Ok so heres an example of what you don't want to happen when out trying to enjoy some street photography..
I was innocently chatting to Gary Gough who i know from youtube as a very experienced street photographer when a security guard who we were aware was following us approached us and ordered us to stop filming as we were on “private property”
Since this encounter I've tried to find out if this is the case. Ive emailed cardiff council who as you'd imagine are yet to reply.. There are no signs around the city centre advising of this and the information is not available anywhere on the internet.
All i can say, is even if the security guard is correct about private ownership, we still have the right to explore and access the site.. Ill update this as soon as i hear otherwise! Needless to say the threat of the police was not welcomed. Since then I have enquired with the police force who have informed me they would not have attended the incident as the security would not have been able to press charges as no crime was being committed!
Very frustrating still and I'm sad to say it took me a while to get back into the mood..
I hope you enjoy the vid, ignoring the terrible audio of me standing the wrong side of the mic, I've since found the Gopro so the next vlog will be ok (audio wise haha)
Thanks again for helping me reach 10k!! Thats awesome!!

A lot of security guards and sometimes police are unaware that under the Criminal Justice Act 1972 a public place is defined as “Public place” includes any highway and any other premises or place to which at the material time the public have or are permitted to have access, whether on payment or otherwise ”. so irrespective of him and his private land claim because the public are allowed access at the material time it is a public space.

@@GaryGough hello bud.... yeah that area was most likely a street not too long ago.... and now pedestrianised. The shops may own it now and are most likely responsible for its upkeep. However it's still a public space with no lockable doors or gates or fences... so anyone can access it at anytime day or night. I dont think there can be a more public space than that... do you. Just an over enthusiastic security guard with a misguided understanding of what he was doing... He just needed to know where his boundaries were. You told him... 😄😄😄 All the best you two... super vid. 👍

@@AndrewBenbow - An interesting read indeed. It's complete nonsense. In fact, this article has made me mad. Rules we can't read, areas which aren't defined and now I read security guards have the right to man-handle you in an area that is clearly accessible by the public. What is this country coming too! Thanks for sharing Andrew

Hi Gareth, I’m a police officer and routinely get challenged when I do street photography. One instance resulted in me being surrounded by 3 security guards, threatening to call the police because they knew the law and I did not (oh the irony). I never mention what I do for a job, because I see it as circumnavigating the situation that many street photographers find themselves in. It is reasonable to be asked to account for your actions. On the occasion I just referenced, I explained what I was doing, referenced the law and they eventually walked away. Looking very flustered. Knowledge is power. If you ever come to London give me a shout.

100% agree mate! but as they have a uniform on theyre often not willing to listen to your point.. as was the case here.. i wish id recorded the conversation Gary had with the second 'officer' he was a nice guy and had no intention of causing upset.. thanks for the comment mate! very helpful.. im tempted to do a follow up video.. might even try and interview some security staff..

@Tom_YouTube_stole_my_handle 5 лет назад
I'd actually question the comment that it is reasonable to be expected to account for your actions. A person acting within the law should not have to explain themselves and someone intent on acting illegally is hardly likely to admit to it rendering asking them to account for themselves pointless.

Can you imagine we often were stopped at public exhibitions to photography their display they put on for public to see. Their logic is "someone will copy our designs". Happened just a few days ago again by youngsters so it really pushed me over the edge at that time and I gave them a 10-minute long lecture on the new world. Lol. I do event coverage and promotion and I was with the team officially promoting the expo and products on Internet. Selection of photos by others you add in the end is just breathtaking, very fun and inspiring.

One of my worst experiences with something like this happened while I was doing an assignment for my college class. I was shooting in a downtown area of a city that so happens to be feet from the border of mexico and Texas. About 30 minutes into my shoot a white van suddenly pulls up in front of me and homeland security jumps out and shake me down. They questioned me for about 10 minutes, asked for my license, and all that drama. They assumed I was some kind of terrorist with a “high powered camera” trying to plot an attack at the international bridge. I lived 30 minutes away from that city and I was followed out by two unmarked vans and a helicopter. It was ridiculous.

