What a cowardly thing for him to do to that child who wouldn't stop crying. He probably did something to cause that child to cry like that. That's when judge told him he would not be eligible for parole. That's disgraceful. He should punch a wall really hard. I bet after that his girlfriend broke up with him after beating her son like that. It's just cowardly.
he's just doing his job as a defence attorney. he has to find an excuse somehow. cause that's what he got paid for even though he knows that what the defendant has done is very wrong
Yeah his face when saying "we don't know if he could do it again" basically reeks of "fuck this kid, I am doing the minimal work judge, you know". Although they get paid to defend. All they can really do is ensure a fair trial. If the trial is fair, then sentence is also fair.
I'm so glad the judge pulled out his quote. It flies right in the face of his emotional display of 'remorse' at the start. He definitely has no remorse since over the course of all the preceedings, all he could think about was how to minimize his sentence, rather than any guilt over what he'd done.
Well it's not lawyer's fault. It's the defendant whose the one at fault for it. Defendant will now be the one taking a long time out in jail for that cowardly behavior towards a defenseless little boy. Defendant heading to state penitentiary for that. Especially with a small to no chance of parole.
Defense Lawyers fight to make sure all evidence the Prosecutors use are solid- they literally are there to represent the balance of justice. I doubt many actually like their clients or client’s actions.
Krassus Maximus it’s generally horrible to think he ended that poor young baby’s life, who knows what that child could’ve become but we won’t ever know now 😢❤️RIP
it can happend, some people are emotionally inmature, cant deal with frustration or anger, and once it get triggered they can go in to a violent rage almost like in automatic, they are there, but at the same time they have no control, until the emotion passes is when they realize what they've done.... I blame his parents for that, but at the same time... he did it, I think its irrelevant how much control he had at the moment, he did it, and he should be jailed, and get mental health at the same time to try and correct where his parents messed up
They just aren’t. Toxicity, ego, and selfishness from the men seems to turn them on sexually and it keeps them invested in the relationships. Idk what it is but I’ve lost my ability to feel sorry for people like the mother here because they choose these dudes, maybe if he just switched up one day I’d feel sorry, but if the warning signs are there, no. I’ll always feel sorry for the baby though…
I'm also in the CPS field. Men should stop abusing children. We should raise boys to play with dolls as they will some day be fathers and caretakers. We should allow and encourage boys to cry when they have emotions. Our society stunts the emotional growth of males and then complains about toxic masculinity. They don't know how to express anger, jealousy, etc without violence and manipulation. Just cry dammit. And the dolls might teach them empathy towards babies. This happens way too often.
@@bobbyhill4118 I don't see how you can make any judgement on the mother. Psychopaths can be charming and say everything you want to hear. And this kid looks pretty harmless on the outside
Yea women usually choose the wrong men, the bad boys, because all the good guys are boring. Well they'll have to deal with repercussions of choosing bad boys. But the situation in this video is totally fucked up. I know that child is in heaven, rest his soul@@bobbyhill4118
1:43 Cute kid. RIP Austin I hope his mother has healed as much as possible and can now look back on their happy memories together with a smile instead of more tears.
No the pain and her guilt will be always with her. This was extremely traumatic for her and her family and very very sad. She will never forget her little boy.
I DON'T KNOW HOW ONE CAN "HEAL" FROM SUCH A HORRIFIC CRIME. HONESTLY, I TAKE IT YOU ARE NOT A MOTHER AND NEVER HAVE BEEN. I FOUND YOUR WORDS AS SINCERE, BUT VERY UNAWARE OF THIS KIND OF PAIN THAT A MOTHER THAT LOVES SO DEEPLY THE GIFT FROM GOD THAT WAS SO PRECIOUS. HER BEAUTIFUL GIFT WAS TAKEN AWAY IN A MOST BRUTAL WAY...THIS DEEP WOUND WILL NEVER HEAL. THE MOTHER WILL NEED A LOT OF KIND AND LOVING CHRISTIAN THERAPY. I CAN'T IMAGINE GOING THROUGH ONE DAY IN THE HELL SHE FACES EVERY SINGLE DAY OF HER LIFE. MY DAUGHTER AND SON-IN-LAW LOST THEIR BEAUTIFUL BABY GIRL AT AGE THREE AND A HALF MONTHS, FROM SIDS. SHE STOPPED BREATHING AND SHE WAS GONE. MY DAUGHTER HAD TO HAVE A LOT OF INTENSE COUNSEL AND MY SON-IN-LAW NEVER WENT TO THERAPY...HE WAS A KIND AND LOVING FATHER AND HUSBAND. HE DIED 12 NOVEMBER 2021. HE OVERDOSED AS HE WAS TRYING TO ESCAPE THE PAIN OF SEEING HIS BABY GIRL DEAD/BLUE EVERY DAY IN HIS MIND. HE DID NOT WANT TO LEAVE MY DAUGHTER FOR SURE. HE WAS ON LIFE SUPPORT AND MY DAUGHTER TOLD NICK, "I WILL LOVE YOU ALWAYS." HE SAID, "I AM SO SORRY, APRIL. I ALWAYS WILL LOVE YOU FOREVER." NICK WAS PARALYZED FROM HIS UPPER NECK AND APRIL WAS TOLD HE WILL NEVER SPEAK AGAIN, IF HE EVEN LIVES WITHOUT LIFE SUPPORT. HE WAS TAKEN OFF LIFE SUPPORT AND DIED VERY FAST. WE BELIEVE HE IS IN HEAVEN WITH HIS BABY GIRL, HIS ANGEL. APRIL'S PAIN WILL NEVER LEAVE. SHE STRUGGLES DAILY WITH PAIN. BUT BEING A CHRISTIAN, SHE HAS HOPE THAT SHE WILL SEE HER LITTLE FAMILY FOREVER WITH JESUS. I DO APPRECIATE YOUR SENTIMENT IN YOUR WORDS. I WAS NOT ATTACKING YOU. I JUST WANTED TO SHARE A MOTHER'S HEART. BLESSINGS~~
Anger Issues But I mean! He's a child and they cry! Like, I know it's frustrating but that doesn't give him the right to freaking beat Austin to death! Like! What thr heck!!
