I was stationed at Camp LeJeune off and on from 1976 to 1985, I now have cancer due to the Water Contamination at Camp LeJeune. I was diagnosed by the VA, I am being treated by the VA. The Va itself stated it is "Presumed" that my cancer was caused by the water contamination. The VA is part of our government so, why is it taking so long for the Dept. of the Navy/Judge Advocate Generals Office to settle my case or any case for that matter. Chances are that I may not survive long enough to see a settlement if this is how the process is going to proceed. I served my country with honor for just short of ten years. I volunteered to put my life on the line for my country. Now I have discovered that a part of that was to defend the very same government that allowed for myself and so very many others to be knowingly and willingly poisoned in a manner of speaking as they had done. The government admits guilt in this matter! The VA diagnosed me with cancer. The VA is treating me for said cancer. The VA states, "Presumed to have been caused by the Water Contamination at Camp LeJeune. If this were a typical civil case it would have been settled by this point given the evidence provided. So why is it the government is allowed to take as long as they choose to settle. *****Enough of the games with the lives of those so negatively affected by the choices of the very same government they volunteered to defended with their lives. ***** Enough of the discussions, enough of the bureaucratic nonsense, enough of the delays and procrastination.......the time is NOW to do the right thing! Make Whole ALL those so drastically affected by the Water Contamination at Camp LeJeune not a month from now, a year from now, or when Congress, the Dept. of Navy, the Dept. of Justice decide to do what's just. It needs to be resolved IMMEDIATELY. I can state that I am honestly proud to have EARNED the title of a United States Marine and I will always be a Marine. However, I am exceedingly ashamed to have served a government that had done what it did to me and so many others. I don't ever want to hear "Thank you for your service" from any politician.
My lawyer told me that the max amount they will get is 25%. They were initially asking for about 40% but are still working on my case. received an update from them just recently. If I were a lawyer, I would do the right thing. These were families of veterans and veterans that served our country. The least we can do as fellow americans is to show our appreciation and not try to bleed them for all the money they get.
This is a fair and just solution. It was the governments representatives who caused these events. It's only fair that they pay their fees and charges. But then where is their allegiance? To that from which they receive their gains.
@@philliptipton9371 The judges are paid by Congress also. Does that mean one can never win against the government? It's not just about who pays, but where obligations lie. Even when there are attorney fees out of damage awards, the money still comes from the government. I am talking about maximizing what the victims get.
My question here as a conservative is why didn't Trump push for the PACT act to be pushed through and signed while he was in office. Since he is pro military and vets. And i voted for him twice. Why did it take The Potato Head in office currently?
This has been my question as well. I'm going to vote for him a third time because America needs him. This none politician embarrassed the swamp by doing more for us than any other president since Lincoln all while dealing with obstruction of the most vial. It's possible that he simply ran out of time, not empathy, abilities or energy. With the globalist's and China's COVID 19 attack upon the world and multiple fraudulent impeachments, he is the only candidate who could have accomplished what he has.
I was from conception, in utero, born on base in 1971 and lived there to age 1 or so. It really screwed me up mentally and physically. $5,000 a month in meds for years now. Multiple specialists. Have tier one and 5 others. Should be 8 including my epilepsy. All my health issues should be blamed on them as our family tree other than my mother and father that were there have none of this. My brother and sister that were born years later off base have no health issues. I have wondered all my life why I had so many issues even with my healthy lifestyle. I feel it aged me by 30 years or more. I was shocked to find out after the lawyer submitted my claim that they are taking 40%.
I wish you all had talked more about the law rather than spending almost all your time on lawyer fees. "What happens next?" made me think this was going to be of interest to victims generally rather than a discussion of what is fair for fees. The fees should be an afterthought.
RiGHT! AMy lawyers said that in this case the most they can charge is 25% by the law and they are still working on the case so all this debate about how tge government should mind their business is neither here nor there. Take the 25% and keep it moving. Stop trying to suck all the money out of the victims.
Considering a large majority of these cases will be filed on behalf of the victims by their children, many cases will payout on the lower end. The govt knew this and is banking on the fact, that obtaining medical records of victims would be extremely difficult. 20yrs is how long most hospitals and doctors offices will hold patient information. In my case, my mother, who miscarried on base, passed 31yrs ago! So far, I have had to do ALL the footwork while the lawyer waits for me to get everything together. It’s just really hard to justify 40% to the lawyer when the paperwork, no matter how much, will be repetitious. They’re not going to be deciphering the Dead Sea Scrolls
Your not alone as I asked for paperwork for my dad at the same place he passed at staff looking at me like ok first there will be a fee so on an so forth I’m thinking. Of many other places. To only get a callback from the firm. From a. Teen or any non attorney just to hear repeated requests i ask them Mind you a year in tell me something I don’t know or at least li and say something new about discovery in my personal case no just what you sent at 40+%. As firms brag we have thousands of camp la cases then i reflect seeing so sort of rubber stamp jusifing unknown process going on an shopping cart full of veterans lives in thousands of folders anger charge 1:02:27 Me for time and discovery. Thank you please excuse my ignorance in writing former spe student Ty my sister born in 70 off bace water on the brain passed in 3 m I don’t understand could be from that to I get it good luck
There are veterans & family members who had to live with these problems caused by this toxic water their whole lives. Please try to justify a lawyer getting anywhere near 50% for a few months of work. That is ridiculous. These people suffered and were not allowed to sue the government, and a greedy lawyer thinks their entitled to get more than 30% is laughable. Majority of these cases will likely end up settling . . Meaning even less work for greedy lawyers. 50% Fee says the lawyer suffered equally as much as the veterans, and that is absolutely ridiculous
Then you qualify for a claim. Did you fill out the legal court claim on the internet? Also be sure to request an MGUS test as it is needed to prove your claim. I am good to go and have been approved just waiting Doc
I would be more sympathetic to the "free market" argument if there were one webpage that compared all the different firms and what they charge. How far does this unlimited fees go? 70%? 80%? 90%? At some point, someone has to say no. These victims have earned their right to these benefits. The lawyers just come along at the end and because it might be a little complicated, the lawyers want to gorge themselves. Next time, let's make it an SSA benefit.
keller lawfirm is one of the leadership team. I am sorry I have to disagree on the caps for attorneys. I believe there should be a cap. The attorney did not suffer the veteran or family did. I do not think anyone should get over a third. should cap at 20-33 percent only.
i have talked to approx. 50 lawyers. there is a lack of communicating the fees.if a vet wants to he can file his own claim an save the 20 %. an then can he hire a lawyer at 25%.The problem is the lawyers just say 45% without explaining the breakup. the vet can add a vigorous bonus % to cover better lawyer efforts. also add 3%to handle appeals.
Setting caps is like imposing a tax. It affects all lawyers, not just your firm. That's why it is not a takings any more than a general tax would be a takings.
Never speaking directly with your attorney meeting on line with paralegal trying to get your question answered being part of a group of 100s maybe we should get a group rate.I hired an attorney in September and my case got filed in May not in the first 500 clients to be filed.
The government charging money on the injury and accidents they caused by neglect of bases soldiers and more. Funny. Fighting over how much money to charge out of the award received from those who inflicted all the personal claims. So we’re paying money to the liable and accountable parties. for the injuries lol😂
