I can see why the concealed weapon charge is a stretch but since pepper ball guns are less lethal and they are made with markings indicating so, such as a yellow mark or orange tip, I can see why he could be charged with it. To a reasonable and ordinary person it looks like a real gun. Hence the term “beyond a reasonable doubt” if he were to pull that pepper ball gun on an officer and they shot and killed him, the officers would be completely justified.
