Ok so the pinned version of the stock has a screw that prevents the button from depressing, therefore it would be in a completely locked position with it installed. Kinda like how you can pin ar stocks in any position. Plenty of Californians have pinned "adjustable" AR stocks and its considered perfectly legal. Theres one at my local shop right now.

If you disassemble the rifle, thus making it a non-functioning paper weight. Then one can take the pin out, and change the positioning of the stock, and re-pin back to a fixed positioning. Once this is completed, you can re-essemble the rifle. This would be the only way to change the positioning of the stock.

so if one has the california version of 1014 and does not live in california, would one need to only by the 3 position tube as well, or would one need to get the whole collapsable stock?

Thank you for your thoughts. Not trying to flame, but considering that the law is ambiguous, and there are laws and compliance such as for muzzle devices being pinned and therefore “fixed”, there is IMO a good argument that one had reasonable cause to believe they were in compliance with the law whether or not they are successfully prosecuted. Videos like this, while well-intentioned, actually serve to an opposite effect, giving the courts more material to say “hey, it’s actually been openly discussed and you should have known that it provably wasn’t compliant, therefore you maliciously disobeyed the law” and leading to harsher sentencing or more success in prosecution. Just a thought. I would be willing to believe that a pinned stock is a fixed stock, and fight for that if necessary. Pinning the stock is already a major inconvenience considering you need to remove two screws that hold the cheek plate on to even access the pin screw in the first place. Giving up even more rights “just because it might be illegal” is why we’re at where we’re at in CA in the first place. But I digress.

If it collapses, it’s a collapsible stock. Period. The law isn’t ambiguous on this point. I don’t like it any more than you. But it’s a felony. Feel free to disregard the law, it makes no difference to me, and you are not alone if you choose to…

Finally the video I’ve been looking for got my Benelli M4 and very disappointed with the stock I thought I was going to get the adjustable collapsible stock all I got was a regular one due to the fact I live in California any recommendations what can I order?

The law allows for one to disassemble and clean the gun. Therefore the stock can be taken off and cleaned. And whose to say it was in the 2nd or 3rd postion?

I guessing a collapsible stock with a fin wrap would be legal even though most wouldn't want to do that when handling a shotgun. And yeah modifying the position of a shotgun in ca would only be okay when not in a state of being a functionable firearm to do the work.

There is one argument to be made, that if this gun is published on an approved firearms list in CA, that any prosecution for owning one in this fixed position would be a violation of due process if that notice is sufficiently misleading

Do any of you drive a vehicle? It probably has an adjustable driver seat...and adjustable mirrors. It actually makes driving the vehicle safer. As a 56 year resident of California, I can tell you that California doesn"t care about safety. they want to restrict your constitutional rights.

thanks for your insight on this. has anything changed with the skeletonized (but fixed stock)? it appears to be more securely fastened to the point where its near impossible to collapse (or to even take off the recoil tube to change the stock..) with thread locker... there's one in stock in the bay area and being marketed/sold as 'ca compliant'... thanks..!!

I’d love to do one. Sort of like a youth stock. People like putting them on Remington and Mossberg shotguns - but the Benelli market is so small. Maybe someday

*So you live in California how are you able to sell collapsible stocks and the 3 position tubes? If you live in California? I owned a m4 with the 3 position collapsible stock when I moved to Boise Idaho and I ended up selling it DUMB MOVE! And I been wanting to buy another with the 3 position but I live in commifornia again :( I think I’m just going to buy one with the 3 position a s say 🖕🏼 to their BS laws plus it looks so damn PURDY!!!!! I’m just don’t know what color the H2O IS growing on me but the black is sweet too! By the way You have a great RU-vid channel I always dig your uploads keep up the great work*

That interpretation of "collapsible stock" is not the accepted interpretation. Take a look at the hundreds of different models of featureless ARs and AKs with the same style one position buffer tube that accepts any mil-spec slip-on stock. Also take a look at Spikes fixed stock drop-in rubber conversion kit. All accepted as "fixed stocks" despite the fact that the stock can slide back until it hits the one notch and stays in place. If they did try and make a test case out of you, your attorney would make mincemeat out of them for it. Because 80% plus of all California Compliant stocks come that way.

Good evening from chilly Michigan! First time viewer, first time commenter. Great show, excellent advice. I've been looking around for a couple of years for upgrades with zero interest in doing anything unlawful. My M-1014 is hands down the nicest shotgun I have ever used, let alone owned! Only one drawback is the funky stock. This unit is like the one you described early in the video, the unlocked butt will rotate and collapse 1/2 inch but never lock. The unit has it's stock on a rod, not the 1/2"+ tube that you showed. So, what can I do to upgrade this stock in Michigan? And once that is resolved (either way) I want to extend the magazine. The only way I have found is to replace with all Benelli parts, and they are made of unobtanium right now. Any advice for other enhancements that are lega (or not illegal)l in Michigan?

You should make your gun 922(r) compliant now - that stock means it is out of compliance. The best way to do that is to put an American made 7-round tube on it, as well as an American made trigger kit. As for the stock, you don't need a new stock, you just need a new 3-position recoil tube. We actually have those in stock right now - they're very hard to get.

I see your logic but it’s flawed. A pinned stock can’t be adjusted. By your logic any stock that can be sawed off is an adjustable stock. Adjustable doesn’t mean it can be adjusted back to original position or length it just means can be changed from the position it’s in now. I adjusted the length of the barrel using a hacksaw. Anything can be adjusted but using common sense it’s means on the fly or readily adjusted. Whenever there’s ambiguity in the law It’s favors the defendant ( which is us ). A pinned stock is no longer adjustable therefore it’s no longer a collapsible stock.

pin it and weld it. so its not collapsible stock. collapsible designed stock. if pinning it is illegal, than all the stock or brace pinned it semiauto rifle/pistole who sells, Turners outdoor, Ammo bro.etc. Yes if you can take out pin and collapse and put pin back, that's collapsible, but if you can not take out the pin without breaking it then i guess its not collapsible.
