I don't know why Mshololo seems to think that raising her voice when cross-examining is a strength. She must just be calm and collected as most of the time she ends up scoring no point.
The dentist was not requested to examine the patient for the purposes of determining whether he was assaulted or not. He was just complying to the requirement that any denstist must do as part of examining the patient. So the state is just being generous by pointing to the bare minimum that even if this was not the request at least the examination done by the dentist should have picked some injuries. So for seasoned advocates to be hanging on the fact that a dentist is not a surgeon is at best clutching at straws unless they want to dispute that the examination he did was not part of the requirement and should be thrown out as they over-stepped. There is a reason why a dentist is expected to administer such an examination and their training is deemed adequate to perform such. In a nutshell if there was a complaint from the accussed that he was tortured, then the right expert would have carried out the examination.
I understand Mr S Ramosepele works together with Adv T Mngomezulu but that continued whispering to Adv Mngomezulu during the time he conducts cross examination I think it disturbs him in the line of thought coz he also shows him some notes even if he (Ramosepele) believes honestly that he is assisting the Adv but it may have opposite effect.. Yes generally he can do but tome it seems it's very frequent...but anyone can differ with me...3/2/2024
