I started listening to the vodeo past midnight thinking that few minutes of law would ensure good sleep. But Adv Naphde's grip on the subject of Land Acquisition and his overall knowledge on the subject of law ruined my sleep . But I am glad that I could listen to such an erudite man. Would love to meet him one day in person when I visit Supreme Court next to pay my respect.
Kindly give your attention to this issue also as it is highly related to the life of farmers , jamindars and land owners . In the year 2013 , land acquisition act 2013 was implemented on the replacement of old English land acquisition act 1894 . In the act 2013 relief was given to farmers, jamindars and land owners from the high handed ness , unfair deals and forcefully acquisition of their lands . But vide a judgement dtd. 06-03-2020 of Hon'ble Supreme Court 5 judges bench , the said land act 2013 is again silently converted into land act 1894 , now the land act 2013 is also likewise to the black English land act 1894 , totally against the farmers , jamindars and other land owners , But Strange no one is talking about this , sab chup hai🙄 The judgement of 319 pages of the 5 judges constitution bench of Hon'ble Supreme Court dtd.06-03-2020 in land acquisition matters related to Sec. 24(2) etc. Of land act 2013 , should be / must be withdrawn immediately in the public interest. I need to know that , What will be the impact of the judgement dtd. 06-03-2020 of 5 judges bench of Hon'ble Supreme Court (regarding land acquisition cases sec. 24(2)) , on the metters decided on 31-08-2016 by the double bench of Hon'ble supreme Court of the same nature. Will the effect of judgement dtd. 06-03-2020 is retrospective or prospective.
He rightly said merely legislating a law on land acquisition isn't going to solve the problem or land losers may get fair compensation, resettlement or rehabilitation unless there is efficient, honest and hardworking bureaucracy to support it. My experience dealing with these acts respectively LARR 1894 and RFCTLARR 2013 initially as a SDM and latter on as a additional land acquisition officer I experienced them when I faced very complex situations left over by my predecessors in #NH57 #SH78 #NeoraDaniyanwan rail project due to inefficient handling the projects marred by corruption and irregularities that not only made them complicated to compete the project in time but also failed to deliver compensation to land losers.I had to work out hard to resolve the issues in land acquisition but I succeeded to eradicate all hurdles in land acquisition.Land loseres were not ready to part away with their land. In #BihtaSarmera road project the said land acquired under LA 1894 ,project started in most of part in 2011 but work couldn't start under land acquired in few blocks that led land losers to demand to get compensation under new act 2013 that made project very challenging.If project had completed in the stipulated time ,protest would not have started against land acquisition for enhanced compensation under RFTLARR act 2013.But I took charge the project and made it hustle free ,thus helping to make dream project of our hon Cm true but no credit goes to me.www.jagran.com/bihar/patna-city-negligence-in-aquazation-of-bihatasarmera-state-high-way-13276010.html?WA& Before my joining status of land acquisition was in #SH78

Is section 05 of limitation Act applicable in Right to fair compensation....Act 2013,,, I have not filed reference application since 9 years as award passed by collector in 2015. I am not satisfied with award now want to move an application under sec. 64 of said act but it's bared by law. Is there any SC Hc ruling where sec 64 application allowed after many years.
Sir solutions for all these cases related to the act LAAR 2013 , is very. Simple. Govt must make only one amendment. That is 50% of the amount will be given now at the present market value And the remaining 50% will be awarded after 15 years after acquisition at that market value. So that land owner who got 50 paise from dlf , now would have got 2 lakhs rupees per sq meter now .
LAND OWNER WHO HAVE RECEIVED THE UNDETERMINED COMPENSATION UNDER PROTEST AND SOUGHT FOR DETERMINATION OF COMPENSATION U/S SEC 18 OF OLD ACT IS ELIGIBLE FOR REDETERMINATION OF COMPENSATION AS PER NEW ACT PROVIDED THE DETERMINED COMPENSATION REMAIN UNPAID FOR MORE THAN 5 YEARS FROM THE DATE OF AWARD IRRESPECTIVE OF POSSESSION. Am I correct Sir?
Sir my question is that if publication of final master plan is the initiation of land acquisition? Because these master plans are finalized in advance 15 to 20 years and land required for road development is identified and reserved through these plans but govt acquire this land after 15 to 20 years. That sounds inappropriate. Can you please put some light on this matter? Thank you.

Must also speak on why the most populated State of India with maximum number of pending cases has minimum Benches and why West UP which owes for more than half of the total number of pending cases of UP has none and so also why another lawless State Bihar has none and why a peaceful State like Maharashtra which tops in the latest justice index ranking list has maximum number of Benches and peaceful States like Karnataka also we see Centre approved two Benches at Dharwad and Gulbarga respectively in Karnataka whose total population is just 6 crore in one go in 2008 but for 30 districts of West UP whose population is more than 10 crores and owes for more than half of the total number of pending cases of UP and still Centre is not ready to create even a single HC Bench nor even a single e-filing facility in any of the districts!
