Got to love how elected officials ask citizens for money to fund their campaigns and then turn around and make ordinances not allowing citizens to ask people for money.
It's hilarious how arrogant these pigs behave up...until the moment somebody calls their bluff. Cops love letting their mouths write checks that the law can't cash.
A corrupt tyrant will want to hide their actions. A civic patriot will want to reveal corruption and hold everyone accountable. The 1st amendment, freedom of the press, exists for all people to observe actions of our government and report to everyone so that corruption and tyrants can be rooted out. If tyrants can hide their actions, they can hide their corruption. There is no excuse to prevent transparency and accountability.
I'm fine with it coming out of the city's pocketbooks. These people are in these positions because of who the people vote for, it's their fault - take notice, or pay.
Coming back to this, I want to add that I think the tyrants should also pay; they did the crime, they do the time (or a payment, separate from the settlement with the city).
I bet that cops ego took quite a hit to have to reverse himself and allow Jeff back onto the property. It could have all been avoided if the cops actually knew the constitution they are sworn to uphold.
Within U.S. of A-s Leo WORLD, They must verbally (NOT WRITTEN NOR SIGNED) orally with hand in the air, SWEAR TO UPHOLD the Constitution. but that legally lasts only until they lower their hands. Let SCOTUS mandate the first 6 amendments, verbally be recited "BY HEART- FROM MEMORY BY EACH LEO UPON CITIZEN DEMAND AND ENCOUNTER.
Well...that was interesting...these two officers went from "if you do not leave, you will be arrested" to "you are welcome to sit/stand on the steps with your sign." What ignorant clowns.
The times on the BWC and dispatch logs don't match or make sense, especially the supervisor who literally arrives in 2 seconds according to the logs and officer 1 BWC shows him walking 10+ seconds before he arrives. This isn't trivial, these are legal records and it's inexcusable to have time discrepancy
While I am not American, I am Australian but I enjoy RU-vid videos and Jeff’s are amongst my favourites, but the thing I noticed about these and other auditor videos is the complete lack of knowledge that police have in regards to constitutional rights and the Constitution is the cornerstone of their democracy. One thing that is so prominent to me is the need to get I D off anyone they talk to, almost like a crackhead getting his daily fix.
@@garyholt4445 exactly. law enforcement training here in the US is short - weeks, not years. And most of the training is physical - wrestling techniques to gain control immediately. and then verbal 'do what I say' regardless. Training in the law itself is simplistic and mostly on-the-job. Individual rights protected by the Constitution are skipped over completely in favor of the officer being in control at all times for 'officer safety'.
This is not poor training, it is the training that law enforcement agencies want. For example, the will train officers to get the ID of everyone they interact with , even though it is a violation of the 4th amendment to compel someone to ID unless there is reasonable suspicion that the individual has committed a crime (in some states ) or has been lawfully arrested. The theory behind this policy is that the more IDs they get, the more likely they are to find people with open arrest warrants. You will see cops threaten to arrest people telling them they have to ID, but that is actually a federal crime, though no cops are ever charged for it, but there is federal statute that allows you to sue the cop and the PD if they force you to ID under threat of arrest under color of law that is an easy lawsuit to win and cops do not have qualified immunity for this (42 U.S.C. § 1983). The police don't really care if they get sued from time to time because the city almost always pays the settlement and it comes either from insurance or from the general fund, so nothing really happens to the cops and they believe that having the policy is tough on crime. That is what is happening with police training. It is the way it is because police leadership is tough on crime, even at the expense of breaking the criminal law, 18 U.S. Code § 242, to achieve their perverted goal. So the taxpayers pay for a system that breaks the law to serve them in the goal of finding the occasional bad guy.
I wonder about that. It should, without doubt. In this instance at least those two officers should know now that panhandling can't get you trespassed from city property, but I just wonder if they would eagerly violate the rights of someone the following week, someone not as knowledgeable as Jeff.
What kind of idiots thinks a city ordinance can strike down a 1st amendment right. That is exactly the same thing as making a city ordinance against religion. You rock, Jeff. ❤️👍🇺🇲
Every city manager and Mayor in the country. I promise you that EVERY town/city in the united states of America has one or more unconstitutional "Ordinances" because the average citizen does NOT know their rights nor the constitution and just goes on about their day until it finally hits them in the face with a 200 dollar "Fine" for looking like a "Vagrant" in front of the city managers house.