The thing is with the Security is they probably see dozens of people filming and taking pics on their phones daily but because it’s a camera you get challenged I’ve had same prob on a few occasions. Public place you can film simple. Worth bookmarking the law on your phone so you can show it if you get challenged again. Oh got some nice images. 👍🏽

When I had my Fuji X100, the zone focusing technique was a go to for my street photography. The saying, "f/8 and be there", holds true . I used f/8, 1/500 and auto ISO a lot of the time, set the focus at 3.5 metres and everything from 1.75m to infinity is acceptably sharp on an APSC sensor. The thing about the X100 is that if you don't have to rely on auto-focus, which wasn't a strong point on the original, then the shutter lag is virtually non-existent and it's perfect for catching candids when you have to react fast.

There’s a simple answer to this whenever confronted. Ask them to prove it with an official document (which they should have with them if they intend to stop photographers in a public space). If they don’t have one or can’t prove it politely inform them that you’ll carry on filming until they can. If they keep on at you inform them that you’ll be calling in the police for harassment.

Can i pick your brains please.... I currently use a bridge camera but want to upgrade to a better one, currently my camera struggles to focus properly and I'm really limited in the depth of field and length of exposures i can use, I've taken some good shots but most don't come out right because the camera takes ages to take the picture I want something that can take superfast action shots or long exposure but I'm wary about buying a digital camera because of the autofocusing never working correctly, i want a camera i can manually focus like a traditional slr but i don't want to be faffing around with film rolls, so could you recommend a camera(s) around 5-600 quid but likewise I don't want to shell ut on a new camera only for it to have issues thanks

Is that some kind of outdoor shopping centre? Its tricky with photography laws. It probably is private property but with an implied right of access.

Solid and entertaining video. I like #7 the best especially knowing it's candid. Were you able to get any shots with the street light shadows and numbers at the 10:34 mark? I can just hear the Indian guy behind you giving the person on the other end of the call a play by play of what was going on when the police wannabe approached you.

Gareth, did you use a polariser for the shot of the guy in the coffee shop? The video has a lot of reflection but in the final image this is well controlled.

No problem mate really great to see that you face people who think they know the law head on ! I get the same Agro when out filming with the drone ! I am so careful to site survey and risk assess ! And ensure I’m adhering to all the relevant legislation and drone code directives ! To cover myself and any people in the vicinity.

I know what u mean about having a hard time after that. U get that nasty feeling in the pit of your stomach, from a pointless confrontation. Glad u kept going cause it is hard when u have to be in a certain happy mindset for good art.

Yeah, that would ruin the photo walk for me, leaving a bad vibe in the air. I am unclear if they have the right or not, especially to physically remove us. Its a shame if this is how it is now and we just have to live with it. But if we have the right, like Marty says in the 1972 law, it's important to educate the security to stop them ruining other people's day.

Mat CMP u got to watch those security guards! I had one tell me that I couldn’t point my camera at his apartment building(which in US is a complete lie). I just nodded and told him to call police, of course he didn’t, he just thought I would submit cause he was in uniform. But it had me fuming on the inside. 🤓 ruined the whole vibe

I don't know if it's the same there, but on private property such as a department store lot, it's a public space, they certainly want business, but they may "trespass" you, meaning ask you to leave, but this rarely happens.
@iainmc9859

Glad you put this video up. Law's different in Scotland but the same general principles apply. Generally its best to ask the 'security guard' in an ill-fitting goon outfit to call for a policeman. The police hate being called out to this sort of 'incident' as 99.9% of the time it is a civil law issue and not criminal law. If the goon touches you or the camera, or even threatens to do so, call the police (this is criminal law). Regardless of which the 'security guard' usually drops the issue when you mention a real public servant in a real uniform. Another good tactic is to pull your phone out and start videoing/shooting. Most low brows can't make the mental leap between a camera and a phone. 'Are you asking me not to use my mobile phone on the street? Why are you asking me to not use my phone on the street?' Thinking required, does not compute - end of problem! If it was indoors I'd be respectful (as I would be in a museum or art gallery) and probably not film/shoot anyway. Generally stay cool, polite and involve real public servants if needs be.

Zone focus is particularly useful for candid shots especially if the camera is shot from the hip. Adjust camera strap so that camera hangs in the stomach region. This way it is possible to walk with finger ready on the shutter. You only need to press the shutter to take the picture. Fling places where a lot of people pass such as bus stop, road. Crossing, i cab take image as fast asablink of the eye.

It looks like you got some great shots, Gareth! Even with the guard hassling you, still great shots. When you say you are Pre Focusing and using Hyperfocal, I'm curious if that's better than Zone focusing if the subject isn't too far away? And, could you explain how you set up your Hyperfocal for 2 meters to Pre-focus? Thanks for all your information on the settings. Very Helpful!!!
