I have been diagnosed with moderate sleep apnea. It's hell. I can't imagine what it's like for people with severe sleep apnea. I get really tired, but I never get that deep restorative sleep that refreshes me and lets me have a productive day. Instead a lay awake most of the night tossing and turning and praying to God for mercy. When I do feel very tired and I'm about to fall asleep, I am awakened by a tickle in the back of my throat and an awful feeling of being suffocated. I have tried a CPAP machine, and it doesn't work for me. I also have restless leg syndrome and I'm hoping between the two of those conditions, I will win my case. My hearing is about a year away. Wish me luck please.

Nate Legakis I have been diagnosed with severe sleep apnea. Was told yesterday at my ENT appointment. I am not allowed to drive. I’m a Sales Rep. driving all day. I was advised to notify Vic roads. If I don’t and have an accident I’m not insured. Mind you when booking me in for my appointment. They didn’t mention anything to me about not driving to me appointment. Knowing I lived 105 kms away.😫

I have been diagnosed with severe sleep apnea just a few months ago, and afterwards realized a lot of other illnesses I have are related like leg,ankle and foot swelling, depression, fibromyalgia, anxiety, I did gain 25-35 lbs but I'm not obese, 11 years ago I was diagnosed with pulmonary sarcoidosis in all of the lymph nodes in my lungs,this was after several bouts of pneumonia, was on steroids and injections for 3 years ended up with two compression fractures in my back and 5 herniated discs, caused from osteoporosis that was caused from the steroids, not to mention a few other medical issues, I never missed much time from work other than a few days for surgeries, I worked for almost 38 years and I just got to a point where I could barely do what I needed to do around the house, it took close to two years to get a hearing and I was approved that day. I have to say the apnea is horrible, if you have a cpap use it, this will keep your problems from getting worse for a while, I was also diagnosed with achalasia (maybe connected to the sarcoidosis) that would require surgery to fix and is not 100% that it would do the trick, the weight I gained from the steroids is now dropping off since I am limited to what I can eat, our bodies are a whole, when one thing is wrong it effects everything like domino's. I was a very active person my whole life and never envisioned being like this, I have not given up, I'm trying to increase exercise,eat better foods and have a positive out look, what's left, we have to try.

Mr. Ginsberg, first off, I'd like to thank you for your videos! They are very informative and have helped me immensely! I tried looking up the the listing for sleep apnea that you mentioned (3.10) and the Soc. Sec. website said that it is/was "reserved". You also mentioned in your video that you would post a link to it and I didn't see it. Is there anyway that you could 1)re-post a link, 2) explain why 3.10 is now "reserved" or 3) if it is "reserved", that you could post what it says in the listing? Thanks!

Paul, SSA periodically changes the listings and that's apparently what has happened here. If you look at the introductory paragraphs at listing 3, you will see the following: P. What are sleep-related breathing disorders and how do we evaluate them?Sleep-related breathing disorders (for example, sleep apnea) are characterized by transient episodes of interrupted breathing during sleep, which disrupt normal sleep patterns. Prolonged episodes can result in disorders such as hypoxemia (low blood oxygen) and pulmonary vasoconstriction (restricted blood flow in pulmonary blood vessels). Over time, these disorders may lead to chronic pulmonary hypertension or other complications.We evaluate the complications of sleep-related breathing disorders under the listings in the affected body system(s). For example, we evaluate chronic pulmonary hypertension due to any cause under 3.09; chronic heart failure under 4.02; and disturbances in mood, cognition, and behavior under 12.02 or another appropriate mental disorders listing. We will not purchase polysomnography (sleep study). So, SSA is now evaluating sleep apnea in terms of how it impacts another body system like the cardiac system or mental (cognitive state) system. This is consistent with what I am seeing at hearings - sleep apnea alone is rarely enough to win but sleep apnea in combination with other issues can still support a winning claim.

@Mr. Ginsberg, thank you for the prompt update. I noticed in one of your other videos, you mentioned having a client with "multiple disorders". That's where I fall with sleep apnea being one of them. I get between 3-5 hours of sleep per night because of multiple health issues. I have an upcoming hearing and I cannot thank you enough for the videos that you have done! If I could ask a favor, I would ask that you do a video on timelines and work history (if you haven't already done one). I was under the impression that the SSA took into account ALL of your prior past work history and experience to prove a person's credibility/work credits, but learned later that the SSA is only concerned about a certain time frame centered around the time of the disability(ies) that a person is claiming. I was in the military for 20+ years and the majority of my issues come from the cumulative time that I was on active duty. However since the VA and SSA view disability through completely different lenses, what happened in the military may not be applicable to the civilian workforce...or how they're evaluated. Thanks again!

Sleep Apnea is more than uncomfortable. It also makes me sleepy most of the day. I have shortness of breath, headache though out the day. I should get SSDI.

Subbed, thumbs up. I had a "representative" that I did not know was not a lawyer until after my case got rejected, went to court, then got rejected again. Things have changed, I just need to call you. Or I'll write you on your site.

Thanks. I’ve been on a CPAP machine for 11 years. I have so much anxiety when rising in the morning. I am also a mouth breather. I cannot breathe out of my nose. I am also disorganized and disoriented during a work day. Please advise if you can help. Thanks David

How does the fee schedule work for services such as yours? Do you pay a fee up front or do you get a percentage of disability when approved? Thanks!

Mr Ginsburg I love your videos! I have severe sleep apnea, stage 4 oastauthorities in my right knee , morbid obesity, lymphadema in both lower legs with pain and tiredness. I have a prescription for a walker because I can't stand or walk but very short time. My right knee gives out on me quite often causing me to fall at times. I been denied the first two times. What you think my chances are going in front of the judge. Thx

George, I'm glad you like the videos. The question of whether or not you qualify depends on whether your medical record contains information that can help a judge understand how your medical diagnoses impact your capacity for work. Do your conditions, when considered in total, prevent you from performing reliably the duties of a simple, entry-level job?

You need to see a Dr. and find out what caused this, a lawyer can not help you with a medical problem.

So this year I've been diagnosed with severe OSA (I stopped breathing 71 times during the sleep study). I was also diagnosed with type 2 diabetes and high blood pressure this year as well. I want to apply for SSI what should I do?
@ssdattorney
@ssdattorney 3 года назад
You will need treatment records and statements from your doctors explaining how these conditions prevent you from performing the tasks of a simple, entry level job. I have never had much luck winning cases based on OSA and generally speaking you will need evidence that your diabetes is out of control despite insulin and you have neuropathy, retinopathy or other organ damage.

I'm 48 almost 49, I have been told not to drive by doc if I am tired and have a couple of point score from being moderate sleep apnea. i also have insulin dependant diabetes, mild disc degeneration tiny bone spurs, depression, obesity,numbness hands legs, had vitamin d deficiency. Is there any hope and how do they expect one to work if they can't drive? Thought about calling ssa and asking them that question but they would put me on hold for six hours. They think if you can do something for five or ten minutes you should be able to do it 40 hrs a week. They don't get it.