After watch a lot of these videos and the results of them. I wonder if a lot of these ordinances are on the books so officers can argue they acted in good faith.
@@robertsparling There's lots of cases where law enforcement officials have had their qualified immunity stripped, and held personally liable for violating citizens' constitutional rights.
They target the poor because they know they cant fight back. As soon as they realized Jeff could hold them accountable, they turned tail and ran. This is exactly what cowards and bullies do.
They also target the poor and homeless because they don’t see them as a money source as the other taxpayers. They search for ways to convict them of a felony so they are also non-voters
@@Tshikonelo What lawsuit? A panhandler gets a ticket and gets moved on. A dumbass 1A slacktivist isn't moved on because he lacks the balls to actually panhandle and break that law...so no, no dispute there. What, you actually think he's going to spend money trying to file a lawsuit because he was trespassed for 5 min after lying to police? You obviously either don't know how much lawyers cost or you think he has a lot of cash to burn.
@@JamesAtkinson-ge3jt he wasn't told not to panhandle on public property, he was told his constitutional rights don't exist in public. That's a scary precedent that you have no ability to justify. Democracy doesn't get to vote to commit genocide, Democracy doesn't get to deprive others of their liberty. It doesn't matter if it's annoying.
@@journathan Okaaaay.....not sure where any of this comes from, but watching the video again, yep. He's being told not to panhandle on city property - not that he can't panhandle elsewhere, and NOBODY mentioned constitutional rights not existing in public. Like...not even HE said that. Now where do you get democracy (do you even know what that means?) committing genocide or depriving others of liberty from? The key isn't "don't do it", it's "don't do it right here". Out of all the civil rights violations that happen daily down there, you take up the cause of one FAKE (not even real) panhandler trying to do activism? Do better.
Excellent to see that their stupid intimidation tactics didn't work on Jeff, because Jeff is a man that knows the law, something they definitely don't.
So NOW! Jeff appeals to ALL OF us! NON LEOs, to become 1-A activists in educating the "DUMMIES" that WE, as Citizens Allow, by being truthful taxpayers.
Love how you threw the law back in their faces !!! These two idiots don’t care what the law is only that they are obeyed !!! Thanks for what you do Jeff you are the best !!!
Cops dont care and arrest lawyers for following the law simply because the cops disagree. We dont hire intelligent people to do these jobs we hire morons that follow orders without thinking.
@@Dannyboy1550 City Hall is limited public property. Was the frauditor there to conduct business with City Hall? No. I'm all for signage and expression of thoughts and such. It's best to do it where its properly designated though.
Any Clearly Unconstitutional Ordinance allowed to be made should get the city Attorney's license revoked plus a $50,000 fine or 1 yr in Jail. Petition your Congress people for such a Statute to be made?
City attorney only advises, does not make ordinance. Board members are the ones that should be gone after, but good luck with that because they have qualified immunity as well.
Only the finest people. Just imagine how they treat people who can't stand up for themselves. They prey on the weak and don't bat an eye when doing it.
I bet “big dummy,” does it again to someone else who is ignorant of the constitution. Greed, sloth, pride, and wrath, the man will retire with a gold watch.
Hero officer because they want conformists not moralists. A conformist will do what they are told regardless of what is right. A moralist does what's right regardless of what they are told.
They will just never accept that their authority is not unlimited. They truly believe "I said so" makes everything they say lawful. The more of these videos I see, the less I think this country is not headed for disaster.
Beyond the threat of arrest for a protected activity, what I find most disturbing is the lack of contrition on the part of either officer... that's a pretty good indicator that they don't take their oath seriously
There's not a single cop in the United States that takes their oath seriously. If they did, you'd see cops standing up to those who violate the constitution daily. Things like civil asset forfeiture wouldn't exist. Those who don't actively partake in it defend those who do rather than upholding their oath to the constitution. Every single cop has chosen the paycheck over the oath.
They do take their oath seriously. The freemasonic oath they make at their Fraternal Order of Police lodge, at least. They don't care about their oath to the constitution.
@@Tuning_Spork So who mislead the cops on their way to the call. The cops were already talking about a guy on the steps of city hall asking for money. Are you going to blame Jeff for that too? Jeff, doesn't have to answer any questions and he can choose to answer them in any way he wishes. He played into their preconceived ideas because they weren't there to listen or investigate. They were there to run him off.
yeah, it doesn't matter if he was asking for money or not. That's also protected under our 1st Amendment. So sick of citizens AND city officials not know ing the law!
