*64: JOBS: LOCAL FIRST* Bill passed in Andhra Pradesh which reserves 75% jobs in factories for local youths from the state. - if an industrial unit fails to find enough skilled local workers, then it will have to train them in association with the state government - The Industry has send an quarterly compliance report. - 75% private jobs across all categories in industrial units, factories, joint ventures as well as projects that are in public-private partnership mode. Idea behind the bill: - Generate employment for the state. - Preventing locals from going far off places for livelihood. - Industries make promises to local people and acquire lands but after setting the units, fail to provide jobs to local educated youth. - a skill development centre will be set up in an engineering college in every parliamentary constituency to train educated youth in the skills required for the industry Negative aspects of the bill: - Political move - Sells very well among people. - Other states going for similar move: MP or Telangana. - Dangerous to unity of country: Social tensions. - This will hurt investment to the state in turn reducing industries & jobs: Industries need policy stability & flexibility. - States already on the verge of demanding reservation in private sector, this bill bolster their demand. - Negates the advantage of labour surplus - prices of produced goods will go up. - May lead to Violations (of the law), Exemptions (to certain industries) & Corruption. Challenges: - Legal aspect: - Article 16: No citizen shall, on grounds only of religion, race, caste, sex, descent, place of birth, residence or any of them, be ineligible for, or discriminated against in respect or, any employment or office under the State. - SC judgement in Jayant Sinha case in 1984 on domicile reservation permitted it to some amount in educational institutions but heavily criticised the move. - Skilled workforce: Is AP already a skilled workforce state waiting for jobs - May open up Pandora's box for other states: Initial reservation was for 20 yrs at the initiation of constitution but it's still going on: SC had to draw contours through Indra Sawhney & further judgements. Way Forward: - Training the local youths - skill development. - Encourage investment by incentivising companies. In Maharashtra: Dalit Entrepreneurs. - Using CSR funds: Industries get tax benefits. The state governments must fulfill the aspirations of the people within the parameters of the law. Encouraging industries & producing skilled workers should be the goal so that people won't be limited to the local rather can find jobs in whole India. Only then we will be able to gain demographic dividend with the labour surplus reducing the cost of products & integrating the states's economy to build a better & stronger India.

Jobs: Locals First Policy Locals first policy: what does it mean? It sells very well politically. It is a populist move. Features: Exempted industries- Cement, coal, fertilizers, some industries which are fairly well developed in the state. It fulfills the aspiration of the electorate. Will this bill stand the scrutiny of law? Equality is deeply enshrined in the constitution. Article 16- it mentions about Public employment. Regarding private employment, changes can be made by the parliament by making a law. eg: Domicile Reservation in Educational Institutions law- some amount of domicile are permitted as the state has invested in their education and its in the state's interest to promote education. Caution mentioned in the judgment- this provision can lead to fragmentation of the country. Criticism: Economy: Investments might reduce in states which raise such stipulations. The advantage of producing at a lower cost will disappear. There may be a flight of capital from India to Africa where many countries are running advertisements calling Indian entrepreneurs to invest there. Counterproductive for the states. It will affect growth at some point. It is kind of a curb which will impact innovation. eg: Maharashtra- if any company gets an incentive from the state government then that particular company will have to have at least 70% of native unskilled workers. Karnataka- for Kannadigas a law was brought out but it exempted IT and Biotech professionals. Employment: India has a comparative advantage in terms of a large pool of labor. And if employment to local people in the blue collared category is enforced then this advantage (producing goods for the local market or for exports) could get negated. Job creation might also be a concern. Unemployability might increase. Education: Higher education might get affected. And if a similar stance is adopted by western countries then where will the students go for higher education. Unity: It can lead to the fragmentation of the country. Other states might follow the path (Open Pandora's box ). eg: In Tamil Nadu, the Pattali Makkal are demanding 80% reservation. A threat to unity and diversity of the country. India is like going back to the stage when the country was ruled by 500 princes and there was a kind of fiefdom. (Isolated island might be created). Lead to social tensions. Society: People with transferable jobs might not be able to adjust in any state. These policies may lead to corruption and dishonesty and so is a threat to social harmony. There might be a demand for SRC on the lines of NRC(National Register of Citizens). Way forward: 1) Incentives for companies that train local labor. (Incentives in the form of lower electricity charges or land use charges. Something on the lines of CSR). 2) Policies which bring out the best in people. 3) This particular law should be properly vetted. 4) Economy based reservation. 5) Maharashtra encouraged Dalits to set up industries and thus job was created. Other states can follow the same path.

