If ESPN didn't want their ACC media contract out, they should've urged the ACC to negotiate a settlement and not run to the courts .just saying.

JY, your position on the view of the ESPN/ACC media deal is a tad bit disingenuous. Your right, ACC school do indeed have access to the media deal. However, you didn't speak on the requirements that the ACC mandates to view the contract. The mandates are: 1. An ACC rep must be standing over any school rep that views the contract. 2. Only a school rep can view the ESPN agreement, no outside counsel. 3.The school rep cannot write down or transcribe any part of tht media deal. 4. The media agreement can only be viewed by 1 party at a time. So technically, your correct. But that's not the case in reality. There's an enormous cost associated with viewing the ACC-ESPN media deal in the current set up. The 2 schools in question are fighting for unfettered access to the agreement....not necessarily to publish the deal to the public. So yea. That should assist u with the facts of the ACC schools access to the ESPN agreement. Respectfully

We talked about the hoops that a school needed to go through, but they can see and have seen these agreements. The conspiracy theories floating around by fans are just that, conspiracies. That’s is until facts prove them otherwise. As you know, we try and deal with the facts and educated opinions, not conspiracies.

@@TheBigMountainPodcast| Yeah... i try to stay with the facts and lean on my 1st and 2nd hand knowledge of the situation. Through a very close and personal friend, who is indeed connected to the athletic department, it was communicated to me years ago and the restrictions to view the ESPN agreements. So when i hear pundits speak on particulars parts of this case that I know for a fact are not correct, its rather irritating. I know you guys are not doing it on purpose, or at least that not the feeling i get from you 2. But, I just want to be able to give you guys and the viewers more accurate info. I do like the you guys' effort to somewhat inform the broad college audience of the matter. And for that I really do appreciate it.

JY.. I know u guys didn't think much of FSUs "sovereign immunity" at tht time, but now it's obvious that that claim has some meat on it, thanks for Leon County's Judge John C. Cooper. It's OK to change your opinion on your previous sovereign immunity take.

Steve has been talking about the potential importance of SI since the beginning. Time will tell if it has meat. We have had one judge say no and one say maybe.

@@TheBigMountainPodcast | Yea. SI is vitally important to the case. So far, a powerful and standing state AG, 2 large Public land grant institutions legal counsels, and their attached BOTs, both the South Carolina state constitution as well as the Florida state statue and a Leon County judge supports SI. On the other side, we have a Mecklenburg County judge and ACC legal counsel who dont support SI. Up to tis point , the numbers seem to be on the SI stance. Thats not even debatable.

Bledsoe will find a reason to agree with the ACC and ignore first file. It will be hard for him to tightrope that home cooking but he will find a way to favor his home state and state entanglement with the ACC

It is interesting that the appeal decision has taken so long. Maybe, FSU may have something with the “Venue Shopping.” If they do, the ACC is in trouble with both cases:

Agreed. He cleverly decided ACC non compliance with their own rules and subsequent amendment satisfied the law.

Clemsns motion to dismiss in nc states that clemsons claims are differerent than fsu and that the acc is treating them the same when they are not.

This is common sense. Florida State University is an arm of the Florida state government. North Carolina courts can't have any power over a Florida government entity. I guess they could seize Florida State's money if they play any games inside North Carolina, but I can't think of anything else.

From what ive heard the acc doesnt even have half of the mefia contract on display for the members which if true Clemson getting a full copy is huge

To be honest there are only three ways the ACC can possibly win. 1: Clemson and ( or) Florida State agree to pay > the full amount to leave. 2: Both the Clemson and FSU suits are combined and Mecklenburg finishes first ( and Judge Bledsoe determines Clemson and FSU must stay until 2036, regardless of ESPN). Thus, Leon and Pickens must defer to him despite what they think. 3; ESPN must extend or the ACC must get $ close to what they are getting now. Anything else is a loss. Do I think these things happen? NO. But I bet nothing is settled before August 15th ( when schools must give a year’s notice to leave). However, if ESPN extends, maybe the ACC goes “All In” and refuses to settle?

Around the 17:30 mark in this video you state that the schools have already seen these contracts - while we know that is true of the GOR document, I was under the impression that the ACC has NOT allowed members to see the ESPN agreement (since individual schools are not direct parties to that agreement). Has it been shown that this is untrue? To me the most important document to get into the record is that ESPN agreement, and unless I have missed it somewhere I believe neither Clemson or FSU has had access.

They all have access to this document via the ACC headquarters. Many, if not all, have seen it. None of them have a copy of it, but that will change May 10th.

So you can confirm they have access to the ESPN-ACC agreement? That would appear to be new information in the case. We have previous confirmation they have access to the GOR but not the ESPN contract. In fact there have been public statements saying that member schools CANNOT view the ESPN contract.
