CRDA Act was published in AP Gazette in 2014 which has legal base for Amaravati. TDP Government already passed a resolution in Assembly deciding Amaravati as the Capital and forwarded to Government of India. There is a problem if Amaravati is published as Capital in the Gazette before 2nd June 2024. That would amount to AP Government giving up its right over Hyderabad as the Joint Capital and the claim over the joint properties there. Political leaders including Pawan Kalyan may give political statements but no Government would do that till 2024 atleast. Telangana would gladly welcome such a notification.

What Sunkara interprets the law, appears to be totally from Jagan's Government point of view not from the irrevocable legal agreement point which prevents farmers from approaching any court under CRDA Act. The CRDA Act commits for construction of nine cities that include Administrative, Legislative, Justice cities on the land pooled from farmers. It should not be forgotten Capital around Vijayawada was decided unanimously in the Assembly in 2014 when Jagan was Opposition leader, so also CRDA Act was passed by the same Assembly. Sunkara is trying to say whatever new Acts brought by present Government regarding 3 Capitals, have legal sanctity and what was enacted by previous Government like CRDA Act and CRDA Rules etc do not stand in courts. Does this mean the Agreements under Statuary Acts have no legal validity? Government lures 29000+ farmers and make them part with 34,000 acres promising them building the Capital with different cities including Administrative, Legislative, Justice cities under irrevocable agreement and then after four years unilaterally says, plans have been changed & 60% of promised constructions would go somewhere else, would not that amount to breach of faith or in plane words cheating? Sunkara is trying to give some Constitutional interpretations to justify Government actions. In simple occurrences, in case a builder makes a written promise by way of an Agreement with the buyers for construction of a large ultra modern Apartment complex with many facilities and collects large amounts from them and fails to provide many of the facilities, some of the buyers as victims approach Sunkara for legal remedy would he not fight their case in the court of law for justice? Same is the position with the innocent Amaravati farmers. Instead of talking of natural justice, even the so called legal luminaries are trying to find escape routes for breach of Agreement. Anyone who goes through all 307 pages of High Court Judgement, does not find any ground for the Government to move away from its commitment. As for the Court giving judgment even after Government repealing 3 Capital Act, the point not to be missed is, Government in the same repeal Act said they will come up with a more comprehensive Bill after detailed consultations with all stake holders which means Government has committed to court their plan of 3-capitals survives, hence the judgment by the High Court. Regarding comments by Hon'ble Judge in Supreme Court about Town planner, 3 months, 6 months time limit, most probably they have not fully apprised themselves on total stoppage of work since 2019. Once they come to know most of the buildings are at 50% to 90% stage, they will be convinced six months time is enough for completion. Other iconic buildings like Secretariat, Assembly, High Court etc are above foundation level. Factual position will come to the notice of Hon'ble Supreme Court in the hearings ahead.

There is a contract (9.14)between ap govt. and farmers for ap capital city. Capital city definition is in ap reorganization act. We have to see the time from the date of agreement and that time has over, that's why high court has given extra 6 months time. I think you may obtain minimum common sense than law degree. That agreement also made by government with opposition support, it should be keep on mind. Based on this scenario AP high court given that judgement. Govt. has to do as per agreement, no doubt, it should happen.
Supreme court refused to give stay on points one and two. What Venugopal said is not important... What is veiw of Supreme Court... That is important... STATE govt also never told to Supreme Court that they will shift capital .... Govt counsel never told that there are going to shift capital .... Govt had taken lands for development of capital .. .. Supreme court had to intrepetate the meaning of capital..... They only gave stay on timelines .... There should be answers to the questions raised by the Supreme court .... 1. Supreme court had asked whether state govt want shift capital , if so where they want to shift ..... state govt answer--- no for the time being nor shifting... since the bills were repealed , old bills are existing and hence Amaravati is capital .... 2) supreme court question .... straight question , whether state govt want shift ... STATE govt counsel answer -- to the best of their knowledge ' no .. in future if required assembly may take decission... Supreme court comment --- since there is an attempt to shift capital , high court is involved since shifting of capital is braking of agreement made with farmers.... 3) Supreme court --- what is the meaning of capital ---- answer to be found in final judgement -- SUPREME has to intrepretate the meaning of word "CAPITAL "" If capital means the place Where Secretariate is placed, head of depts are placed , Assembly is placed -- then these bldgs which are part of capital can not be shifted.... If capital means nothing , it is only a word then final conclusion is only a word capital is written in the agreements made betn govt and land owners ... If SUPREME court agrees the assurances made in agreement are to be fulfilled and the word capital is interpretated ,? AMARAVATI to be developed as per the agreement and as per the interpretation of the word 'x CAPITAL "" If this is the version accepted then time lines that is points 3 to 7 will come for discussion.... If SUPREME court feels the agreements and not valid in the eyes of law , the case is closed .. state govt need not do anything in AMARAVATI... BUT state govt affidavit says they will develop AMARAVATI as per agreements ... If to be developed what is scope of development.... as capital or only roads and other real estate infra ..... If as per agreements means as capital, then the facilities pertaining capital can not be shifted ---- to be defined by court .... Things and Indecisive Judgements are very very far from Hard/ Naked Realities/Truth. For eg take a small individual family, putting up a family at the place of work and shuttle from a distant place causing hardship for smooth functioning..In fact a family can’t afford for such luxuries. Every family should have a realistic and prudent and economic realistic approach and prioritise the things, luxurious family stay or economic and smooth functioning.. Being local everything works and Here in this case the real and genuine farmers who donated the agricultural lands for state capital should not be neglected and rent/ tenancy/కౌలు for the farmers should be paid on a regular basis
High court should have told to hand over the completed flats etc to owner s by completing facilities as first priority. I am not understanding the way high court twisted issue without solving the issue. They made judgment favourable to jagan by giving unattainable targets instead of solving. This made government to go to supre court.

I respectfully differ with your opinion sir. Doctrine of separation of powers may not have much relevance when the state had entered into a legal and binding agreement with the Amaravati farmers. The doctrine of equity plays much role in this scenario. Even an ordinary civil court will have inherent jurisdiction under section 151 CPC to do any act to meet the ends of justice and to prevent abuse of the process of law. In such case AP Government, which is a party to the contract can not be seen as "Legislature or Executive" and therefore the doctrine of seperation of powers is not applicable in this case. The high court was also well aware about the non practicality of the given timelines in their judgment. The only intention of the high court could be to put pressure on the government so that atleast from now onwards there can be some serious action on their part. The comment passed by Justice Smt.Nagaratna during the hearing about the high court acting like a chief city planner are only obiter dicta, with an intention to elucidate the view of the farmers' counsel. The high court judgment has to be viewed from macro angle covering all legal issues involved in the case. Even assuming that the Justice Nagaratna made the comment seriously, it will not stand at the time of final disposal of the case, as there is every chance that her present view will get changed after thorough mustering of all relevant facts involved in the case. I follow your channel regularly and appreciate that you always advocate the correct legal position and explain legal nitty gritty to the laymen in their language. But in this issue, I have a different view from yours.