It clearly shows the immaturity of Mr.Jagan reddy. How can it is possible. What if the other states like karnataka,Telengana,Tamilnadu, impose the same LAW and if all andhra ppl thrown out of respective states, is Mr. Reddy in a position to provide jobs to them?

When the people of Andhra Pradesh with all their hard work built Hyderabad as economic power, central government simply gives it away to Telangana with out compensating Andhra Pradesh.. if that is ok then the Andhra Pradesh will try to do all in its power to protect its economy and locals especially considering that poor economic situation the central government left it...

It will be counter-productive move →as additional compliances will not attract investors. →Also, Andhra Pradesh has one of the lowest fertility rates which implies the aging population will be on rising. 2. Cement, coal, fertilizers, some industries which are fairly well developed in the state are exempt from this law. So it is a notion that you can reap the benefits of employment reservation. Yes, Andhra People Played a big part in the development of Hyderabad. But now it is a closed chapter. We need to focus on the development of the model state for the country. We are topping Ease of Doing Business Ranking for the past 2 years. But these kinds of moves will drag back the into fiscal clutters. If u really want to protect the economy first thing u need to do improve the economic condition of the state. This step taken by the government was not only hurting the economy but also violates the basic principle of Equality enshrined in our constitution.

The Problem in our state is the lack of employment opportunities. We did not have the situation of Employment opportunities and they are being totally grabbed by migrants. In order to overcome the problem of unemployment, we need to address the cause of it. By providing reservation without improvement in employment opportunities ain't gone improve the situation.

World should think about this seriously...Development should be decentralized and everyone should be able to get jobs at the own places. Reduces a lot pollution, saves a lot of energy, money, time. currently we are populating (and polluting) few cities, making them concrete jungles.

Who is responsible for training the youth of the state to make them employable? If the state cannot do it, why transfer that responsibility over to the industry whose primary motive is profit. Not even China's local governments have such laws in place. The Chinese local governments go to the extent of offering full tax breaks, free 24-hour power supply and rent-free space for launching companies without ever worrying about employing locals. Why? Because the Chinese administrators know that in order for this to be a win-win situation, they need to let the companies grow and start generating profits which would be taxed after they break even. This tax-income is redistributed in training local youths, infrastructure, attracting more startups or global players in an almost unending competition between local governments who plan to outbid each other by becoming more attractive to companies. The reverse is happening here in Andhra Pradesh. I am thoroughly disappointed with these turn of events. Not only is this over-protective and based on populist-sensationalism, but downright biased. This will exactly have the opposite effect. Businesses and companies will simply move shop to a state where such locally-populist measures are not in place and leave the state's with fewer jobs (much-needed) than they already have. The Tata's shifted an entire Nano manufacturing plant to Gujarat after unfavorable conditions in a small village in West Bengal. What do you think this piece of populist legislation will do?

Did central government has done any thing needed to Andhra Pradesh so far that should be done like driving any corporates to set up any firms in AP before some discussions like this? Hope look into the huge work force and how they are living in other states leading pathetic lives.

@@karthikn8536 i guess you mistook him. He is saying exports should be limited in proportion of workmen diversity. However, this is not good for economy in short term but better results would appear for backward states. In the other hand, making state reservation is not good for unity. It would increase regionalism.

75 percent to locals.. I don't see more than 15 cerent in industries for labor force and allied sectors even in IT it is mostly 30 percent.. Locals will be more every where..

Though its in bill stage it would be very difficult for it to stand Legal scrutiny . U/A 16(3) its only Parliament which can provide by law prescribing "Residence" as the ground for qualification in certain classes for employment under the state not a State Legislature.

