China's position is not unique and is in line with some Western countries. China *declared that it does not accept any of the compulsory dispute settlement procedures for all categories of disputes listed in Article 298(1)(a-c).* This means China has opted out of using ITLOS, ICJ, and arbitration for these types of disputes with other UNCLOS parties. However, their declaration does not preclude them from agreeing to other non-compulsory methods of dispute settlement on a case-by-case basis. . China already said many times that South China Sea (SEA) disputes return to the table for negotiations and return to the track of bilateral negotiations but the Philippines choose to risk their fishermen and journalist life in the disputed area to provoke China. . . Did US ratify and signed UNCLOS Annex VIII, Article 298? NO. . Article 298 of the International law explicitly said _"a state may declared in writing that it does not accept any one or more other ways the law proposes to settle territorial disputes". this might sound controversial but in reality nearly 40 countries did that. Australia, Argentina, Canada, Denmark the list goes on to speak nothing of the U.S. who did not ratify the law in first place so in say no to compulsory arbitration on sovereignty China has plenty of company in the Western world.._ . *International Tribunal for the Law of the Sea - Declarations made by States Parties under article 298:* .
