It was not a valid threat and the council just used it as an excuse to remove her from the meeting, as evidenced by their interviews afterward wherein they complain she's been a pain in the ass. It's not illegal to be a thorn in the side of your town council! There was no legitimate threat. Did her comment teeter on the brink. A little. But, since it wasn't fighting words and she wasn't standing there holding a weapon, it's covered under the 1st because it's a public forum.