The Sc/STs in our village discriminate others based on wealth.. As they are wealthier in my village after going Kuwait etc.. They got three acres church ⛪ biggest entire in my district and they got 11 churches and only two temples... I am an atheist but the point is.. All the churches got inverters but the two temples which are 50 years are in demolishing state... The president in our Village is ST at present in other cases their puppets.. They got cement roads in their area but our roads are with red soil... They keep christ meetings and only critise our gods and compare with satans... If any one opposed it they will keep SC/St atrocity cases on us.. So that we don't get any govt job.. Since we are weak.. We are discriminated

@@ramanareddy2308 I didn't say any of these, it's your false assumptions. I never have intentions to hurt anyone's sentiments. Look any Pvt. company investing under the PPP model do have to provide jobs for the local residents under their contract agreement. But to enforce this by making a law would make, certain highly skilled companies to opt-out from that state or to provide low skilled jobs to the local residents , which no one would like to. (except neo populists ha ha) Moreover, they have given exemptions to certain industries that would further aggravate the condition as everyone will want to get exemptions and that in turn will give rise to corruption. Hope now you get it.🙂

@@himanshu0921 hello people never asked for such a type of reservation infact people here wanted more industries and more investments to come up that's what the Vision of our former chief minister n.chandra babu Naidu but here in case of jagan Reddy it's different he is unable to bring more investments and industries so that's the reason why he come up with this idea and it's all political he lacks vision don't worry it will get scrapped in a couple of years Soon. And don't drag people here people are skilled and talented that's the reason most of the people are in countries like American.Even CEO of Microsoft is an Andhrite.

The economy in Andhra Pradesh is mainly driven by local MSME units and large industries . Hence despite the legislation , the economy will continue to grew steadily over the long term.

If the person who has good intentions for his people then we may get positive results.. The main aim of industries is to get profit.. They needed skillfull workers for it. Govt of Andhra Pradesh is ready to invest in training it's students for such standards.. I think It's good move with good intentions.. A clarity on unemployment on the state can be determined, instead of making dilama of students and people as all these days happened in every state. Its huge challenge to Jagan govt with good intentions for long run. Jagan is the person who lives upto it's promise.,so if it works positive,entire nation is going to look on this.

Domicile status in local state is very much flawed in nlu admissions look at the criteria they setup it is disadvantage to the locals so those who say there is domicile in education of higher studies needs to take a relook there is a case filed in Hyderabad high court by a student of llb of 5 years who studied in nlu Bhubaneswar but got denied admission in nalsar for llm because she had not studied in local state prior to llm course though she is a native resident of telangana so why create ruckus for employment when u r so stringent for education

people in general will ask for things they require at the moment and thats very natural and justified... and so is the problem of employment around the country...but the legislation and the executive are expected to work with a broader vision to keep things in check for the very sustainability of the system and at the same time try to provide peoples all the basic things in best possible way. Now , the need of reservation was basically the representation of every group at every place but when the same reservation policy is being used to appease the different section , it clearly means that demand is greater than supply and by reservation we will provide you the first opportunity to get the job from the limited seats. How long would it keep the bubble under control..? ultimately we need to create jobs for all . and clearly we cant do it without private enterprises . Now, every such step to regulate the private firms working style ultimately brings hindrance for the firms to grow. What we really are doing as a nation. we are converting it into a mess.

The people who giving land to the industries are not getting compensation as per market value. And further they are loosing future income opportunity. The people who are giving lands to industries are small and marginal farmers.we all know what is the socio-economic conditions of these people. If you take out their lands for industrial development, how can you secure their future generation's. If we think from people side it is welcome step. Though every step& decisions consists some negatives also. For example after independence our country went for land reforms, we know how far it was successful. Before criticizing the step once give some suggestions to fulfill the need of people...thank you

Just now I saw the ap assembly videos on this particular bill. AP CM SRI JAGAN MOHAN REDDY Garu and concern minister clearly explained the details of the bill. One more important point they clearly said in that particular bill is 'if the industry not finding the skilled people they can opt out from that'. As per bill local means state of ap not particular village. And other 25%jobs are open for all. Really bit is good bill.

