are just making a turn-about after realizing the detriment this would have in them being found guilty or not at the end. Its a scheme to do damage control on the defense part.
This judge is predictable , I mean, we all knew that he already made his mind about the admissibility of those confessions. Not surprised at all by his rulling.