The thing is both those badged clowns - especially the Sergeant - look more foolish after the encounter as it just showed how clueless and contemptuous they were. Great audit.
Sparks read the back of the sign as "Help me not hate" when it clearly says "Help not Hate." He is so biased against people he perceives to be homeless that he adds a word that suggests Jeff is asking for money. Therefore, justifying the abuse of his authority.
I love how they are so biased by the time they show up they can't even read accurately. The sign says "Help not Hate" there is no "me" there officer. This is a really interesting look into how people's senses are affected by their thoughts.
Speaking of time... the times on the BWC and dispatch logs don't match, especially the supervisor who literally arrives in 2 seconds according to the logs and officer 1 BWC shows him walking 10+ seconds before he arrives. Not just clowns, but CRIMINALS if they behave this way. “Section 242 of Title 18 makes it a CRIME for a person acting under color of any law to willfully deprive a person of a right or privilege protected by the Constitution or laws of the United States. For the purpose of Section 242, acts under "color of law" include acts not only done by federal, state, or local officials within their lawful authority, but also acts done beyond the bounds of that official's lawful authority, if the acts are done while the official is purporting to or pretending to act in the performance of his/her official duties. Persons acting under color of law within the meaning of this statute include police officers, prisons guards and other law enforcement officials, as well as judges, care providers in public health facilities, and others who are acting as public officials. “ www.justice.gov/crt/deprivation-rights-under-color-law
Nope, they are just keeping their town from turning into Portland or Seattle. Good for them. Especially letting him go when they discover he's just a slacktivist.
"That's something you would have to take up with your attorney." It's already been taken up with attorneys and judges, all the way to the Supreme Court of the United States. It's decided. They're big dummies.
Make these claims and cant drop a case. Go read Watchtower. Further read that Federal and State, and County, and Muni, and anything governed by the government is restricted property.
There is no qualified immunity for violating clearly established constitutional rights. Carrying a sign, even with profanity on it, on a public sidewalk was ruled a constitutional right long ago. The cop doesn't know this because they were not trained on it, and there is no incentive for them to be trained on it (sometimes there is, but that is a different story and is the result of a DOJ assessment to see if it is systemic in a department). If they were to have arrested Jeff, Jeff would have sued and won, but the cops don't care. The city taxpayers pay for the insurance or the money from the general fund to pay the settlement (and this would be a slam dunk case). This case had nothing to do with qualified immunity because qualified immunity does not protect a cop against violating clearly established constitutional rights. Jeff said he would lose it, but in this case, he would never even have had it, It was already lost in previous Supreme Court Rulings.
@@letsgobrandon7567 It only costs a small filing fee with the clerks office to file a lawsuit... I would not hire a lawyer as that would cost thousands... what do you have to lose filing yourself?
He was trespassed because he lied about breaking an ordinance and further lied about continuing to do it. Then they figured out he wasn't panhandling and just being a slacktivist, so they lost interest in him. He's irrelevant.
I suspect the older cop has a decade or two serving in law enforcement, so the fact that he doesn't understand the First Amendment is scary. He will, I'm sure, continue to violate the civil rights of citizens, mostly fueled by his ego.
he understands his tatics quite well... he doesn't care about the rest because he doesn't have to as he is protected from his stupidity by the laws the government passed.
This was priceless. I can here the cops attorney saying “my God leave him alone.” I have watched multiple appeals court hearing on qualified immunity and you are brilliant letting the officers know they are messing up…
It’s so sad that we’ve been watching these videos for years and they still don’t get it. If they spent half as much time learning the constitution, which is the very basis of their job, as they do shooting their guns, which most will never do in the line of duty, we would not have to pay our hard earned money to defend these tyrants in law suits.
That would be due to the training of follow orders and nothing else. No worries as they will be covered unless they do something too out of the ordinary. I tell people if you want to change it. You're gonna have to restructure the whole thing or replace it city by city and state by state.
The basis of their job is to collect revenue. To be sworn in you have to take the oath. It is just like basic training. Once you get deployed, you are told to forget everything you are taught.