Bro please wake up industry and investment comes to state basing on that state capabilities and viability to make profit it won't just stop coming if some govt passes a bill to reserve 75percent to Locals.see ap people are better skilled comparatively to other states I am not saying they are the best am saying they are good enough.so I won't see a problem in compromise of merit is not there.so relax his govt is trying to fulfill the aspirations of the people of his state.basically you are trying to say to govt u won't do your duty to provide jobs to people who voted to him to.power.wake up brother.

@@himanshu0921 actually according a recent report, Andhra people are the most recruitable talent pool in the country, this move is just a political move to satisfy the CM's voter base. He just wants shortcuts and doesn't want to invest in skill development since he has to spend money on populist schemes to just get himself elected. But such schemes will damage his base more than others actually. Since they'll be trapped with the welfare policies n there will be no skill development investment by the state. In Today's India,. companies can't be demanded they can only be incentivised else it'll backfire bad and they'll not come to invest even if we touch their legs n have to give them more bargaining power. A CM must be a good negotiator not like the one who passes absolute orders.

@@AR-jm8ce usually people don't care about the long term consequences. That's where role of gov comes into the picture. For ex if my gov announces unemployment allowances then that will sound fascinating and immediately majority from my state will love that idea. No one will notice the fact that by encouraging investment and providing gov vacancies regularly will be a much better and long lasting idea. One of the state exams hasn't been completed since 2014. Pre result is still awaited in my state.

@shivam gupta Ok. It is in the constitution itself that Caste and Place of Birth can be considered in employment. Why do you think people from one state dont compete in other states Public Service Commission exams but they do compete UPSC and SSC exams? Because jobs are reserved for local people. And in case of Andhra Pradesh there is sub regionalisation in this also. Andhra Pradesh has zonal system. State is divided into 2 zones( in united andhra pradesh 4 zones). Govt created zonal posts and only locals of that zone are eligible for the zonal posts. And finally the argument is place of birth and residence or locality are considered in providing employment opportunities and it is constitutionally valid.

You should know that no industry comes up in UP Bihar because of the law and order situation even if the government tera the mafia rules and politicians are hand in glove in south ren india the industry is not affected by these factors even though to some extent this is also true here

The domicile based reservations are allowed in every state and is enforceable as well but simply based on place of birth or origin of a person it can't be allowed as it amounts to discrimination under article 16. These kinds of reservation might work out so far as unskilled workers are concerned but when it comes to skilled workers these may actually be detrimental for company's growth as there should be no bar on talent pool from which a company can hire and can even be seen as an impediment for ease of doing business. These are also used as a political tool to lure voters by regional leaders and is highly short sighted vision. If we want to create one nation we will have to do away with such legislations otherwise it will be a huge barrier when it comes to movement of people across country which is vital for creating one nation. Imagine if princely state had put forward a similar demand we wouldn't have the India that we know today. It is also against the spirit of globalisation which has opened doors for Indians to work anywhere in the world and earn a living and we all frown upon Trump's decisions or announcements which curtails immigration of skilled workers from developing nation, so the same logic should be applied for domestic immigrants as well.

Guys these South Indian states are very possessive about their states. I don't know why they are suffering from xenophobia. In my state I have always welcomed people from any state. But simultaneously i have observed that these people don't want to mix with others. God knows about the fear they have. Even highly intellectual person of these states will have the Same opinion on such issues. They are making separate nation in our nation. I don't have any strong urge to go there and I am not having feeling that this bill has done unjust to me. As a rational i am giving the opinion

Futile debate.. i don't think there is any solution . These experts are talking about article 16 and telling about the -ve impact of bringing domcile in reservation but actually nothing is going to change... my father was freedom fighter in azad hind fauj in UttarPradesh(now uttrakhand) but i was discrimnatd in Uttar pradesh .I was rejected in service bcoz i will not get freedom fighter qota bcoz my grandfather after division of UP becomes domcile of Uttrakhand..i am a domicile of UP but these are only loud talks nothing fruitful just relax and face the consequences 😂😂😂