If a child is crying and you start to lose it or get angry...WALK AWAY. LEAVE. its always a choice. If you cant handle it, leave. Call someone else if need be. Leave baby or toddler in a safe location where they cant hurt themselves and WALK AWAY. theyll be ok long enough for you to get it together.
Or better yet, don't pretend that you can babysit. I'm incapable of handling toddlers throwing temper tantrums. I simply cannot deal with it. I have the self-awareness to know this about myself. Therefore, I will never pretend that I can, and I'll never offer to take care of babies or toddlers because I know I will suck at it.
That’s a much better choice than beating the child…but I think he was a bit of a power player, he wasn’t going to let that child misbehave…he didn’t listen, so this punk killed him. So sad.
Not his fault he didn't read the last page of the guide . Hahah Like for real. DUDE if someone beats you from your size and age he can kill how. Thats a baby ... Stupidity next level
@@28Justchecking Yeah I don't even see how that could be used as a valid argument. Not sure how he could say that with a straight face. I don't think I could ever be a criminal lawyer for people like this. No amount of money could ever want to make me help out someone who is so clearly guilty. I would have trouble sleeping at night if I was the lawyer who came up with that gem.
I’m not sure I agree 100%, but there’s NO question that is a possibility. I wouldn’t risk it…prison for life. Take a child’s life, beating him to death…how can it be anything other than life in prison no parole…or capital punishment would even be better. If the kid was willing to give his life for Austin, why can’t he just do a life sentence and not cry like a little beotch.
He’s going to regret every day being in there. Small, white, blond kid with a baby face is going to get passed around that prison block like a cheap white…he’ll regret being alive soon enough.
He wasn't the birth father. She was 19 and he 16. He slammed the kids head on the ground while changing his diaper and put a pillow over his head and punched him repeatedly for crying.
Perfect comment. I sooo wish the judge had said this to that filthy coward and his sleazy attorney. Just to see their faces when they reply "uh uh uh" trying to come up with some bullshit.
Everything about this terrifies me. The fact someone could do this. The fact someone so young would end up doing this. The fact someone could do something like this when they didn't mean to!!? The fact that someone who did this could stand there and expect anyone to listen or have mercy upon them. The fact a lawyer would try to defend it as "lack of babysitting experience"!!? Where does the nightmare end?
Well, we've pretty much extinguished the concept of 'reason' from our society, so it's not that surprising given the type of logic people use on a pretty normal basis now. Like "he wasn't experienced enough in baby-sitting".
"my client couldn't Control his anger" He could've punched a wall, punched himself, punched the sofa... But he decided to punch and beat a defenseless child. Man deserved the sentence
When I was younger I would take it out on my own stuff or a wall, lol. That's crazy attacking someone or something defenseless over a temporary emotion that can have a permit effect.
So not only is he a psychopath who beat a toddler to death, he is also an idiot for leaving such words on record. I'm glad he probably doesn't get the chance to breed the next generation after a 25 years sentence.
his sentence was reduced on appeal to 18 years. he will be out when he is 34. they felt leniency was warranted since he wasn't raised right and had mental health issues.
Luke Dark meanwhile a black kid that was selling drugs to support themselves gets life without parole.. He was definitely right about one thing, if he was a black teenager who killed a kid he'd never be getting out.
Defending the indefensible is very challenging. As a lawyer, you have to pick out the smallest point possible and run with it. There’s not much else he could have said
I agree. Also, he sees the offence as "situational", like it was an exception. I don't think so.... He strikes me as not able to control his anger in other situations and the judge was right to ask what makes the attorney think the defendant won't do it again.
