In this video Heimler walks you through Unit 3 topic 3 (3.3) of the AP Government curriculum which deals with the first amendment's protection of the freedom of speech. None of our civil liberties is absolute, and so even free speech has limits.
The Supreme Court has established limits for speech over time. In the required case Schenck v. United States, the Court ruled in favor of silencing speech if it was deemed a "clear and present danger." In Morse v. Frederick, the Court ruled that speech could be silenced in schools if it promoted illegal drug activity. On the other hand, in Tinker v. Des Moines, the Court ruled in favor of students who wanted to use symbolic speech to protest the Vietnam War. The most recent iteration of a test to silence speech is the Brandenburg Test.

Studying for ap gov is making me realise how ironic the current state of America is. Just today the police arrested peaceful protesters at Columbia university for protesting the genocide of Palestinians. America truly does not change.

Hi there! Really helpful video though I have one question. Why wasn't Donald Trump arrested for inciting the Capital Hill riot similar to Charles Schenck getting arrested for encouraging to avoid the draft?

Well, the short answer is that sitting presidents cannot be prosecuted outside of impeachment trials. And if you were listening carefully, a lot of people were speculating on whether Trump’s speech passed the Brandenburg Test. So there you go: AP Gov is useful!

Much of the 1st Ammendment was originally meant for the assemblance of free ideas and Assembly etc, keep in mind this is LONG before tape and videos, etc came along, - and thus there are these so called First Ammendment Auditors - which is a whole other Animal, and I dare say if you know anything about animals they can have their pros and cons...

I don't think we have to be familiar with them if they are non-required. I think for SCOTUS FQRs, they do a brief description of the cases they are comparing to the required case.
