Speaking strictly from conversations i had with a friend who owned a greenhouse in NY state... apparently, they are pretty common, and often enforced. You have to consider that the more beautiful the flower, the more people would want it. Also, after the legalization of weed, he told me some strands are quite protected if their uses are medicinal.
