If the consumer does not purchase anything from the Hayley Paige brand then it will affect them in the purse. That is all they care about. Profit is the key motive of JLM. I also bet most people don't care and will find gowns they like and not notice that she left the company

She hasn’t been allowed to use her name and her record company didn’t put her music out.. literally couldn’t legally sing her songs for 10 years I believe. But she got out, she didn’t give up!! I came to comment the same thing. Jojo has a interview out somewhere about her fight to get her name back. This is actually really common in the industry and it’s so sad it’s not talked about more!

Listen to some episode of "say yes to the dress" If she can go to the bridal store , she go and surprise the bride. I've seen her draw in 5 minutes and entire bridal jumpsuit for a bride that liked a dress but not the fact it was a dress. She's amazing in her work :)

Your mommy and daddy gave you that name as part of your personal identity and no one should be able to tell you you can't engage in life in your personal dealings. Such a hard and demoralising fight. It's been that way for many designers before her. No one forced her to sign the contract. She had time to have her lawyers review it before signing etc.

I remember when this happened to Pierre Cardin, and his name was used on all sort of cheap and silly things. There should be a law, that no company should have the right to have control of anyone's name, a name is something, as you mentioned, given at birth by your parents and no matter what no one should have indefinitely control of it

I support you 100%, Haley! You are one of the most creative bridal designers out there and you shouldn’t have to give up your creativity, social media or, especially, your name for someone else to control and besmirch. JLM needs to stop this and come to the table willing to talk like adults. If they aren’t willing to do that, then you need to hire the best team of litigation attorneys out there and show them what it means to fight for what you believe in. I posted on your other video from two weeks ago. Consider designing clothes for dogs and cats, as well as wedding dresses. Many pet lovers spend a lot of money per year on their pets. You could use your dogs name or add part of yours to it. A new creative path could be a great start for you. Financially, it's not a bad idea, if you love pets. Everyone loves animals ❤

In my opinion, how about if HP requested that her Insta be deleted? So that JLM won't have any leverage against her? So that she can make new and UNDER her name. Is that allowed?
The name "Hayley Paige" is trademarked by JLM so they own the name. They do not own the instagram itself if she started it off as a personal account and did not hand over any rights to it. However, If she were to start her own bridal line under her name/instagram then they will have the liberties to be able to have her account removed/handle handed over. If she moves forward to only use it as a personal account and to not use it to sell similar merchandise or to make a profit, they most likely will not be able to do so. It will also come down to court ruling.