@@Lagoster There is a bunch of mitigating circumstances and factors he can pick from. Previous offences, age of perpetrator, learning difficulties, an offender who suffered abuse as a child. I work in law and thought the lawyer's arguments were weak.
@Jeff grayston ...and to savor every kernal. Times have changed. Perhaps there will be a Popcorn Maker in thePrison Commissary. Oh, and Lube, lot's of it.Have a Nice Day.
Another mind reader! The police should take a look at the RU-vid comment sections and hire some of these experts. It's literally full of mind readers mental health experts, so they would save a lot of resources that way!
He is probably crying for what he is about to gain as well. He is going to gain a husband, a job as official soap picker upper, and he will probably gain a broken broom handle inserted in various orifices.
Look guys it cant be done to sentence him in greece if you kill someone in 12 years you realize from prison its irrational to get life sentence tell me your opinions ?🤯🤯🤯
He is a puny little coward that would be afraid to start a fight with a male of his own age. You can tell by his voice that when he said he cared about the child , he was lying. He did not like the child at all .The child was probably afraid of him which would make him cry even more.
Good job for the judge who wasn't having his crocodile tear's for himself, not the precious life he took. If had really been willing to give his life for the baby he would've taken his sentence that he deserved. As far as a lot of people are concerned he should do life. He took a life and he doesn't deserve one.
I remember this guy. He said he was nice looking and would be let off because of it. I'm so glad his life was not given more value than that poor little boy.
Yep! The kid comes in crying, and having teenage boys myself, I wanted to feel sorry for him. Then they show the baby that was killed and I felt bad for the whole situation, a kid killing a smaller kid. But then that quote was read, and I was like, "Holy cow! That little devil!"
@@anythinggoes5574 I'm pretty sure he said blonde. I don't know or understand why but based on my experiences people with blonde hair are sometimes held in higher regards than people with dark hair. I know Hitler made a big deal out of blonde hair and blue eyes but I don't know if it started with him.
This young person has been allowed to do whatever he wanted since the age of 2. A lot of people who should have parented him correctly are equally guilty of that little boy's death.
That’s definitely the reason, plus he probably know that. He might get his ass beat in prison other inmates, because there some prisoners do not take kindly to child killers or paedophiles.
Yes I agree with the appeal, definitely the wrong sentence. Appeal it and hopefully change it to 70 years without parole. 25 years is a slap on the wrist. Bullshit sentence.
It appeared that way at first, but then the judge produced the evidence of that phone call to his mother and that the offender was just acting in the courtroom to get a lesser sentence. If it hadn't been for that phone call they might never have found out, his act was quite convincing. Crazy stuff.
So his lawyers argument is that it’s not his fault because his anger and inexperience got the better of him? Most people who are inexperienced with kids and have anger problems don’t beat the kid to death!
I was inexperienced with kids when my daughter was born, like everyone else who has their first born, strangely enough we don't beat our children to death.! I hope someone beats this waste of human life to death in prison.
What truly makes him a monster is what he said on that phone call with his mom and I find it so satisfying that the court had that phone call to use for the sentencing
If he had hit the boy ONCE I would have believed the story of it "just being accidental" but as this guy hit the child a few times in a row, this is a sign that he has anger issues and is dangerous to anyone in society who is weaker than him (especially children, elderly people and women)
Whelp from what i was told you could be a god fearing bible thumper and end up in prison and within one year be the gayest inmate in the whole dam prison
"Inexperience in babysitting" Really? So he doesn't know it's not good to beat a kid to death? But those aren't tears of remorse for the child, those are tears of not getting away with it. Still, I bet he's having a wonderful time in prison when the other inmates know he's a child killer.
+Larry Bundy Jr teens shouldn't be watching kids anyways why would you put your childs life in a teens knowing there hormonal. This kinda shit happens all the time because parents are to stupid to not understand teens are not responsible.
You have to admit, you feel so much satisfaction when the judge read what the guy said to his mother: “all I’ll have to do is cry in-front of the jury” what a manipulative monster.
HE IS RIGHT!!!! HE JUST GOT BUSTED ON TAPE!!! STATING THE OBVIOUS!!!! PISSED THE JUDGE OFF!!! STILL DID NOT GET HIS JUST DUE!!! THAT SKIN COMPLEXION AGAIN!!
Anybody might have said the same thing to try to calm their mother down or to try to make her feel better. What little we hear of the defense atty here, he does a terrible job helping his client
@@jgunther3398What do you think should happen? He beat a kid into a pulp. Should they roll out the red carpet for him? Something tells me you are a conservative - I thought you guys were against post birth abortions 😂
I guarantee that if the kid was Black...well, the White judge would have handed down a less severe sentence in order to protect his own reputation as well as his job. That's equity in modern America, right?
Yeah I agree that's not a strong argument..but that's an attorney, it's his job to defend that guy. The attorney probably does not want to defend him but he has to
He forgot to read the chapter in the Babysitting 101 book with the part that says "By any means do not put your hands on a child if it's crying, even if it annoys you."