They never learn anything because they don't have to. Jeff said the cop would have lost his qualified immunity, but the fact is that there is no qualified immunity when it comes to clearly established constitutional rights. The thing though is that had the cop arrested him, Jeff would have sued both the cop and the city, and he would have won because the Supreme Court long ago ruled that holding a sign in a public forum, even with profanity on it, is protected under the 1st Amendment. The thing though is that the cop and the PD would not pay a penny out of their own pockets. In this case, my guess is that the city has an insurance policy to pay out in the event of city employee misconduct and the settlement would come form that and not the police officer's wallet or the PDs budget. In other words, the taxpayers are punished, not the wrongdoers. Since there was no lawsuit (and even if there was) there really is no incentive for the PD to get all of its officers in a room to do civil rights training, and they continue to do what they have always done. This particular cop may have learned something, but it is unlikely that the lesson would reach the entire force, and even if it did civil rights violations would continue because the only way to stop that is when the DOJ has to audit the city and prescribe civil right training. They can't force the city to do the training, but they can cause the city to lose federal funding, and it makes it easy to get criminal convictions for civil rights violations in the future, so the three things that fix it are the public getting fed up and getting civilian oversight, cities losing their insurance, or the DOJ dropping the hammer on them.
Usually the cops have ZERO repercussions for them breaking the law, ignorance of the law is never a defence unless you wear a badge or know the right people.
He is baiting them by prcaticing his rights ! If solicitating for funds is constitutional then the state of FL needs to be sued for not removing this law and adviseing all cities to do the same .
The cop who said take it up with your attorney is a spineless coward. It's his job as someone who took that oath to tell his command staff that he won't enforce local ordinances that attempt to supercede the Constitution because that's an attack on the Constitution you swore to defend. If he's fired he has a wrongful termination lawsuit and he'll never have to work again. Cops lack the intestinal fortitude and gumption to tell command staff and city government to go kick rocks. That's textbook tyranny.
It is appalling public officials ask for money for their political careers and they do not due their jobs, don't show up in congress for debates. Ignore what what the people who voted for them, wants, needs and concerns
OMG did no cops get the memo about you. Hardly anyone knows their civil rights anymore. U R my Hero! Neither did I until 3 years ago. Now I have 3 books on the constitution. God bless, JR Boise
"Help not hate" message of compassion and love for everyone. "Help me not hate" 1:02 This is how the cop read it for the camera. A selfish message filled with guilt.
Jeff you should tell them you will sue under Color of Law Section 242 Title 18 US Code and they lose qualified immunity and their boats...lol😂 I see they folded!!
Why would they call the city attorney? He doesn't have him on speed dial. Its not there job. They dont get held responsible for a lawsuit. The taxpayers do.
You know what the thing with this is.... if you and I went the Tarpon Springs City Hall with the same sign as Jeff and did exactly what he was doing, we'd get trespassed and even arrested by those same cops.... Keep doing what you're doing, Jeff.
The anger in his voice when he found he was wrong tells the world that this dummy should be nowhere near a badge and a gun. How may innocent people has he railroaded?
The report said he was requested to sit on the bench and refused. The bench wasnt even referenced til the engagment was concluding, and only as a suggestion that he was able to use the bench if he wished to take a set. The officer lied on a sworn document to try to make him look worse than he actually was. I do believe that florida has a brady list that this clowns name needs to be on.
Law suits should be paid by the police departments funds. Not the tax payers. Also, police departments shouldn't investigate their own corrupt officers.
This went from if you don’t leave we are doing to arrest you! To sit on a bench and stay as long as you won’t. Listening to the interaction over the radio and threatening trespass and trying to violate a man’s rights was sicking. I can imagine how they treat the public daily. If your doing your job and upholding the laws how in the world would you get a rise. Even Jeff ask for you to contact the city attorney make those calls but Jeff wants to cause a issue.
I love how you stand your ground in the most calm manner and protect our rights. I'd love to see you and Sean from Long Island audits get together and team up in an audit. It could be legendary. Thank you for what you do.
I love how you always make these the gold standard videos of auditing you don't curse at them you just call them dummies to their head not behind their back when they're being dummies keep up the amazing work
Besides violating the 1st amendment right they also didn't realize that city property is public property,, which you can't be trespassed from if you haven't broken the law or done a crime.
Jeff, Question: How long will it take the cops of this nation to learn about the 1st Amendment? Answer: Six minutes and 20 seconds. Thank you for what you do!