They like all other companies in every aspect of life who take the artists own and call it theirs when in fact it is not within their capiabilies to come up constantly with new ideas. @@marcywolters6402 they didn't take anything. She SOLD her brand aka name and designs. That means she was PAID for everything. It is no different than if you write code for Microsoft - the company owns the software even if you later quit. If you think you deserve more than the money they paid, you can quit and start a new company - just don't call it Microsoft and sell the same software you designed previously. Her name is still hers to sign checks, birthday cards, etc. The only thing she cannot do is sell it again as a brand as another company ALREADY exists and is owned by JLM. Stopping her from attempting to steal is not bullying and no one is stopping her from designing. She just needs to do the hard work of creating a new brand and new designs, rather than ripping off another company. But yes, everything is documented. Which is why she has no case and the more she keeps tarnishing JLM the more she opens herself up to a lawsuit where she would lose everything else. That will be fun to watch. Maybe you can bring the popcorn.
Ms Hailey Paige - from the distance of any involvements in creative and business parts that sounds absurd and out of common sense. I love to see your creations and your connections to the brides. Why anyone wants to bully that? Whatever JLM is their idea to participate as non-creatives business people in a beautiful world of creation appears to be outdated. However, nobody should be stripped off his/her own name to use or social media accounts on his/ her name. That is so that unbelievable that one really need to see that in writing to believe it. I wonder how Social Media companies react to that? Doesn't it contra-actions their very first idea? Courage to you and hope to see you soon as designer again.
I'm not a lawyer, so the long winded comment I post is merely my interpretation of the law that isn't in legalese. It's based on my experience and observations regarding other contract issues I am somewhat familiar with. ------------------------- My situation: I had an employment contract with a previous employer that included a broadly worded non-compete clause that they wanted me to sign before I could start working for them. It stated I could not work for ANY competitor for FIVE years after leaving them. I worked for an academic service provider, but I have performed my role in academia, the business sector, and now, for the government. There are many avenues one can explore in my career, but my ultimate goal is a professorship. The way this NC was worded, it appeared that they could block me from being employed by a university, in any role (our clients were universities, and they potentially could claim any university as a completitor). I balked. Fortunately, a friend is a lawyer and I sent her a copy of it, while contacting my recruiter to express my concerns that I plan to seek teaching roles, but the broadly statement implies that I cannot take any role with a university, as you could argue they are competitors. She got back to me the next day to share an email from their legal counsel that defined exactly what the NC covered. Quickly sent off a thank you, while pointing out that the contract needed to be specific. My friend pointed out what I think will prevail here , that your contract contains an extremely broad statement that is unenforceable. Social media when you signed the contract was not even a fraction of what it is today, so even if you *had* your lawyer review it, they might have asked for specification of 'use of any iteration of name', 'use of images', 'etc. and not even revised it to include Facebook or Twitter. They state that they have the right to use and license your name - they do not OWN your name. --------------------- Two things to consider that may help clarify, both from the music industry: 1. Frank Zappa's estate owns all rights to the name Frank Zappa. They (mother and two younger siblings) sued Dweezil Zappa for performing music on a tour named "Zappa Plays Zappa." They wanted an injunction blocking him from using the name Dweezil Zappa in their suit. They won the first part, Dweezil cannot use "Zappa Plays Zappa" or "Playing the Music of Frank Zappa". HOWEVER, the judge ruled that you cannot claim ownership of an individual's name. As such, he can use his own name - but IIRC, there was a period of time where an injunction was in effect and he could not use his own name. --------------------- 2. A guitar builder set up shop as Dean Guitars, his first name, making some unique guitars 40 years ago. He later sold the company to a business partner, including all rights to the name Dean Guitars. Several years later, he missed the creative energy of making guitars and decided to get back into building guitars. He found a partner and set up a new company. He sold the rights to call it Dean, so he named the company DBZ Guitars. He still could design and sell guitars. If I understand correctly, over time, he didn't like the way the guitars were being produced and left the company. They renamed to DBZ Diamond. They owned the rights to the *business name*, not his personal name. When he left DBZ, it was to form a third guitar company that only makes their guitars in-house (factory direct). It's more of a boutique brand than the previous two companies had become, and this time, these guitars wouldn't be sold by retailers - they'd come directly from a factory he personally oversees. -------------------- I don't know if these two examples help you at all in clarifying things, but I hope they lead you and your counsel to potentially finding case law decisions that specifically address and strike down what JLM is asking the court to rule in their favor. It can be argued that people would identify you as a person more so than the brand. It's "HP is the designer of HP bridal," rather than "HP is a corporation that shares the name with the main designer." They don't own your name, they cannot prevent you from designing entirely. I don't look at your social media thinking it's a corporate website, I look at it because some vloggers I follow were supposed to have weddings this year and they both expressed interest in trying on and purchasing HP gowns - so I looked at the dresses. I've seen you on SYTTD, so I know it wasn't a made up name, and you're a human, of course you're going to drink, dance, travel, express your feelings about COVID. It's actually a freaking selling point about the HP brand -there's a real person behind that brand who is endearing and engaging with potential brides. That is worth FAR more than JLM realizes - the engagement and approachability you provide HELPS sell the product. They can probably argue that any future entity you own/operate to design and sell bridal products could hurt their sales if it is named MissHP, or HPG, or the various iterations of your name that are in the contract you signed. It is why the contract licenses your name. Forgive me if this next part is wrong, but no one has stated to the contrary. They license the named permutations of your name within the contract as they relate to the design, marketing, production, and sales of bridal dresses. What I do NOT see is anything that expressly forbids you from designing at all - they license your name, and it would be a reasonable expectation that if you hung out a shingle for a new company named HP fashions, LoveHP, WeddingsbyHP, yadda yadda, it would cut into their business. So if you named it All That Glitters Bridal, unless your contract states specifically that you cannot design bridal, you would be able to do so, provided your name wasn't prominently featured in the marketing or on the website, or included in the legal name of your company. There are legal ways to start a new company and thrive, while holding to the spirit of this contract, should the judge rule in their favor. HOWEVER, this is another question I have. Does the contract state they license your name in perpetuity, or just for the length of your employment? How does it address the termination of licensing, if at all? Can they terminate the contract at any time? Can you? Or is it a lifetime thing? I don't expect you to answer any of these questions, they're merely the gaps in this contract that I see that could end this in your favor. ____________ Final thought - you're welcome to post on your Insta 'with their approval' means they view you as their employee who has to abide by their code of conduct. Were you asked to sign one? (A prior employer, in the early days of Twitter and Facebook, had language in our new hire documents that spelled out that we could not say who employed us in anything we posted on the internet. This predates your contract with JLM, so it would be a valid question for the judge. I've got a couple of other business ethics/legal questions, but they name thing is the primary focus, so my ADHD brain will just stop here before this becomes War and Peace,. ***If you'd rather I take this down for any reason, please feel free to message me. My opinions and observations are just that, especially since my legal experience really comes from reading a lot of cases and having a penchant for watching tv shows about lawyers... Hang in there, hold your head high, and do whatever you can to be the shining light you are in the darkness of these times. You make a lot of brides happy...
She is totally free to design and start a new brand - absent any reasonable non-compete period in the contract. She is not allowed to cause brand confusion which is why she cannot use her name for commercial purposes. Thus the brand cannot be “sparkles by Haylay Paige” as people would not understand the difference with JLM’s intellectual property. Her gripe is not that she cannot start a new brand. It is she doesn’t want to do the work of starting a new brand rather than ripping off the IP of JLM.
@@scottmolnar4132 at the same time they shouldn't take her own personal name for their gain. For example if it was All that Glitters by Hailey Paige then they can sue her for the right to keep All that Glitters not Hailey Paige.
@@Wondorawoman if she created the brand "all that glitters" they would have bought that brand. Instead, she created the brand and they bought the name Haylay Paige. They get to keep that brand name. She still keeps her name, she just cannot use it for commercial purposes as they already own the brand. It literally is that simple
@@scottmolnar4132 It's a little of that, and a lot of grey area because the social media accounts in her name did not exist when the contract was drafted. She is not prevented from designing at all, she just has to do so under a name that doesn't include any permutation of her name as spelled out in that contract. As with the Zappa case, it can be argued that it is her name, and she can freely use her name in non-wedding industry activities that do not negatively impact JLM's business. The Instagram account detailed the whole of her life from the time she opened it, and designing wedding dresses was a big part of that, which is why they're arguing for it. Vacation pictures, food pictures, pet pictures, family pictures can make it clear to people that it's a personal account, not run by the business. If she'd only put designs and dresses on there until recently, they'd have a legitimate claim to the account.

I want you to know that you have a lot of support from many many people who have been bullied in the workplace themselves and also see the injustice in what JLM is doing.
