After all this, do we hand him/her over to police for false declaration or simply let him/her go.

ECI has not said anything about handing him/her over to the Police. The former Chief Justice of the honourable Supreme court had ruled that such Rule (Rule 49MA) is unconstitutional. ECI keeps this rule so that voters don't take it casually. Thank you for your query.

The presiding officer should maintain the proper documentation of declaration and the 2nd entry in Form 17A.
