To think Matt Hoss could've been well respected in the H3 community if he just embraced the meme. He could've gotten quite a following from that, like many others featured in H3's videos.
Not only did a judge have to watch this, lawyers on both sides, including paralegals and law firm assistants (both parties have a lot of money) watched this, multiple times. And there’s no doubt they watched a lot of H3 and Matt’s other videos to build the case all that. I love the thought of some 60 year old seasoned lawyer watching h3’s video about the enema lady and taking notes like “hmm yes this is indeed a satire media and should be represented as such”.
This case never made it into an actual courtroom. It ended with what's called a summary judgement, essentially a "trial on paper": Ethan and Hila wrote up their case and sent it to the judge, who ruled in their favor. RU-vidr Legal Eagle has a video explaining all the steps in a lawsuit, most of which end without ever reaching trial. (Also, this case-- Hosseinzadeh v. Klein-- is mentioned in all of his video descriptions!)
Imaging going to law school getting your law degree becoming a judge and having to watch a middle aged man running and jumping over some walls in pursuit of a paid actress
Imagine the Judge watching this, pausing it in the courtroom and saying, "You know, Mr. Klein, you could've just added cabbage and called it Holeslaw."

Actually this would’ve fallen under “Civil Case” and the judge is probably a civil judge which means they only deal with lawsuits, legal disputes, land disputes, and other legal matters. Crimes wouldn’t fall in this jurisdiction, so really the judge **at worst** divorce fillings, people trespassing while someone presses charges, or very mild crimes with the main focus being the wanting of compensation by one party. They never really would’ve seen murders or serious gore, maybe the lawyers if they represented a murderer, but never the judge.

I think the defamatory claim was secondary to fair use, they essentially put this guy's whole video in their reaction video. Kind of like an "add it to their tab" attitude
If Bold guy just contacted Ethan to do a parody of the video with Ethan as the girl, he would have gotten a lot more success than his pathetic lawsuit could have ever done.
In retrospect, the thing that strikes me is just how polite and cordial their criticisms are. They never make any vicious personal attacks. The fact that he sued them over this is laughable and I'm glad he fell on his stupid creepy face.

I really don't think he did it because he was offended. I think he *REALLY* attempted to sue just to extort money from them. If he had been offended about the video, asking them to take it down would have been enough. That's what most people do. But he literally contacted a lawyer and demanded $4,000 in 24 hours or else. And the only other compromise he gave was to force them to promote his channel and upload specific videos(and I think send him the money they made from those videos). Then when he figured out he would likely lose the lawsuit on copyright, he attempted to sue them for two other issues he and his lawyer made up in order to hopefully get something out of it. So it would seem his entire plan was based around the idea that people would not fight against him in a lawsuit. And agree to comply with his demands. I mean, it was completely calculated. Yes he had a lawyer, but the entire situation reeks of a guy that tries to abuse the flawed law system to extort money from people. Whats scary is what if he has done this before? How many people gave into the 'Pay 4,000' or 'promote my channel' demands before he picked a fight with h3h3 and lost?

Well the modern manner of the justice system is a sword that *no one* can use force on it because its handle is also sharp enough to cut anyone is hand. The difference between the pass and modern justice system manner is that we can see and we can hear if there was a crime or not... The old justice system has this women with blinded eye and balance(form of election) and sword. In 2000 era. the technology allow this same justice *women* to have laser scan eyes (pin pointed problem/solution), laser sword, and digital balance systems. hehe So it`s no more about the hit but the following orders back in good conduct/stabilization.
Literally Figurative It establishes precedent showing that reaction videos such as this one, that utilize clips of other people's works and add criticism and commentary, are indeed fair use. Precedent is everything in our system of law, because judges rely on prior decisions to decide the cases before them.

That's probably the best thing about this. I've watched so much commentary community drama go down & it usually benefits the smaller creator that gets made fun of. Instead of using this as a window to grow his audience, this idiot tries to make a quick buck & sue. Now all he go out of it is millions of people who think (know) that he's a tool.
